HomeMy WebLinkAboutBoard of Zoning Appeals (minutes) - 04/05/1989 BOARD OF ZONING APPEALS MINUTES April 5, 1989 PRESENT: Anne Hintz, Don Krueger, Terry.Slover and Kevin McGee STAFF: Susan K. Moore, Principal Planner; Diane Witzke, Recording Secretary Chairperson McGee called the meeting to order at 3:40 PM. Roll call was taken and a quorum declared present. Because only four Board members were present, Mr. McGee informed the applicants that four affirmative votes would be required to approve a request. A 3 -1 vote for approval would lay the appeal over for consideration until the next meeting. The minutes of March 15, 1989 were approved as distributed. 62) 2210 MINERVA STREET - Lynn N. Resop The applicant is requesting a variance to construct a 440 sq. ft. addition to an existing garage. The addition would result in the garage having a total area of 1100 sq. ft.; whereas Section 30 -15 (B)(2)(b)(vi) of the City of Oshkosh Zoning Ordinance states that detached garages in the rear yard may have a maximum area of 30 percent of the rear yard area or 800 sq. ft., whichever is less. In answering questions from the Board, Mr. Resop explained the following: His hobby is working on his collector cars. He would like to be able to store the cars that are presently sitting outside on his lot inside. The addition would add enough room for three more cars to be stored. He uses storage facilities away from his home to keep four more cars. He has attempted unsucessfully to purchase other properties near his home to obtain more storage area. There are also four family cars that are used on a daily basis by Mr. Resop, and his wife and daughter. His wife does not want to move to another home because she likes this neighborhood. Mr. McGee stated he was concerned that "warehousing" these vehicles would possibly cross over the line into "commercial use ". Ms. Moore stated the applicant can legally store these cars outside. The garage would only serve to put those vehicles out of sight. The use of the existing garage would not change. Discussion ensued on "commercial use" vs. "recreational use ". Mr. and Mrs. Roger Schwartz, 2222 Minerva Street, stated they live directly north of this property. Mrs. Schwartz read and submitted a letter stating their objections to this proposed garage addition. They felt that by adding the addition, the size of the apron to the garage would enlarge resulting in more parking area for his cars. They did not want to look at a parking lot. However, they do not mind the cars that presently sit outside. They do not believe that collecting cars presents a hardship. BOARD OF ZONING APPEALS PAGE TWO APRIL 5, 1989 Motion by Hintz to move approval of a variance to construct a 440 sq. ft. addition to an existing garage. Seconded by Krueger. Motion denied 0 -4.
