Dear Nikunj:
As you will recall, we had a conversation at our office on 10/15/10 regarding violations of the City of
Oshkosh Municipal Code (see Sections 30 -5 & 17.20 (3)(a)) at the property you own located at 3100 Old
Orchard Lane. At the conclusion of the discussion you inquired if the patio pavers were removed can the
subject area be maintained with finely crushed pea gravel?
After consulting with the Wisconsin Department of Natural Resources and Winnebago County staff, it has
been concluded that pea gravel is considered a permeable surface. Therefore, if the pea gravel that will
replace the patio pavers is at -grade and is not framed by any sort of structure to hold it in a specific
shape /form /place, it will be defined as being a form of "ground cover" and not a structure. This would mean
the applicable setback standards and building permit would no longer apply as ground cover is a landscape
function.
Please review this information carefully and communicate your plan for compliance to our office no later
than October27, 2010. If you have any questions regarding this letter, please do not hesitate to contact me
