PLAN COMMISSION MINUTES
JANUARY 2, 2001

The meeting was called to order by Chairman Borsuk. Roll call was taken and a quorum declared
present.
The minutes of the December 19, 2000 Plan Commission meeting were approved as mailed.

I:REZONING– FORMER RAILROAD RIGHT-OF-WAY; 521 W. 16 AVENUE
Zion Lutheran Church, petitioner for Lawrence Gohlke, owner, requests the Plan Commission to review
and approve the rezoning of property that was formerly part of the Wisconsin Central Railroad right-of-
way from R-2 Two Family Residence District to M-2 Central Industrial District. The property

proposed for rezoning is 50 feet wide and generally runs from 16 Avenue to about 379 feet south of
th
16 Avenue.
Attorney Chris Kindt, 345 Windingbrook Drive, stated he was representing the petitioner and was
available to answer any questions.
Mr. Ruppenthal questioned what type of landscaping was planned to restore the transitional yard
setback. Mr. Bluemke stated they are required to meet setbacks, however, they will be requesting a
variance to have the setback remain as is.
Questions arose regarding the owner and the petitioner. Attorney Kindt stated Zion Lutheran Church
became the owner as of December 27, 2000.
Jeff Thompson, 528 W. 16th Avenue, stated he had questions regarding the use of the property, but
would talk with the owners at another time since he realized this board was not dealing with those
issues.

Mr. Smith questioned if the eastern half of the railroad right-of-way had been offered to the adjoining
property owners. Mr. Bluemke stated the property had been offered for sale to the adjoining property
owners, however, they had refused to buy. Mr. Smith also questioned why the property wasn’t being
rezoned through to 17th Avenue. Mr. Bluemke stated there was no request for rezoning of the property
to the south. Discussion followed as to the ownership and use of the land. Mr. Bluemke stated rezoning
any additional railroad right-of-way at this time was being held off until a more definite use of the land
was known, since a house would not be able to be constructed on the site if it were rezoned at this time
to an M-2 district.
Motion by Ruppenthal for approval of the rezoning of property that was formerly part of
the Wisconsin Central Railroad right-of-way from R-2 Two Family Residence District to
M-2 Central Industrial District. Seconded by Smith. Motion carried 5-0.
II:REZONING & CONDITIONAL USE PERMIT; 753 N. MAIN STREET
Zion Lutheran Church, petitioner for Raymond Last, owner, requests the Plan Commission to review
and approve the partial rezoning of property located at 753 N. Main Street from M-2 Central Industrial
District to C-3 Central Commercial District, and review and approve a Conditional Use Permit (CUP)
for an adult day care center at the same location. The subject property is currently occupied by Sterling
Gardens.
Attorney Chris Kindt, 345 Windingbrook Drive, stated he was representing the petitioner and was
available to answer any questions.
Mr. Ruppenthal questioned what modifications would have to be made to meet the ordinance
requirements. Reverend Nerenhausen stated he wasn’t aware of any modifications necessary at this time.
He stated the day care facility will be housed in the current flower shop and the busses will be kept in
the garage in the back.
Mr. Blassingame questioned if the day care was licensed by the state. Reverend Nerenhausen stated the
day care was licensed by the stated and he believed an inspector from the Green Bay area would handle
the necessary inspections. Attorney Kindt stated the day care was currently operating on Marion Road.
Mr. Smith questioned if any manufacturing was occurring in this district. It was noted there was cold
storage, which is a manufacturing use.
Mr. Reschenberg questioned the petitioner and owner as listed on the application. Mr. Bluemke stated
the owner has concurred with the petitioner’s request, therefore has signed the application. Reverend
Nerenhausen stated he needed to know if the rezoning would be approved, and the use allowed by a
conditional use permit before he would close on the property.
Motion by Smith to approve the partial rezoning of property located at 753 N. Main Street
from M-2 Central Industrial District to C-3 Central Commercial District, and approve a
Conditional Use Permit for an adult day care center at the same location. Seconded by
Ruppenthal. Motion carried 5-0.

III:REZONING 400 N. SAWYER STREET
Zion Lutheran Church, petitioner and owner, requests the Plan Commission to review and approve the
rezoning of property located at 400 N. Sawyer Street from R-1 Single Family Residence District to R-5
Multiple Dwelling District.
Attorney Chris Kindt, 345 Windingbrook Drive, stated he was representing the petitioner who was also
the owner. He explained there was an error in the supporting material submitted with the application. He
stated this request didn’t refer to a planned development overlay district, but basically was for additional
parking space for the elderly.
Mr. Ruppenthal asked if anything was planned for the small piece of land to the north. Reverend
Nerenhausen stated it was generally a drainage area for the parking lot.
Motion by Ruppenthal for approval of the rezoning of property located at 400 N. Sawyer
Street from R-1 Single Family Residence District to R-5 Multiple Dwelling District.
Seconded by Blassingame. Motion carried 5-0.
There being no further business, the meeting adjourned at 4:18.
