GENERAL DESCRIPTION/BACKGROUND
The applicant is requesting a variance to construct an attached garage with a 6 "+ side yard setback;
whereas Section 16- 15(A)(1)(d) General Requirements of Mobile Homes and Mobile Home Parks of
the City of Oshkosh Municipal Code requires a 5' minimum setback from the mobile home lot line.
The general area, as well as the site in question, can be described as having R Multiple Dwelling
zoning characterized by the Patrician Village Mobile Home Park.
Section 16 -18 VARIANCE of the City of Oshkosh Municipal Code indicates that the Common Council
has authority to make special exceptions to the terms of this division in harmony with it's general
purpose and intent so that the spirit of this Division shall be maintained, public safety and welfare
secured, and substantial justice done. Based on this authority, the owner /applicant has asked the
Common Council to take into consideration and approve the above request.
ANALYSIS/RECOMMENDATION
The site in question is located within the Patrician Village Mobile Home Park. The mobile home park is
an older mobile home park with a mix/mash of setbacks and mobile home structure placement
throughout the Park.
Approval of this request would not appear to create a negative impact on the area or the immediate
adjacent mobile home uses. The majority of mobile homes in the Park currently have car ports, utility
storage sheds or garages. It would seem appropriate for this owner /applicant to be allowed the same
amenities the majority of mobile homes currently already have.
As a result, it would certainly appear that approval of this request would not be out of character with
the current conditions of the Mobile Home Park and would appear to be in harmony with the current
conditions of the Mobile Home Park. Approval of this request would not appear to create an
environment which would have a negative impact on the public safety and welfare of the Mobile Home
Park or the general neighborhood.
Flood Homes has stated that they have no objections to the proposed location of the garage.
It would appear that the criteria for approval of the variance request has been satisfied and based on this
information, staff would recommend approval of the variance as requested.
