Problem/Violation of: MUN 17 -36A — Failure to maintain a structure free of conditions
reflective of deterioration and/or inadequate maintenance.
Brief history review:
6/17/09 — After receiving a complaint an inspection was made of the property located at 338 Bay
St. At inspection the following conditions which violate MUN 17 -36A were noted:
• Broken and boarded up windows.
• Holes in the fascia and soffit areas.
• Chipping/peeling paint found on siding, windows and trim.
• Deteriorating stairs.
• Sagging roof.
• Poor condition of shingles.
A Correction Notice was issued on 6/18/09. The owner did not respond to the Notice.
In May, 2010, following a complaint, a Correction Notice and citation were issued for failure to
maintain the grass and weeds according to Municipal Ordinance. No response was received from
the owner and the property had to be cut by the City.
A second and final notice was issued on 10/6/10 for the uncorrected exterior violations. The
notice was returned as "undeliverable and unable to forward" by the post office.
City Ordinance and State Statutes state that if a building is old, dilapidated or out of repair and
consequently dangerous, unsafe, unsanitary or otherwise unfit for human habitation and
unreasonable to repair, order the owner of the building to raze the building or, if the building can
be made safe by reasonable repairs, order the owner to either make the building safe and sanitary
or to raze the building, at the owner's option.
I am requesting a Raze or Repair Order that would require the property located at 338 Bay St.
to be razed unless the property owner complies with MUN 17 -36A by undertaking the following
required actions:
1. All broken or boarded up window shall be repaired or replaced.
2. All areas where paint is chipping/peeling shall be repaired by scraping and painting or
covering with an appropriate exterior finish material (siding).
3. The damaged or missing fascia and soffit shall be repaired or replaced.
4. The deteriorated stairs shall be repaired or replaced.
5. The roof (shingles) shall be replaced.
6. The damaged and sagging roof shall be repaired.
I am requesting a Raze or Repair Order that would require the property located at 338 Bay St.
to be razed unless the property owner complies with MUN 17 -36A by undertaking the following
required actions (continued from page #1):
7. An interior inspection shall be made to verify the interior condition of the property.
8. An occupancy permit shall be obtained prior to any future occupancy.
