Roll call was taken and a quorum declared present. The minutes of April 17, 2001 were approved as mailed. (Krueger/Blassingame) Unanimous. I:REZONING AND CONDITIONAL USE PERMIT/DEVELOPMENT PLAN REVIEW 609 – 629 DIVISION STREET, 104 W. PARKWAY AVENUE AND 107 IDA AVENUE Burns Development Corporation, petitioner, requests the Plan Commission to review and approve a rezoning from C-3 Central Commercial District to C-3PD Central Commercial District with a Planned Development Overlay and that the Commission approve a Conditional Use Permit/Development Plan for the property generally located at 609 – 629 Division Street, 104 West Parkway Avenue and 107 Ida Avenue. The general area is characterized by residential land uses to the north, south, and west, and commercial land uses to the east. Mr. Smith questioned if 108 Parkway Avenue was considered for acquisition. Ms. Kepplinger stated the property is owner occupied, and the owners have lived there for many years. She also mentioned it made a nice transition between a new development and an older neighborhood. Mr. Ruppenthal questioned if there was a strong market for that type of development. Brian Burns, 905 Oregon Street, stated he doesn’t have any signage on the property advertising rentals, and has maintained a waiting list for quite awhile. He stated the location; the design and the amenities make the apartments very popular. Mr. Burns stated the market was somewhat questionable in the area, therefore the decision was made to include extra amenities to make the apartments more desirable. Mr. Smith asked if there were many students living in the apartments. Mr. Burns stated half of his units are to be affordable but by law, full time students do not qualify for these units. Of the remaining 24 units which are not classified as affordable, 3 are rented to students, although he stated he receives 10-15 calls per week from students interested in housing. Plan Commission Minutes Page 2May 1, 2001 Motion by Blassingame for approval of the rezoning from C-3 Central Commercial District to C- 3PD Central Commercial District with a Planned Development Overlay and for approval of a Conditional Use Permit/Development Plan for the property generally located at 609-629 Division Street, 104 West Parkway Avenue and 107 Ida Avenue with the following conditions: 1)A landscape plan, which includes the proposed fencing, must be submitted and approved by the Department of Community Development prior to obtaining a building permit. 2)The elevations of the buildings must be approved by the Department of Community Development prior to obtaining a building permit.
