OfHKO.IH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Bur icl Director of Planning Services DATE: December 21, 2010 RE: Approve Release of Utility Easement on North Side of East Packer Avenue on Property at 2737 Harrison Street BACKGROUND Oshkosh Corp. requests Council to release an existing stormwater /public drainage easement on the north side of East Packer Avenue on property at 2737 Harrison Street. ANALYSIS Several years ago, the drainage way on this property was rerouted to the west and storm sewer constructed along Packer Avenue, which made this existing easement obsolete. The easement is located in such a way that it hinders the owner's ability to expand or improve the site. The Department of Public Works has reviewed this request and has determined the easement area is no longer needed by the City and can be released. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its December 21, 2010 meeting. Approved, City Manager ITEM: RELEASE OF A STORMWATER/PUBLIC DRAINAGE EASEMENT AT 2737 HARRISON STREET Plan Commission meeting of December 21, 2010 GENERAL INFORMATION Petitioner: T.R. Karrels and Associates Owner: Oshkosh Corporation Action Requested: John Kieckhafer with T.R. Karrels and Associates, on behalf of Oshkosh Corporation, is requesting the release of a stormwater /public drainage easement located at 2737 Harrison Street. Applicable Ordinance Provisions: N/A Property Location and Type: The 35.75 acre parcel is a manufacturing center for Oshkosh Corporation and is fully developed. In conjunction with the sites development, a surface stormwater drainage easement was established and contained a drainage ditch that served Packer Avenue and the immediate area. ANALYSIS Over the years, the drainage way was rerouted to the west and storm sewer constructed along Packer Avenue. The easement area no longer contains any drainage features for public stormwater runoff and is unneeded by the City of Oshkosh. Additionally, the easement is located in such a way that it hinders the owner's ability to expand on their structures or improve the site. RECOMMENDATION /CONDITIONS Staff recommends approval of the release of the stormwater /public drainage easement as requested. The Plan Commission approved of releasing the easement as requested. The following is the Plan Commission's discussion on this item. Mr. Thoms inquired if the drainage ditch was properly abandoned. Mr. Gohde replied there is no pipe underground, only a ground swale and the lot has been graded to address drainage. Motion by Thoms to approve the consent agenda. Seconded by Hinz.
