Dear Mr. Frueh:
Two employees of the Oshkosh street department, who responded on
Monday to my complaint of knee -high weeds and much thistle in the yard
at 36 Mill Street, advised me to contact your office for a check on pos-
sible violation of the July 21, 1983, ordinance pertaining to "public
nuisance affecting property usage ".
The property at Street is owned by Douglas Nelson, who for
approximately the past four years has been remodeling the house as an
investment. However, since September, 1982, no work has been done on
the house.
Presently, the backyard has several piles of debris- -lath, cut -up
branches now overgrown with a vine -type weed and pushed against my fence,,
brick, rotted window frames, a discarded door, sheets of tarpaper, a bro-
ken clothes line pole, scraps of roofing, and used caulking tubes, for
example. In addition, there are now the weeds and brush which the city
workers cut down on Monday.
The front yard has weeds, two large foundation stones, a discarded
door, and branches from a box elder tree which a forester might declare
hazardous.
Prior to my reporting the weeds to the street department, I sent a
note to Mr. Nelson asking for his cooperation. I got no response. This
followed the expected pattern, for other neighborhood residentshave con-
tacted him about lawn mowing at dandelion time and snow removal, and
then have had to call city crews to get the job accomplished.
The three phrases used in Part B, Section 18 - 79.1 of the ordinance
"unsightly ", "tending to depreciate property values ", and "creating a
nuisance or hazard " -- certainly seem to apply to the combination of debris
and the constantly recurring obnoxious weed problem in that yard.
Could there be an official evaluation of the situation, and appro-
priate measures taken, please?
