PURPOSE: APPROVAL OF ANNUAL CITY LICENSE / FRATELLO'S BANQUETS —
OSHKOSH CONVENTION CENTER
INITIATED BY: CITY CLERK
WHEREAS, an application for a license has been made, fees deposited, and all legal
procedures have been taken as per Ordinance of the City of Oshkosh,
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the following licenses be granted:

with the following condition:
That the License be surrendered at such time as the State of Wisconsin
Department of Revenue issues a Public Facilities Liquor Permit for the
Oshkosh Convention Center.
BE IT FURTHER RESOLVED that upon surrender of this license the City Clerk is
hereby directed to hold the license until such time as an application is filed for the Marion
Road /Pearl Avenue Redevelopment Area.

RE: Renewal of Annual City License / Fratello's Banquets — Oshkosh
Convention Center and Designate Fox River Brewing Company, LLC as
Concessionaire and Authorize Application to the State for a Public
Facilities Liquor Permit for the Oshkosh Convention Center
BACKGROUND
The City of Oshkosh owns the Oshkosh Convention Center located at 2 North Main
Street in the City of Oshkosh. The City has entered into an agreement with the Oshkosh
Convention and Visitors Bureau (OCVB) for the operation of the Center and the OCVB
has, in turn, entered into an agreement with Fox River Brewing Company, LLC (Agent:
John Supple) to provide catering services for the Center.
To provide full food and beverage services for the Center, in November 2008, the Fox
River Pizza & Buffet Liquor License (now Fratello's Banquets — Oshkosh Convention
Center) (Agent: John Supple) was allowed to be transferred from the Marion
Road /Pearl Avenue Redevelopment Area when the Developer for that area indicated
that they were not going to proceed with development of the anticipated hotel and /or
restaurant for the riverfront parcel within the redevelopment area. At the time the license
was transferred, the Council included a condition that the license be transferred back to
the Marion Road /Pearl Avenue Redevelopment Area at such time as the City entered
into an agreement with a successor operator to the OCVB for proposed operation of the
Center. The OCVB has, at this time, indicated a willingness to continue operation of the
Center for a limited period of time and has reviewed the catering operations and made a
determination to continue to contract with the Supple's for food and beverage services
for the Center.
Through further review of State Statutes, staff identified the possibility of obtaining a
liquor permit for the Convention Center through the State Department of Revenue. Staff
has had conversations with both the OCVB and the Supples regarding this, and both
parties have been cooperative and supportive of the City's efforts to obtain the State
permit and return the current license to the Marion Road /Pearl Avenue Redevelopment
area as had been originally anticipated.

ANALYSIS
The two resolutions before the Council would renew the current license in use at the
Convention Center and would designate a concessionaire and authorize application to
the State for a Public Facilities Permit for future alcohol beverage sales at the
Convention Center. At the time the State Public Facilities Permit is issued, the Supples
will surrender the current license back to the City.
The State Public Facilities Permit would be issued directly by the State and can be used
for certain types of public facilities, including a facility such as the City's Convention
Center. The requirements for the Public Facility Permit include the requirement that the
City designate a concessionaire" by resolution of the governing body and authorize
application to the Department of Revenue for the Public Facilities Permit.
Through conversations with representatives of the Department of Revenue, city staff is
confident that the requirements of the Public Facilities Permit will be met. However,
because the current license expires June 30 and representatives of the Department of
Revenue could not guarantee issuance of the Public Facilities Permit prior to July 1St
staff is also recommending that the current license be renewed to avoid any potential
gap in licensing and the provision of services at the facility.
FISCAL IMPACT
There is no specific fiscal impact due to this item.
RECOMMENDATION
Staff recommends that the Council approve the Resolution renewing the current license
and also approve the Resolution designating Fox River Brewing Company, LLC as
concessionaire and authorizing application for a Public Facilities Liquor Permit for the
Oshkosh Convention Center.
