Easement
Grant of Right of Way for Emergency Vehicle Purposes
THIS AGREEMENT, made on the /J day of1 2003 by and between Steven Sieger, Grantor and
Zangl & Shields, LLC, Grantee.
WHEREAS, the Grantor owns a parcel of land in fee simple known as Lot 1 of Certified Survey
Map 1606, Being a part of the Northwest ''A of the Southwest ''A of Section 15, Township 18 North, Range
16 East of the City of Oshkosh, Winnebago County, Wisconsin.
r WHEREAS, the Grantees own a parcel of land in fee simple adjacent to the afore referenced
;, , property and as more particularly described on the attached legal description, and bearing Tax parcel No.
! 16- 1167 -01, in the Sixteenth Ward of the City of Oshkosh, Winnebago County, Wisconsin.
WHEREAS, the City of Oshkosh requires access to Lot 2 owned by Grantor in the event the road
known as "Robin Avenue" is flooded and impassable;
WHEREAS, it is the intention of the Grantor to grant to the Grantees, a strip of land 10.00 feet in
the width running north to south on the westernmost lot line for the sole purpose of allowing said
emergency vehicles passage to Grantees property.
NOWTHEREFORE, the Grantee has purchased a property known as 3156 Scenic Drive (Vacant
Land), City of Oshkosh, Winnebago County for the sole purpose of constructing a home on this property
for the Grantor, to the Grantor's Approval. In exchange for the cost of the home and the afore mentioned
property, the Grantee will exchange the property known as Lot 1 of Certified Survey Map 1606, Being a
part of the Northwest ''A of the Southwest ''A of Section 15, Township 18 North, Range 16 East of the city of
Oshkosh, Winnebago County. This Exchange will occur based on a formal "WB -35 Simultaneous
Exchange Agreement" being executed and Closed as agreed by both named parties to this agreement.
NOWTHEREFORE, for good and valuable consideration, the receipt whereof is hereby
acknowledged, the Grantor hereby, grants to the Grantee, right of use to said 10.00 foot strip of land, until
completion of home at property known as 3156 Scenic Drive, City of Oshkosh, Winnebago County and
Closing of the "WB -35 Simultaneous Exchange Agreement" which will be executed within 30 days of this
agreement being signed. The 10.00 foot strip of land is described as follows:
A 10.00 foot ingress /egress easement over the West ten (10) feet north of Lot 1 of Certified
Survey Map 1606, being part of the Northwest '' of the Southwest' 'A of Section 15, Township 18 North,
Range 16 East, in the City of Oshkosh, Winnebago County, Wisconsin. Parcel #16 -1169.
For the sole purpose of allowing passage of emergency vehicles onto Grantee's property in the event said
roadways are flooded.
Grantees agree that they have no right to use said strip of land for any purpose than as set forth
above. Grantor agrees that no structures, trees, bushes, shrubs, or any other impediments are permitted
upon the afore described easement, nor any other type of impediment to the use of the easement by
emergency vehicles.
Should it become necessary for emergency vehicles to access Grantor's property by use of this
easement, Grantees shall restore the surface of the ground as nearly as possible to the condition as it existed
immediately prior to the occurrence.
If the "WB -35 Simultaneous Exchange Agreement" is not agreed and executed in the afore
mentioned 30 (thirty) days from the time this agreement is signed and agreed upon by both parties. The
Grantor will have the right to rescind this Easement agreement and the Grantee will have to vacate any
agreed use of said Easement.
