HomeMy WebLinkAbout10-364NOVEMER 23, 2010 10 -364 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE & EXECUTE RELOCATION ORDER; DETERMINATION OF NECESSITY TO ACQUIRE PROPERTY FOR PROPOSED NATIONAL GUARD ARMORY AREA STORMWATER DETENTION BASIN — GENERALLY LOCATED AT THE EASTERLY TERMINI OF MENARD DRIVE, SOUTH OF MORELAND STREET, WEST OF WISCONSIN NATIONAL GUARD ARMORY PROPERTY INITIATED BY: DEPARTMENT OF PUBLIC WORKS PLAN COMMISSION RECOMMENDATION: Approved WHEREAS, in February 2004 the Common Council approved the official mapping of lands in the Menard Drive /Moreland Street /Armory Place area for the purpose of storm water detention; and WHEREAS, the Department of Public Works has completed further study of the area and is recommending the acquisition of properties within the previously approved officially mapped area owned by 2323 East Capitol LLC, more particularly described in the attached. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the Common Council determines that it is necessary and a public purpose for the City to acquire the properties described in the attached for said purpose of construction of a stormwater detention basin. BE IT FURTHER RESOLVED by the Common Council that this resolution constitutes a Relocation Order for acquisition of property described in the attached in accordance with the title acquisition procedure set forth in Wisconsin Statutes, Section 32.05, said property being in the area at the easterly termini of Menard Drive, south of Moreland Street and west of the Wisconsin National Guard Armory property. BE IT FURTHER RESOLVED that the proper City officials are hereby authorized and directed to execute any and all documents necessary for implementation of this order and that a certified copy of this Resolution shall be filed with the Winnebago County Clerk within twenty (20) days of its adoption. BE IT FURTHER RESOLVED that this Resolution shall be effective immediately upon its passage and publication. The general area is a mix of low density residential uses to the north, commercial uses to the west and National Guard facilities to the south and east. In February of 2004, the Oshkosh Common Council approved the official mapping of a portion of the subject site for future use as a storm water detention basin. The official mapping action protected this area from private development. ANALYSIS The Department of Public Works is seeking to acquire this land for construction of a stormwater detention basin within the Campbell Creek Watershed which will allow for the stormwater runoff to collect at this location and reduce flooding to properties within the watershed. The acquisition involves partial acquisition of a parcel requiring the razing of two storage buildings from the former Menards store. The 2008 Draft Campbell Creek Stormwater Management Plan recommended the construction of three detention basins within the watershed at Tipler School, the Armory property and the Westhaven Golf Course to provide 215 acre -feet of stormwater storage. The Tipler basin was constructed in 2009 and the larger basin proposed for the Westhaven Golf Course was removed for consideration by the Common Council with a smaller basin being proposed adjacent to the Westhaven Clubhouse. The two additional proposed basins at the Armory location and W. 9"' Avenue and S. Washburn Street combined with the Tipler and Westhaven basins will provide 158 acre -feet of stormwater storage. If the land is acquired, the Department of Public Works will be required to apply for a conditional use permit to construct the proposed basins. FISCAL IMPACT None anticipated from a land use standpoint other than removal of assessable property from the property tax rolls. RECOMMENDATION The Plan Commission approved of this request at its November 2, 2010 meeting. Approved, City Manager ITEM: AUTHORIZATION TO ACQUIRE PROPERTY LOCATED AT 1415 ARMORY PLACE AND 1530 S. KOELLER STREET There were two parcels that were presented for acquisition at the Plan Commission meeting included in this report. The acquisition of the 2323 East Capitol, LLC property is the only one being considered for approval at this time. Plan Commission meeting of November 2, 2010 GENERAL INFORMATION Applicant: City of Oshkosh- Department of Public Works Property Owners: State of Wisconsin & 2323 East Capitol, LLC Action(s) Requested: The City of Oshkosh Department of Public Works is requesting approval to acquire approximately 18.80 acres of land from two properties for construction of a storm drainage detention basin. The detention basin will allow for the stormwater runoff to collect at this location and reduce flooding to properties within the watershed. The land acquisition involves partial acquisitions of two parcels. 8.5 acres is proposed to be acquired from the 2323 East Capitol, LLC, (new Best Buy), property and contains two storage buildings from the former Menards store that will need to be razed in order to construct the new basin. 10.3 acres is proposed to be acquired from the Armory property and is currently undeveloped. After the proposed acquisition, the City will prepare a Certified Survey Map for the new parcel configurations. The February, 2008 Draft Campbell Creek Stormwater Management Plan recommended three detention basins to be constructed in the Campbell Creek Watershed. These included basins at Tipler School (34 acre -feet of storage), the Armory property (27 acre -feet of storage) and Westhaven Golf Course (154 acre -feet of storage). The three basins were proposed to provide approximately 215 acre -feet of stormwater storage during a 100 year storm event. The Tipler basin was constructed in 2009 providing the originally proposed 34 acre -feet of storage. The large Westhaven Golf Course project has been removed from consideration by the Common Council. A smaller 25 acre -foot basin is now proposed adjacent to the Westhaven Clubhouse. The proposed expanded armory basin will detain approximately 64 acre -feet of water and the proposed basin near the intersection of W. 9 1h Avenue and S. Washburn Street will detain approximately 35 acre -feet of water. The total stormwater storage upon completion of these basin projects will total approximately 158 acre -feet. The construction of stormwater detention basins at the Armory, 9 th & Washburn and related piping improvements will help reduce flooding to properties within the Campbell Creek Watershed. Additional improvements will be required to further reduce the impacts of flooding in the stormwater drainage basin. If this land is acquired, the Department of Public Works will need to apply for a Conditional Use Permit to construct the basin. At that time, the Plan Commission will review the site plan and design of the proposed basin to analyze the impact on the surrounding properties. RECOMMENDATION /CONDITIONS Planning staff recommends approval of the proposed land acquisition as requested. Item — Land Acquisition —Armory & Koeller The Plan Commission approved of the land acquisition as requested. The following is the Plan Commission's discussion on this item. Mr. Burich presented the item and reviewed the site, surrounding area, existing land use, and zoning classifications. He reviewed the acreage of each parcel proposed to be acquired and stated that part of the area was officially mapped previously for this use. Mr. Thorns inquired about what areas of the city would benefit from the construction of a detention basin at this location and if the proposed basin would be wet or dry. Mr. Gohde replied that this would also be a wet detention basin which would assist in the quality of the stormwater as well as alleviate flooding issues. This detention basin would benefit properties in the neighborhood northeast of the basin location and properties downstream from that location. Mr. Fojtik questioned if there would be issues with the area proposing to be acquired not matching exactly the area that had previously been officially mapped. Mr. Burich responded that it would not create any issues as the land acquisition is not required to be officially mapped previously but the process is done only to protect the area from future development. Part of the area had been officially mapped previously but some of the area was left out and the land acquisition was adjusted accordingly to accommodate the size of the detention basin at this location. Mr. Gohde added that with the removal of the detention basin at the Westhaven Golf Course by the Common Council, the area for this detention basin was required to be increased. Judy Lett, 1615 Crystal Springs Avenue, stated that a ditch currently exists between their home and the parcel proposed to be acquired and questioned if the ditch was going to remain after the construction of the detention basin. She also questioned who is going to clean out the grate in her backyard and where the water is going to be directed. She commented that she has lived at this location since 1967 and has never had problems like she does now. She also distributed photos of the grate area displaying the debris that has accumulated there. Mr. Gohde replied that the pipe in the ditch would remain between the homes as the detention basin and wet surface will allow the discharge to function better. The Department of Public Works and the Street Department crews will handle the cleanup of the area. Mr. Thorns commented that there was a lot of debris on the photos Ms. Lett distributed. Mr. Gohde responded that the area is routinely inspected by the Street Department and that the debris on top will not get caught in the out flow. Ms. Lohry questioned where the grate is located on the map. Mr. Burich displayed where the pipe was located and the grate on the aerial view map. Item — Land Acquisition — Armory & Koeller Ms. Lett commented that they have been cleaning up the grate area themselves as the City was not doing an adequate job of removing the debris. Ms. Lohry inquired if something can be done to make the grated area more attractive. Mr. Gohde replied that they do not install fencing around detention basins. Mr. Burich added that the land acquisition is the only issue being considered today and issues such as the construction and appearance of the detention basin can be addressed at the time that the conditional use permit for the detention basin is brought forward for review and approval. Mr. Fojtik commented that Ms. Lett should work with City staff on these issues. Robert Cutts, 120 Merritt Avenue, stated that he worked at the Armory and they were not opposed to the proposed acquisition other than 10 -15% of the area may be an issue as they have one more building they were planning to construct on the site and an access area for the motor pool. He displayed on the aerial map the location of the additional structure and motor pool access area yet to be constructed and commented that the flooding issues in the area were horrendous. Laura Langkau, 1310 Moreland Street stated that the detention basin constructed at Tipler School is very unattractive and she did not want the detention basin in their neighborhood. She further commented that the Tipler location was fenced with orange construction fencing and the proposed detention basin would be ten feet from her property. She also voiced her displeasure with the fact that the Armory currently allows them to use their land for their children to play on which will cease if a detention basin is constructed on the site. She also questioned what constitutes a wet basin. Mr. Gohde explained that a wet detention basin is an area that contains a permanent pool of water. Ms. Langkau questioned how that was different than what is there now. Mr. Gohde responded that the area would be excavated and would contain a permanent pool of water which would have the ability to hold many more feet of water than the site currently can accommodate. Ms. Langkau stated that she did not approve of this as the area currently has a two foot creek at times but to create a permanent detention area there would decrease their property values. Mr. Fojtik questioned how the 10 -15% of land that the Armory may have an issue with would be handled. Mr. Burich replied if the land acquisition was approved, it would be worked out when negotiations commence between the Armory and the City for the sale of the property. Mr. Gohde added that a portion of the land had been officially mapped and the remaining lands would be worked out in a voluntary negotiated sale. Item — Land Acquisition —Armory & Koeller Ms. Propp commented that today's item was an authorization to acquire land and the time to discuss restrictions or conditions on the construction of the detention basin would be when the conditional use permit is brought forward for approval. Ms. Lohry stated that she cannot support the land acquisition without knowing how it is going to impact the neighbor's properties and she would need to see further information on the request before she would support the request to acquire the property. Mr. Palmeri inquired if there would be time to address concerns about the layout and construction of the detention basin at a later date. Mr. Burich reiterated that a conditional use permit would be required to come before the Plan Commission and Common Council for approval prior to the construction of the detention basin and meeting notices would be sent out to adjacent property owners at that time. Concerns regarding the construction of the basin could be addressed at that time. Mr. Palmeri then questioned if the conditional use permit could be rejected at a later time if plans did not address concerns of adjacent property owners. Mr. Burich responded affirmatively. Mr. Thorns inquired if the land acquisition would be approved by the Common Council prior to knowing if the conditional use permit would be granted for the construction of the detention basin. Mr. Gohde replied that the City cannot get on the land to do the necessary testing and other studies to design the detention basin prior to the acquisition of the land. Mr. Thorns questioned if the City could not get access to perform the necessary tests in advance of the acquisition. Mr. Gohde responded that it may be possible but it would be up to the current property owners if they desired to allow it. He further stated that the City cannot apply for the necessary permits with the DNR until the land is acquired. Motion by Propp to approve the authorization to acquire property located at 1415 Armory Place and 1 530 S. Koeller Street as requested. Seconded by Thoms. Motion carried 4 -1 -1. The detention basins will allow for stormwater runoff to collect in these locations and reduce flooding to properties within the watershed. The first detention basin location is adjacent to the Wisconsin National Guard Armory located at 1415 Armory Place. This detention basin has been commonly referred to as the Armory Basin in numerous presentations to the Common Council and public. A portion of the land was officially mapped in February 2004 for the purpose of stormwater detention. The proposed area of acquisition is approximately 18.8 acres. The land is owned by two property owners. The proposed acquisition is for approximately 10.3 acres of vacant land from the Armory and approximately 8.5 acres of land from 2323 E. Capital, LLC. This location is behind the new Best Buy store. A portion of this land is vacant and remainder has two buildings that _were part of the former Menards Store located at this site. The area of the two buildings was not included in the official mapping. The second detention basin location is near the intersection of W. 9 Ave. and S. Washburn Street. The proposed area of acquisition is three vacant parcels and a portion of a forth parcel. The proposed area of acquisition is approximately 11.2 acres. The entire area proposed for acquisition was officially mapped for the purpose of stormwater detention in November 2006. The proposed acquisition is for 3.8 acres from Lee Engelman, 3.6 acres from the Life Estate of Angela Demler and 3.8 acres from Gail Demler.
