HomeMy WebLinkAbout10-219JULY 13, 2010 10 -219 RESOLUTION (CARRIED 6 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: AMEND INITIAL RESOLUTION 10 -77 FOR SPECIAL ASSESSMENTS / CONCRETE PAVING, SIDEWALK, DRIVEWAY & UTILITIES / JACKSON STREET - MURDOCK AVENUE INTERSECTION IMPROVEMENT PROJECT INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, on May 25, 2010, the Common Council of the City of Oshkosh approved an initial resolution pursuant to Section 66.60 of the Wisconsin Statutes; and WHEREAS, it is necessary to revise the initial resolution to include a portion of Hobbs Avenue and Kentucky Street. BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows: 1. The Common Council hereby declares its intention to exercise its power under Section 66.0703 and 66.0705 of the Wisconsin Statutes to levy special assessments upon property within the following described areas for benefits conferred upon such property by improving the following: Concrete Paving, Asphalt Paving, Concrete Curb and Gutter, Sanitary Sewer Laterals (New & Relay), Sanitary Sewer Main, Water Main, Water Laterals (New), Storm Sewer Laterals, Sidewalk Repair, New Sidewalk, and Concrete Driveway Approach: Jackson Street — 100' South of Hobbs Avenue to 500' North of Murdock Avenue Murdock Avenue — 450' West of Jackson Street to Burdick Street Hobbs Avenue — Jackson Street to 25' West of Jackson Street Kentucky Street — Murdock Avenue to 25' South of Murdock Avenue 2. The total amount assessed against such district shall not exceed the total cost of the improvements and the amount assessed against any parcel shall not be greater than the benefits accrued thereto from said improvements. 3. The assessments against any parcel may be paid according to the provisions of Section 25 -83 through 25 -89 of the Oshkosh Municipal Code. JULY 13, 2010 10 -219 RESOLUTION CONT'D 4. The Board of Public Works is directed to prepare a report consisting of: (a) Final plans and specifications for said improvements. (b) An estimate of the entire cost of the proposed work or improvements. (c) An estimate as to each parcel of property within the assessment district of: (1) The assessment of benefits to be levied for each improvement. (2) The damages to be awarded for property taken or damages by each improvement. (3) The net amount of benefits over damages or the net amount of damages over benefits for each improvement. Upon completion of such report, the Board of Public Works is directed to file a copy thereof in the City Clerk's Office for public inspection. 5. Upon receiving the report of the Board of Public Works, the City Clerk is directed to give notice of a public hearing on such reports as specified in Section 66.0703(7)(a) of the Wisconsin Statutes. The hearing shall be held by the Board of Public Works at the Council Chambers in the City Hall at a time set by the Clerk in accordance with the Wisconsin Statutes. 6. The installation of said street improvements shall be accomplished according to the provisions of Section 25 -3 through 25 -11 of the Oshkosh Municipal Code. Gohde, Assistant Director of Public Works July 8, 2010 Amend Initial Resolution 10 -77 for Special Assessments for Paving, Sidewalk, Driveway and Utilities / Jackson Street - Murdock Avenue Intersection Improvement Project BACKGROUND Resolution 10 -77 was the initial resolution for allowing the City to assess abutting property owners for improvements completed during the reconstruction of the Jackson Street and Murdock Avenue Intersection. The assessable work included concrete pavement, sidewalk, driveway aprons, sanitary sewer laterals, and storm sewer laterals. ANALYSIS Additional work was required on the side streets to tie in the new concrete pavement to the existing roadways at side street intersections. The resolution is amended to include Hobbs Ave from Jackson St to 25' west and Kentucky St from Murdock Ave to 25' south. FISCAL IMPACT Assessments allow the City to recover a portion of the costs associated with projects from benefiting properties. Assessments will be calculated per the City's Assessment Policy. Funding for the projects is included in the 2010 Capital Improvement Program in the Street, Storm Sewer, Sanitary Sewer and Water Main sections.
