transitional yard standards and landscape standards in
conjunction with parking lots are not being met.
Mr. Roskom stated that the Plan Commission would not be able to
sign the Certified Survey Map because compliance with the Zoning
Ordinance standards have yet to be determined and would need to
be determined prior to approval signature.
Motion by Schwalenberg to move approval of the lot division with
the condition that prior to approval signatures, the
applicant /petitioner indicate compliance with all applicable
Zoning Ordinance standards such as, but not limited to, setback
standards, parking standards, buffing /landscape standards, and
loading and unloading facility standards. Seconded by Pressley.
Motion carried 6 -1 (Aye: Blassingame, Bock, Borsuk, Pressley,
Ruppenthal, Schwalenberg; Nay: Biendarra).
III. PRESCOTT ANNEXATION - Edward Prescott, et al, owners.
City Administration requests the Plan Commission to review and
approve the Prescott Annexation for property located east of and
adjacent to 2670 Jackson Street on the south side of West Packer
Avenue.
Stephen P. Jansen, 3815 Fond du Lac Road, stated he was present
on behalf of Northern Auto Supply Company who would like to
relocate their downtown store to the site stated above. He
further stated the site in question is consistent with other uses
presently there and it has sewer and water. Northern Auto Supply
Company would build a similar store at that location as the one
they presently have at the downtown location and that this
request would involve no industrial use.
Motion by Schwalenberg to approve the Prescott Annexation with
temporary and permanent zoning of C -2 Light Commercial. Seconded
by Biendarra. Motion carried 7 -0.
IV. FINDING ON FLOODPLAIN STATUS /PROPERTY NORTH OF ROBIN AVE. &
FIELD STREET - John Mark, Security Investments, Inc.
Mr. John Mark, Security Investments, Inc., 763 N. Westfield,
Oshkosh, WI, is asking that the Plan Commission and Common
Council find that the property north of Robin Avenue and
Westfield Street not be considered as being within the limits of
the regulatory floodplain due to the fact that the property
identified has an elevation that exceeds the regional flood
elevation profile for this area.
Mr. Kinney explained the Department of Natural Resources (DNR)
has indicated the limits of the floodplain in the aforementioned
area at 752 ft. above mean sea level. The shaded area on the map
attached to the staff report represents Westfield Heights as well

as an R -4 Multiple Dwelling District area owned by the
petitioner.
Mr. Ruppenthal inquired if some of this property was filled in as
a result of the proposed development.
Mr. Mark indicated that we had filled in some areas with the
permission of the City and we also installed sewer and water.
Mr. Kinney stated at the time the property was rezoned and
subdivided, Mr. Mark proceeded as a developer does.and did site
improvement work to the property. He noted that while the DNR
had felt the area was in the floodplain, the regulatory maps
showed that it was well outside the area. He noted that the
existing conditions show the area to be outside the regulatory
floodplain.
Paul Sandors, 985 S. Westfield Street, inquired if his house was
located within the floodplain area and Mr. Kinney indicated that
it was not.
Motion by Ruppenthal to recommend that the Common Council find
that the property identified in Map 1 attached to the staff
report is not part of the regulatory floodplain per Article XIV
of the City of Oshkosh Municipal Code, Floodplain Provisions.
Seconded by Schwalenberg. Motion carried 6 -0 with 1 present
(Borsuk).
V. CONDITIONAL USE PERMIT /1010 N. Westfield St. - Evergreen
Retirement Community, Inc., owner /petitioner
Evergreen Retirement Community, Inc., owner /petitioner,
request(s) the Plan Commission to review a Conditional Use Permit
(CUP) for a 10- person Community Based Residential Facility (CBRF)
for ambulatory persons with Alzheimer's disease for the property
located at 1010 N. Westfield Street.
Julie Zuleger, Assistant to David A. Green, President of
Evergreen Retirement Community, Inc., stated Evergreen had
acquired land from the E.B. Davis Group Home and they would like
to turn this existing building into a home for ambulatory persons
with Alzheimer's disease. Evergreen has received a license from
Madison and have passed City Inspection for up to eight people.
The proposed facility requires a Conditional Use Permit for a 10-
person Community Based Residential Facility (CBRF).
Motion by Pressley for approval of a Conditional Use Permit (CUP)
for a 10- Person CBRF with the condition that all appropriate
permits from the Wisconsin Department of Health and Social
Services, or any other applicable agencies, be obtained prior to
the operation of the group home. Seconded by Biendarra. Motion
carried 6 -0 with 1 present ( Ruppenthal).
