PURPOSE: APPROVE AMENDMENT TO PREVIOUSLY APPROVED
PLANNED DEVELOPMENT AT FVTC FACILITY AT
4200 POBEREZNY ROAD TO PERMIT OFF PREMISE SIGNAGE
INITIATED BY: FOX VALLEY TECH NICALCOLLEGE
PLAN COMMISSION RECOMMENDATION: Approved with condition
WHEREAS, the Common Council previously approved a planned development,
for construction of a vocational welding school for FVTC; and
WHEREAS, the petitioner desires to amend the development plan to permit off -
premise signage for Miller Electric, which is a primary sponsor of the facility.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the vocational school planned development at 4200 Poberezny Road is
hereby amended to permit "Miller ", for Miller Electric, as off - premise signage on the
main identification ground sign with the condition that no other changes are permitted
to the sign without prior approval.

BACKGROUND
The FVTC facility received conditional use permit and planned development approval in June, 2010.
It is located on a recently annexed parcel of land that was annexed from the Town of Nekimi. The
subject property is located in a relatively yet undeveloped area of the Highway 41 corridor (the
Veterans Museum is the only recently developed structure in the immediate area).
ANALYSIS
FVTC is requesting inclusion of "Miller" on its main identification ground sign as the primary sponsor
of the welding facility by providing the welders that will be used to train students at the facility. The
sign is technically considered to be an off - premise sign because, while they will be trained on Miller
welders, Miller is not a service, business, commodity, or product offered at the property and thus
requires a "base standard modification" to allow the sign as proposed. Inclusion of "Miller" in the
ground sign as proposed above the signage identifying the "Advanced Technology Manufacturing
Center" essentially identifies the facility as the "Miller... Center" which is a type of arrangement that
is not uncommon for other such facilities in the City. The intent of prohibiting off - premise signage is
to prevent the establishment of '`billboards" and other off -site advertising for services and items not at
all directly related to the use of the property where the advertising is placed. In this case, there is a link
between Miller and the use of the FVTC facility.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its November 16, 2010 meeting.

GENERAL INFORMATION

Actions Requested:
The petitioner requests a development plan amendment at the recently completed FVTC welding
training facility at 4200 Poberezny Road involving "off - premise" signage to be installed in a
ground sign on the property. FVTC is requesting to have the "Miller Electric" logo installed in
the ground sign. Aside from the off - premise issue, the sign appears to meet all other code
requirements.
Applicable Ordinance Provisions:
Section 30- 1(147(r) of the "Zoning Ordinance defines an off - premise sign as "a sign which directs
attention to a business, commodity, service, entertainment or attraction sold, offered, or existing
elsewhere than upon the same lot where the sign is displayed."
Section 30- 7(E)(5) prohibits off- premise signs.
The Zoning Ordinance establishes criteria and guidelines for the establishment and /or
amendment of a PD overlay district in Section 30 -33 and Conditional Use Permit in Section 30-
11.

ANALYSIS
FVTC is requesting inclusion of "Miller" on its main identification ground sign as the primary
sponsor of the welding facility by providing the welders that will be used to train students at the
facility. The sign is technically considered to be an off - premise sign because, while they will be
trained on Miller welders, Miller is not a service, business, commodity, or product offered at the
property and thus requires that a "base standard modification" be permitted to allow the sign as
proposed.
Inclusion of "Miller" in the ground sign as proposed above the signage stating "Advanced
Manufacturing Technology Center" essentially identifies the facility as the "Miller... Center"
although FVTC is not actually designating the facility as such. This type of arrangement is not
uncommon for other such facilities in the City with examples such as Ford Festival Park, JJ
Keller Field at Titan Stadium, and FVTC's FABTECH Education Center on Oregon Street.
The intent of the off - premise provisions is to prevent establishment of "billboards" and other off -
site advertising to occur for services and items not at all directly related to the use of the property
where the advertising is placed. In this case, there is a link between Miller and the use of the
FVTC facility and as such staff is supporting this request with conditions.
RECOMMENDATION /CONDITIONS
Staff believes that the proposed development, with conditions, will meet the standards as set
forth in Section 30 -33: Planned Developments and not have a negative impact on surrounding
lands, will be harmonious with the intended character of the general vicinity, and will not be
detrimental to neighboring property or the community as a whole.
Staff recommends approval of the development plan amendment with the following conditions:
1- Base standard modification to permit the ground sign with Miller identification as
proposed with no other changes permitted to the sign without approval.
The Plan Commission approved of the development plan amendment with conditions noted. The
following is the Plan Commission's discussion on this item.
Mr. Burich presented the item and reviewed the site and surrounding area and stated that FVTC
had previously received conditional use permit and planned development approval for their new
training facility. He reviewed the site plan displaying the area where the sign was proposed to be
located and explained the zoning ordinance definition of off - premise signage. He further
explained the reasoning for the technical college's request to add the "Miller" logo to their
signage and reviewed the sign design and conditions recommended for this request.
Mr. Thorns questioned if the Plan Commission had reviewed signage for this site at the time the
planned development was approved.

Mr. Burich responded that signage plans may not have been submitted at the time of the planned
development approval and providing the proposed sign meets all code requirements, it is
customarily approved through the usual zoning review process. This sign meets all code
requirements but was coming back for approval of an amendment to the planned development
due to the addition of the "Miller" logo to the sign.
Mr. Thorns then questioned if the proposed sign would block the view of the veterans memorial.
Mr. Burich replied that the size and height of the sign meets all code requirements and he felt the
digital billboard sign to the south was much more obtrusive than the FVTC proposed sign.
Mr. Thorns inquired if the Plan Commission could request that the placement of the sign be
moved back further from its proposed location.
Mr. Burich responded negatively and reiterated that the proposed sign meets all code
requirements other than off - premise issue.
Jill McEwen, Vice President of Administrative Services for Fox Valley Technical College, 1825
North Bluemound Drive, Appleton, stated that they worked with Jones Sign on the development
and placement of the signage. She further stated that she discussed its location with a
representative of the Veterans Museum and they have approved the location of their proposed
sign. She also discussed their 20 year relationship with the Miller business and their reasoning to
request to add their name to the signage for the site.
Motion by Nollenberger to approve the development plan amendment at 4200 Poberezny
Road as requested with the following conditions:
1. Base standard modification to permit the ground sign with Miller identification as
proposed with no other changes permitted to the sign without approval.
Seconded by Borsuk. Motion carried 7 -0 -1. Ayes -

currently other billboards in the area. Our sign will be an enhancement to our building.
SUBMITTAL REOUIREMENTS — Must accompany the application to be complete.
A NARRATIVE of the proposed conditional use/Development Plan including:

Sign Approval Submittal to the City of Oshkosh
October 28, 2010
Below and attached for your respective reviews and approvals is information related to
the proposed sign at the Advanced Manufacturing Technology Center located at 4200
Poberezny Road, Oshkosh, Wisconsin.
This new sign identifies our Fox Valley Technical College (FVTC) facility and is
cobranded with the Miller Electric logo. The.sign is designed this way because we have
the same type of relationship /partnership with Miller Electric as we do with FABCO and
our FABTECH Education Center on 3729 Oregon Street. This same type of sign
(different appearance but shared logos) was approved for the facility on Oregon Street,
which was built approximately three and one half years ago.
We have reviewed the sign with our only neighbor, the Military Veterans Museum, and
they were supportive of the appearance and the location. There will be no effects on
adjoining properties. The sign will not interfere with the museum's future plan for
signage. The only other signage in the area is two billboards. One billboard is on the
north end of where the new FVTC leased facility is located. The other is located on the
south side of the Military Veterans Museum. FVTC expects to serve up to 80 students
per day.

• The sign cabinet base is approximately 342 square feet per side.
• Projected install cost is $57,000.
