Ubrig, City Clerk DATE: June 3, 2010 RE: Non -Quota Liquor License — Blue Agave Southwest Bar & Grill BACKGROUND Blue Agave Southwest Bar & Grill has requested that the City of Oshkosh issue a non -quota liquor license for a proposed restaurant located at 3015 S. Washburn Street, the restaurant located in the Horizons Outlet Mall. The owners have submitted a plan showing 238 interior seats and an additional 84 seats located on an outdoor patio. The exterior seating will be located on a defined patio area enclosed with fencing including gates for entrances and exits. ANALYSIS Wisconsin Statutes establish a quota on the number of liquor licenses that a municipality may issue; however, the statutes also allow municipalities to exceed their quotas for one of several exceptions. One of the allowed exceptions is that a municipality may issue a license for a full - service restaurant that has a seating capacity of 300 or more persons. In the past, the City has applied this provision only to restaurants that have had a 300 or more person seating capacity within the restaurant building. In this case, the proposed restaurant would seat 238 in the building and would rely on additional seating in an outdoor area. Restaurant is a defined term under 125.02(18) which refers you to 254.61(5) which defines restaurant as follows: "Restaurant" means any building, room or place where meals are prepared or served or sold to transients or the general public, and all places used in connection with it and includes any public or private cot Non -Quota Liquor License — Blue Agave Southwest Bar & Grill 6/3/10: Page 2 school lunchroom for which food service is provided by contract. By reference to the term "place" in addition to building or room, the statutes would appear to allow municipalities to include outdoor seating areas in the number of seats counted toward the 300 seat minimum. The statute also does not include any limitation on how often it may be used or require that the area be usable in every weather condition. We contacted the State Department of Revenue who enforce the liquor licensing laws and were informed that this particular part of the alcohol laws is left up to the discretion of municipalities as to what they will accept as a 300 seat restaurant. The Department noted that state law makes no mention that all seating is to be indoors for purposes of this exemption and state law doesn't indicate that the seating must be 300 at all times of the year such as might occur if a portion of the 300 is outdoors and unusable in winter. FISCAL IMPACT If the Council should choose to allow the applicant to count the outdoor seating and issue a liquor license for this restaurant, the City would receive fees for the license and property tax revenue. RECOMMENDATION The Restaurant has provided a substantial number of the required 300 seats within the restaurant's interior. The 84 seats provided in the outdoor patio area are provided in a defined area, intended to be available at any time weather allows, are enclosed by a fence and gates and actually exceed the minimum required for the 300 seat exemption.
