HomeMy WebLinkAboutMinutesBOARD OF APPEALS MINUTES July 28, 2010 PRESENT: Robert Cornell, Robert Krasniewski, Dennis Penney, Jane Cryan EXCUSED: Dan Carpenter, Mark Nielsen STAFF: Todd Muehrer, Associate Planner /Zoning Administrator; Deborah Foland, Recording Secretary Chairperson Cornell called the meeting to order at 3:30 p.m. Roll call was taken and a quorum declared present. The minutes of July 14, 2010 were approved as presented. Penney /Krasniewski 4 -0. ITEM L• 1629 RAINBOW DRIVE Mary Mettler, Green Bay Sign - applicant, Discovery Properties II LLC- owner, request a variance to permit an identification sign with a 10' front yard setback. Section 30 -20 (B)(5)(c) of the Oshkosh Municipal Code: R -3 Multiple Dwelling District requires a 25' front yard setback. Mr. Muehrer presented the item and distributed photos of the subject site. He explained that the site is zoned R -3 Multiple Dwelling District and is irregular in shape. The proposed ground mounted identification is to advertise the apartment complex located at 1629 and 1645 Rainbow Drive and will be single- sided, non - illuminated, and erected on two support poles. There should be no adverse effect on surrounding properties as there are no driveways located near the proposed sign location to affect visibility and adjacent properties would be unable to view the sign. The property is unique because of the existing placement of the principal structures which are setback 21' from the right -of -way making a sign placed at the required 25' setback impractical. Mary Mettler, Green Bay Sign & Design, 2803 Packerland Drive, Green Bay, stated that the owner has invested a substantial amount of money into the property due to a fire and this signage would be the only identification being placed on the site. She further stated that the sign would be constructed of cedar with vinyl graphics and would have landscaping features placed around it. Mr. Krasniewski inquired if the landscaping features would allow the sign to further extend into the setback area. Mr. Muehrer responded that the landscaping would not permit the sign to further intrude into the setback area and added that the City encourages landscaping features around signage for aesthetic purposes. Mr. Cornell questioned if the sign was replacing an existing one on the site. Ms. Mettler replied that it previously did not have an identification sign on the parcel. Mr. Penney commented that the Board had denied a variance request in the past for signage for a sewing machine repair shop and questioned what the difference was between that request and the one being reviewed today. Board of Appeals Minutes 1 July 28, 2010 Mr. Muehrer responded that the request for the repair shop that was denied was due to the fact that it was located at a single - family residence which was operating a home occupation from their dwelling and the permit for home occupations does not allow signage on the site. This request involves the limitations of the setbacks on the parcel only as the signage would be allowed in this zoning district. Motion by Cryan to approve the request for a variance to permit an identification sign with a 10' front yard setback. Seconded by Penney. Motion carried 4 -0. Finding of Facts: Least variance necessary. No harm to public interest. Ms. Cryan inquired about the City's ordinance regarding the amount of space on a parcel that could be impervious and the amount that could be grass as this parcel appears to have an excessive amount of cement on the site. Mr. Muehrer replied that the ordinance depends on what zoning classification the property is located in and also varies from one property to another in certain districts. He further stated that the City is conscience of the problems created by too much impervious surface particularly with flooding issues experienced in the city. Mr. Krasniewski questioned the parking layout for this site which has two parcels, one at 1629 Rainbow Drive and one at 1645 Rainbow Drive as it appears that there is not sufficient parking on one of the sites. He inquired if this was a grandfathered situation. Mr. Muehrer responded affirmatively. COMMUNICATIONS Mr. Cornell stated that a new board member was appointed at the last Council meeting and inquired if the new member would be sent materials to attend the next meeting. Mr. Muehrer replied that the new member has been sent orientation materials and would be sent a board packet for the upcoming August meeting. There being no further business, the meeting adjourned at 3:43 p.m. (Krasniewski/Penney).
