HomeMy WebLinkAboutMinutes BOARD OF APPEALS MINUTES July 25, 2001 PRESENT: Carl Ameringer, Fred Dahl, Cheryl Hentz, John Schorse EXCUSED: Joel Kluessendorf, Don Krueger STAFF: Matt Tucker, Associate Planner; Mary Lou Degner, Recording Secretary The meeting was called to order by Vice Chairman Schorse. Roll call was taken and a quorum declared present. The minutes of July 11, 2001 were approved as mailed. Hentz/Dahl. Unanimous. th I: 428 W 8 Avenue Mary Demler, applicant and owner, requests a variance to expand a nonconforming driveway, whereas Section 30-4(B)(d) of the City of Oshkosh Zoning Ordinance states that no alterations, additions, or expansions may occur which will increase the dimensional nonconformity of a structure. Matt Tucker introduced the item with pictures. Vice Chairman Schorse inquired if Ms. Demler would be putting a garage on site. Ms. Demler responded perhaps at sometime in the future, at this point in time she is contending with water seepage into the basement from the old sidewalk that pitched toward the house. Mr. Tucker stated that the existing storage structure takes up a large portion of the allowed 30% of the rear yard area, and would take up most of the available space for a garage. Ms. Hentz inquired as to the amount of water that is accumulated in the basement during a normal rainfall. Ms. Demler stated about 2” and noted that she does have a sump pump. She stated that her intention is to divert the water away from the foundation of the house. Ms. Hentz asked if the applicant had a problem with the condition recommended. Ms. Demler responded that she did not have a problem with it, but stated that the neighbor may have a concern. She inquired as to why the driveway along the house had to be screened instead of just the new expansion. Mr. Tucker explained that the intent of the condition is to help mitigate what may have a considerable adverse impact on the adjacent properties. Mr. Ameringer asked if the neighbor had any objections. th Ms. Demler presented a paper stating that Mr. & Mrs. Phil Fleischman, 432 W 8 Avenue, had no objection to the variance request. Discussion followed as to the width of the driveway, the screening options, and the recommended condition. Motion by Hentz for approval of the variance to expand a nonconforming driveway with the following condition: 1.The driveway expansion area be screened in accordance with Section 30-35(I). Dahl seconded the motion. Motion carried 4-0. Unanimous.
