This pumping station was built in 1986 within an easement and serves properties in the 9`" Addition to North Point Plat. The below - grade valve vault has historically filled with water due to its close proximity to Lake Winnebago and must be purnped of water prior to each entry. The proposed upgrades include removal of the buried vault which will be replaced by an above ground system enclosed by an eight -foot by eight -foot heated structure. The subject property is a 0.46 acre waterfront property containing a single- family home with predominantly single- family uses in the surrounding area. ANALYSIS The project involves the replacement of the existing cover with a new cover, vent and hatch enclosed in a prefabricated brick building placed on a concrete foundation and slab. The new control panel is proposed to be located on the rear elevation of the building to provide shielding from the roadway with the exterior of the structure constructed to compliment the adjacent residential homes. The existing site currently has grass cover with a row of 10 -12 foot tall arborvitae for screening which will be relocated to provide screening for the new structure and seeded upon completion of the project. The proposed improvements will also require setback variances from the Board of Appeals as the location does not meet the minimum front and side yard setbacks. The City does not have any economically viable options for the relocation of the pumping station as this is the low point for the sanitary collection system for this area. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its September 21, 2010 meeting. Approved, " � 44a/- City Manager ITEM: CONDITIONAL USE PERMIT FOR A PUBLIC UTILITY STRUCTURE (HICKORY LANE PUMP STATION) 2065 HICKORY LANE Plan Commission meeting of September 21, 2010 GENERAL INFORMATION Applicant: City of Oshkosh — Department of Public Works Owner: Michael and Patricia Schumerth Action(s) Requested: The applicant is requesting a conditional use permit to upgrade an existing utility structure (sanitary sewer pumping station) at 2065 Hickory Lane. Applicable Ordinance Provisions: Public utilities are permitted only through conditional use permits in the R -1 Single Family Residence District as regulated in Section 30 -17 (A)(8) of the Zoning Ordinance. Standards imposed on Conditional Use Permits are located in Section 30 -11 (D) of the Zoning Ordinance. Background Information Property Location and Type: The Department of Public Works is seeking approval for upgrades to an existing below grade submersible pump station with an adjacent below -grade valve vault. The pumping station was built in 1986 within a lift pump station easement and serves properties in the 9 th Addition to North Point Plat. The lift station is in need of modernization. The below -grade valve vault has historically filled with water due to its close proximity to Lake Winnebago and is considered a confined space requiring special entry procedures and safety measures. Additionally, it must be pumped of water prior to each entry. The existing structures are shielded from view by mature arborvitae shrubs. The proposed upgrades include removal of the buried valve vault, which will be replaced by an above ground system enclosed by an eight -foot by eight -foot heated structure. The existing pump control panel will be replaced and relocated on the back side of the structure. The subject property is a 0.46 acre waterfront property containing a single family home. The general area predominantly contains single family uses with exception of a few undeveloped properties. The new valve arrangement will be enclosed in an eight -foot by eight -foot prefabricated brick building placed on a concrete foundation and slab. The new control panel is proposed to be located on the northwest (rear) elevation of the building to provide maximum shielding from the roadway. The exterior of the building will have natural earth tone colored brick and trim and dark gray asphalt shingle roof to compliment the adjacent residential structures. The existing site currently has grass cover with a V- shaped row of 10 -12 -foot tall arborvitae for screening. It is intended for the arborvitae to be harvested and relocated with a spade truck to provide screening for the new structure (see plan). The site will be restored with seed upon completion of the project. In addition to Plan Commission review and Common Council approval, the Department of Public Works will also need setback variances from the Board of Appeals for the location of the proposed improvements. The proposed location does not meet the minimum front yard and side yard setbacks required of the R -1 District. Although the proposed structure may seem out of place from an aesthetic standpoint, the City does not have any economically viable option for relocation of the pumping station as this is the low point for the sanitary collection system for this area. Staff agrees that the proposed above - ground valve house, although not aesthetically pleasing, is an improvement over the below grade system from a safety and maintenance point of view. The Department of Public Works plan to shield and landscape the structures will lessen the visual impact from the adjoining properties. RECOMMENDATION Staff recommends approval of the CUP to allow the construction and operation of the proposed sanitary pumping station as requested. The Plan Commission approved the conditional use permit as requested. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and surrounding area including the current land uses and zoning classifications. He discussed the need for the upgrades to the pump station and described the proposed pump station structure and details of the project plans. He also reviewed the relocation of the existing arborvitae to provide screening for the structure and the potential issues with reconstructing the existing pump station underground. He also explained that it would not be economically feasible to relocate this pump station to another area and further reviewed details of the pump station and photos of the existing conditions and examples of the proposed above ground structure. Mr. Vajgrt left the meeting at 5:11 pm. Item- HickoryLaCUP /Public Utility Mr. Hinz questioned if the pump station was left as it currently exists, would it continue to flood out. Steve Brand, Superintendent of Utilities, stated that the pump station was constructed in 1986 at which time this area was undeveloped. The valves were located underground at that time and there are safety concerns with maintenance to this facility and it could also be more costly to repair if we wait until the pumps fail to address the issue. He also stated that the project has been discussed with neighboring property owners as the City wishes to maintain the integrity of the neighborhood. This is a low point of the area and that is why relocating the pump station elsewhere is not a feasible option. He assured Commission members that they would continue to work with the neighbors as this project proceeds. Mr. Thoms questioned if any of the neighbors had issues with this proposal. Mr. Brand responded negatively. Ms. Propp inquired how high the proposed structure would have to be. Mr. Brand replied that the structure would have to be high enough to allow someone to be able to stand up on the inside of it. He further stated that the picture included with the narrative for this project is much larger than the actual planned structure. Ms. Propp commented that this may be the only alternative however she was not pleased with the pump station in the park from an aesthetic standpoint and questioned if the arborvitae proposed for the screening would be adequate. Mr. Brand responded that the neighbors had offered some suggestions for additional screening if necessary and the color of the structure was also discussed with property owners to try to make the building as compatible as possible with the surrounding homes. Mr. Palmeri questioned if 24 years ago when this pump station was constructed, the level of housing in this area was not anticipated. David Patek, Director of Public Works, replied that the City anticipated the service area and that the issue was the underground valves were unsafe and difficult to maintain and the proposed plan was a different design than what was previously constructed. Mr. Palmeri then questioned if the existing design of the pump station was not considered unsafe 24 years ago and if there had been any incidents on the site since its installation. Mr. Patek responded that design standards and worker's safety concerns were looked at differently years ago and to his knowledge there had not been any incidents at the site however an equipment failure would result in sewage backup into basements and flowing into Lake Winnebago. The brick structure is more aesthetically pleasing than a steel building and would be more compatible with the residential homes. Mr. Palmeri inquired if there were any alternatives to addressing this issue. Mr. Patek replied negatively. Item- HickoryLn.CUP /Public Utility Mr. Nollenberger commented that it appeared that the staff had discussed the proposed project with the neighbors and it seemed to be effective as there were no property owners present opposed to the plan. Mr. Thoms stated that he applauded staff for their efforts and as the neighbors do not have issues with the proposed structure, he felt the plan to bring this pump station above ground was appropriate as we need to be more cognizant of the safety of workers. Motion by Bowen to approve the conditional use permit for a public utility structure located at 2065 Hickory Lane. Seconded by Hinz. Motion carried 7 -0. The sanitary pumping station is located on a 60 -foot by 60 -foot triangle lift station easement on Lot No. 283 of the Ninth Addition to North Point Plat. Lot No. 283 is owned and maintained by Mr. and Mrs. Michael Schumerth whose address is 2065 Hickory Lane. The sanitary sewage pumping station is an existing below grade submersible pump station with adjacent below grade valve vault. The station was constructed around 1986 to serve the Ninth Addition to North Point and is approximately 24 years old. The station needs upgrades to improve safety and reliability. Specifically, the existing valves are located in a buried 5 -foot by 8 -foot concrete vault which historically has filled with water due its close proximity to Lake Winnebago. The valve vault is a confined space, requiring special entry procedures and safety measures. With the high groundwater condition, the valve vault must be pumped empty prior to servicing or operating the valves for the station. , Station upgrades proposed include removal of the buried valve vault and replacement with an above ground valve arrangement protected by an 8 -foot by 8 -foot electric heated enclosure. A new pump control panel will replace the existing pump control panel which has reached the end of its useful life. The pump control panel will be located on the back side of the new enclosure. Adjacent Structures The valve manifold structure is to be placed on an existing easement within a residential subdivision. Photos of the adjacent homes at 2065 Hickory Lane and 2155 Hickory Court are shown below. The pumps are controlled by a control panel adjacent to the station. The buried valve vault cannot be seen from the ground surface. The pump station is currently shielded by tall arborvitae shrubs. Proposed Condition The project will include replacing the existing cover with a new cover, vent, and hatch. The buried valve vault will be replaced with an above grade valve arrangement and approximately 8- foot by 8 -foot prefabricated building which will be placed on a concrete foundation and slab adjacent to the pumping station. The new control panel is 5 -feet in width and will be mounted on the northwest side of the structure as shown on the drawings. This panel will be located on the rear side of the structure to provide the maximum screening from the roadway. Landscaping will be provided to screen the panel from the adjoining residential properties. The proposed building will have a brick exterior, asphalt shingle roof, and steel security door. An example of the general appearance of the structure is shown below. The brick color and trim colors will be natural earth tones to compliment the adjacent residential structures. Dark gray architectural asphalt shingles will be used. Site Landscaping The existing site is grassed and has a v- shaped row of 10 -12 foot tall arborvitae bushes for screening as shown on the site plan drawing. It is intended that these shrubs will be harvested and replanted with a spade truck in the locations shown on the drawings. This will provide screening for the station, preserve the existing mature vegetation, and provide the necessary clearances for the landscaping from the control panel. The adjacent parcel contains mature landscaping which will be undisturbed as part of this project. The site will be restored at the completion of improvements with seed. Site Setbacks and Variances According to City of Oshkosh Planning Department, the existing sewage pumping station site is a legal non - conforming parcel. The existing parcel is zoned R -1 Residential with 25 -foot front yard setback and 10 -foot side yard setback requirements. The existing sanitary wet well and valve vault are not in compliance with the setback requirements. Improvements to this property will require a variance. A variance for the improvements identified in this narrative is warranted S: \MAD \1300 - 1399 \1382 \043 \Wrd \Narrative CUP.docx due to a hardship which is unique to this property and does not necessarily apply equally to other lots. The subject easement is small and is located at the front of the residential lot. The pump station is comprised of a 25 foot deep concrete wet well which cannot be moved as it is the low point for the sanitary collection system for this area. An above ground valve vault and heated enclosure is required to improve safety and reliability of this system.
