BOARD OF APPEALS MINUTES
MARCH 14, 2001
PRESENT: Fred Dahl, Cheryl Hentz, Joel Kluessendorf, John Schorse, and Don Krueger Chairman

The meeting was called to order by Chairman Don Krueger. Roll call was taken and a quorum declared
present.
The minutes of March 6, 2001 were approved as mailed (Hentz/Dahl).
I: 1503 LINWOOD AVENUE
Christine Braun, applicant and owner, requests a variance to have a 6’ high wood fence with a 20’ front
yard setback; whereas Section 30-35(E) of the Zoning Ordinance requires a 6’ high fence to have a 25’
front yard setback.
Christine Braun, 1503 Linwood Avenue, stated the difference between this request and the last variance
request was 8’ from Olive Street making the setback 20’ instead of 12’. She passed around pictures of
the fence currently on the lot, and stated the yard wouldn’t have any privacy if the 8’ section of fence
would have to be removed.
Mr. Schorse questioned how far the setback was at this time. Ms. Braun stated the fence was 12’ from
the sidewalk. She stated she had received a violation correction that asked for an 8’ section of fence
removed and for the fence to be moved 8’ towards the house.
Motion by Hentz for approval of the variance to have a 6’ high wood fence with a 20’ front
yard setback. Seconded by Schorse. Motion carried 5-0.
Finding of the Fact: Ms. Hentz stated the variance wouldn’t create a safety problem for traffic from
the south. Mr. Schorse stated it was the minimum needed for the fence to provide
a function for the corner lot. Ms. Hentz also stated it would correct the violation.
II. 1714 W. LINWOOD AVENUE
Gail and Gary Lenz, applicants and owners, request a variance to construct a 24’ x 24’ detached garage
in the front yard; whereas Section 30-1(A)(2) of the Zoning Ordinance requires an accessory structure to
be located in a side or rear yard.
Gail Lenz, 1714 W. Linwood Avenue, passed around pictures of the area in which they desire to
construct a detached garage.
Mr. Schorse questioned what trees would need to be taken down. Gary Lenz, 1714 W. Linwood, stated 2
trees would need to be taken down to construct the garage.

Ms. Hentz questioned if they had any problem with the conditions outlined in the Staff Report. Mrs.
Lenz stated they had no problem with the conditions.
Chairman Krueger questioned what the distance was from the sidewalk to the garage. Mr. Bluemke
stated it was 25’. Mrs. Lenz added it measured 21’ from the sidewalk on Linwood. Discussion followed
regarding which street the driveway entrance would be located on.
Mr. Kluessendorf questioned if there had been any objections from the neighbors. Mr. Bluemke stated
he hadn’t received any objections. Mr. Kluessendorf questioned how high the garage would extend.
Mr. Bluemke stated the Ordinance required garages to be no more than 18’ high.
Mr. Schorse stated there didn’t appear to be many alternative locations for construction of a garage.
Chairman Krueger stated it would eliminate unsafe and unsightly parking.
Motion by Schorse for approval of the variance to construct a 24’ x 24’ detached garage in
the front yard. Seconded by Dahl. Motion carried 5-0.
Finding of the Fact: Ms. Hentz stated it would eliminate unsafe and unsightly parking, and Mr. Dahl
stated there wasn’t any other alternative of where to locate a garage on the site.
There being no further business, the meeting adjourned at 3:45 p.m.
