PURPOSE: REMOVAL OF MUNICIPAL CODE LANGUAGE PERTAINING TO
TRANSIT BENCH PERMITTING REQUIREMENTS

A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING SECTIONS 22 -21
THROUGH 22 -25 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO BENCHES
AT BUS STOPS, CONDITIONS OF PERMIT FOR BENECHES AT BUS STOPS, BOND
TO BE FILED, CONSTRUCTION REQUIREMENTS AND ADVERTISING, AND
INSURANCE REQUIRED.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Sections 22 -21 through 22 -25 of the Oshkosh Municipal Code
pertaining to benches at bus stops, conditions of permit for benches at bus stops, bond to
be filed, construction requirements and advertising, and insurance required, are hereby
repealed.
SECTION 2. This ordinance shall be in full force and effect from and after its
passage and publication.
SECTION 3. Publication Notice. Please take notice that the City of Oshkosh
enacted ordinance #10 -XXX (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH
REPEALING SECTIONS 22 -21 THROUGH 22 -25 OF THE OSHKOSH MUNICIPAL
CODE PERTAINING TO BENCHES AT BUS STOPS, CONDITIONS OF PERMIT FOR
BENECHES AT BUS STOPS, BOND TO BE FILED, CONSTRUCTION
REQUIREMENTS AND ADVERTISING, AND INSURANCE REQUIRED) on November
23, 2010. The ordinance removes requirements related to permitting and constructing
of transit benches.

SECTION 1: SECTIONS 22 -21 THROUGH 22 -25
REQUEST TO REPEAL PORTIONS OF MUNICIPAL CODE RELATED TO TRANSIT
BENCHES
Chapter 22 of the Oshkosh Municipal Code is entitled "Public Transportation." Most of
the sections related to taxi operations within the City. However, several sections in the
code, specifically Sections 22 -21 through 22 -25, deal with the permitting and
construction of transit benches. (These are attached for your reference.) I believe that
this language pre -dates the City's ownership of the transit system. Prior to that time,
private companies provided transit service in the City, and these sections may have
been necessary to promote public safety.
I believe these sections are no longer necessary. Any time the City installs a new
shelter or bench, we consult with the Department of Public Works. This would also be
required of a private company interested in constructing a transit bench within the public
right -of -way. With the current transit funding model, it is likely that private funding that
may be used to support shelters and benches would be funneled through the City, to
ensure that FTA procurement guidelines are followed and that Federal and state dollars
can be effectively leveraged.
