PURPOSE: APPROVE FUNDING FOR MARION ROAD RIVERWALK
INITIATED BY: COMMUNITY DEVELOPMENT DEPARTMENT;
REDEVELOPMENT AUTHORITY
WHEREAS, the City previously adopted the "Fox River Corridor Riverwalk Plan
and Design Guidelines" which includes cross section illustrations and conceptual
drawings for all segments of the corridor from the Wisconsin Street bridge to the
Canadian National Railroad bridge; and
WHEREAS, the Redevelopment Authority (RDA) requested bids for riverwalk
improvements along Marion Road, between Wisconsin Street and Jackson Street and
the most advantageous bid received was from Radtke Contractors; and
WHEREAS, the RDA requests funds in the amount of $1,587,900 to implement
the Marion Road riverwalk improvement project as follows:
- Reallocate $367,100 in previously borrowed park improvement funds to the
Marion Road riverwalk west leg improvement project.
- Allocate future proceeds of the proposed Deltox property land sale to the Marion
Road riverwalk east leg improvement project.
- Balance of funds to be borrowed in future Capital Improvement Programs to be
repaid by future tax increments (TIF #21).
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the Council hereby approves funding the Marion Road riverwalk
improvement project and hereby reallocates $367,100 in previously borrowed park
improvement funds to the Redevelopment Authority for the Marion Road riverwalk west
leg improvement project.
BE IT FURTHER RESOLVED that the Common Council hereby approves funds
in the amount of $1,220,800 be allocated to the Redevelopment Authority for the Marion
Road riverwalk east leg improvement project as follows:
- Allocate future proceeds of the proposed Deltox property land sale to the Marion
Road riverwalk east leg improvement project.
- Balance of funds to be borrowed in future Capital Improvement Programs to be
repaid by future tax increments (TIF #21).

BE IT FURTHER RESOLVED that the property City officials are hereby
authorized and directed to take those steps necessary to implement funding for the
Marion Road Riverwalk Improvement Project as noted above.

SUBJECT: Funding for Marion Road Riverwalk
BACKGROUND
In 2006, Council approved the Fox River Corridor Riverwalk Plan and Design Guidelines as
prepared by JJR Consultants out of Madison for proposed riverwalk improvements along the
north and south shores of the Fox River. The first phase of the riverwalk improvements on the
north side, is the Riverside Park riverwalk which is currently under construction. As part of the
Development Agreement with Oshkosh River Development for construction of the elderly
housing complex on the former Mercury Marine property (referred to as the west leg of the
riverwalk improvements), the RDA/City must construct the riverwalk and associated
improvements along that portion of the Fox River. The RDA requested bids for construction of
the Marion Road Riverwalk (including that portion along the elderly housing complex), with
alternate bids for various portions of the riverwalk improvements from Wisconsin Street to
Jackson Street, and competitive bids were received. Based on RDA funds available, the RDA
approved a partial bid to the lowest bidder, Radtke Contractors, only for the west leg in the
amount of $696,403.45.
As noted, alternate bids were requested for the entire Marion Road riverwalk area due to the
favorable bids that had been received for the Riverside Park Riverwalk portion. The alternate
bids were for:
Alternate 1 is for extending utilities for leased docks – not recommended at this time.
Alternate 2 is for crushing on -site bedding material – recommended.
Alternate 3 is for east leg base construction – dredging, revetment, base course -
recommended.
Alternate 4 is for east leg finishing items including paving, lighting and fire hydrant utilities and
landscaping - not recommended at this time.
The total bid for Alternates 2 and 3 is $745,440.90. The bid is good for 60 days to September
27, 2010.
ANALYSIS
The RDA/City has already obtained the following grants for the project:
• $200,000 for remediation under the west leg.
• $200,000 for remediation under the east leg.
• $325,000 for docks along Marion Road riverfront.
The Riverside Park riverwalk project is projected to finish under budget by $367,100. Those
funds can be re- appropriated to the Marion Road Riverwalk.
Project Timing — Both $200,000 remediation grants must be used by September 1, 2011.
The $325,000 docks grant must be used in 2011 and 2012
The RDA/City is also responsible for the riverwalk lights, benches, tipping fees for site
remediation and contingencies for the west leg of the project, estimated to be $567,100. The
RDA's /City's responsibility for the tipping fees and contingencies on the east leg is estimated to
be $675,300.
The Total cost to finish the west leg and construct the base of the east leg is estimated to be
$2,684,241.
The RDA/City will still be required to construct the final paving on the east leg of the riverwalk
when the private development takes place, but by approving Alternate 2 and 3 to construct the
crushed gravel base course the RDA/City will be in a better position to finish the riverwalk when
such development takes place, or if funds are approved as part of the 2011 CI P. The bid from
Radtke Construction is very favorable due in part to the fact that Radtke is currently working on
the elderly housing site and is already mobilized on site. Awarding the alternate bids at this time
would avoid additional remobilization expenses to the City if the City would have to rebid the
project at a future date.

FISCAL IMPACT
There is no new fiscal impact for completion of the west leg if Council approves reallocating the
$367,100 from the Riverside Park Riverwalk project.
To proceed with Alternate bids 2 and 3 of the riverwalk project estimated at $1.4 million, the
RDA is requesting funding from the City. Possible funding sources for the remaining funds
needed for the base construction of the east leg of the project are:
• utilizing Deltox land sale proceeds estimated to be $600,000
• City borrowing in 2011 —to be repaid by future Tax Increments (TIF #21) estimated to be
$620,800
Future City obligations also to be included in the 2011 Capital Improvement Program would be:
• Finishing the east leg paving, utilities and landscaping estimated to be $812,000.
• The cost of the docks not covered by the grant is estimated to be about $1,075,000.
The RDA has also applied for a grant from WisDOT Transportation Enhancements to finish the
Marion Road riverwalk east leg and the entire riverwalk from Jackson Street to Main Street.
WisDOT will not be awarding the grants until November, 2010 at the earliest. Should the RDA
be successful in securing grant funds, they would go towards funding these future obligations.
RECOMMENDATION
Staff recommends the City Council approve the reallocation of $367,100 in savings from the
Riverside Park riverwalk to the Marion Road West Leg.
Staff recommends the City Council authorize the funding for the Marion Road East Leg base
construction cost of $1,420,800. If the City Council authorizes the East Leg, the RDA would
meet again to award the low bids for Alternate 2 ($24,570.00) and Alternate 3 ($720,870.90) to
Radtke Contractors in the amount of $745,440.90. The balance of the City funds would be used
for site remediation as explained above.
