PRESENT: James Larson, Kevin McGee, Dave Neu and David Nitkowski

Chairperson Kevin McGee called the meeting to order. Roll call was taken and
a quorum declared present.
Due to a four member Board present, Mr. McGee informed the applicants that
four affirmative votes would be required to approve a request. A split vote,
would be an automatic lay over.
The minutes of June 17, 1987 were approved as distributed.

Mr. Laraine explained the applicant is requesting that the Board of Zoning Appeals
extend the M -3 zoning district boundary line to encompass their entire property;
whereas the Ordinance permits the Board of Zoning Appeals to extend district bound-
ary lines where a property in single ownership is split by two zoning districts.
Mr. Gerald Demler representing the Winnebago County Highway Commission stated
we are currently zoned R -2 and M -3 and we would like to be zoned entirely M -3.
We have an October 1, 1987 deadline by the State to build another salt storage
structure which is not allowed in an R -2 district.
Mr. McGee asked when the first salt storage structure was built.
Mr. Demler stated it has been up for 3 -4 years.
Mr. McGee asked if this has been a single property?
Mr. Demler replied yes, for a long time.
Mr. Nitkowski questioned if the City was aware that the County was in this
R -2 area. If it had known that the boundary would have been adjusted.
Mr. McGee asked if this parcel could have a separate exit?
Mr. Demler replied no, the only access is on Knapp Street.
Mr. McGee stated then this property could not be used for residential purposes.
Motion by Larson to move approval to extend the M -3 Zoning District boundary
line to encompass their entire property. Seconded by Nitkowski. Motion carried 4 -0.
Regarding the findings of fact, Mr. Neu stated the boundary would not have any
negative impact on the surrounding properties. We are correcting an error and
we have the recommendation of the Community Development staff to approve this
application.
Mr. McGee stated that without this variance we would not have any practical
use of this property.
