HomeMy WebLinkAboutMinutes PLAN COMMISSION MINUTES MARCH 4, 2003 PRESENT: Lurton Blassingame, David Borsuk, Jon Dell’Antonia, Steve Gehling, Kathleen Propp, Achim Reschenberg, John Ruppenthal, and Lee Bettes, Vice Chairman EXCUSED: Jack Heinemann, Donald Krueger, and Donald Pressley STAFF: Darryn Burich, Principal Planner, Jackson Kinney, Director of Community Development, and Vickie Rand, Recording Secretary The meeting was called to order by Vice Chairman Bettes. Roll call was taken and a quorum declared present. The minutes of February 18, 2003 were approved as mailed (Blassingame/Reschenberg). Unanimous. I: CONDITIONAL USE PERMIT TO ALLOW AN OFF-PREMISE SIGN GENERALLY LOCATED AT 2195 STATE RD. 21 (RACETTE FORD) RLO Signs Inc., petitioner for Art Pommerening, owner, requests Plan Commission review and approval to replace a nonconforming off-premise sign generally located at 2195 State Road 21 (Racette Ford). The half acre subject property is zoned C-2PD General Commercial District with a Planned Development Overlay. Roger Oster, RLO Sign representative, 1030 Ontario Avenue, Sheboyan, stated they feel the proposed sign will project further down the highway. He stated they don’t have any other alternative than to move the sign into the retention area, which wouldn’t provide stability for the sign. Motion by Ruppenthal for approval to replace a nonconforming off-premise sign generally located at 2195 State Road 21 found to be consistent with the standards set forth in Section 30-11 (D) of the Zoning Ordinance subject to the following conditions: 1) Any future use of signage on the subject property be accessory to uses at 2195 State Road 21 with any signage change subject to review and approval by the Department of Community Development. 2) Landscaping to be installed in accordance with the approved landscaping plan within three months of issuance of the building permit for the sign or by September 30, 2003 3) Approval and permit by the Wisconsin Department of Transportation. Seconded by Dell’Antonia. Motion carried 8-0. Plan Commission Minutes 2 March 4, 2003 II: CONDITIONAL USE PERMIT FOR A NURSING/RETIREMENT FACILITY EXPANSION AT 815 S. WESTHAVEN DRIVE; ABANDON EASEMENT Omnni Associates, petitioner for Sisters of the Sorrowful Mother, owner, requests Plan Commission review and approval of a conditional use permit (CUP) and abandonment of an easement that will allow the expansion of the nursing/retirement facility at 815 S. Westhaven Drive. The 8.2 acre subject property is zoned R-3 Multiple Family Residence District that allows nursing homes through CUP. Mr. Burich introduced the item asking for the elimination of condition #3, which pertains to the Sawyer Creek Trail system. Mr. Burich explained when the City is ready to implement that portion of the Sawyer Creek Trail they will negotiate with all the owners at one time due to Affinity being the largest property owner along the trail in this area. Gray Krusner, Affinity Representative, stated the Sisters want to recreate the floodplain because it is their belief to replace a condition of the environment they have taken, even though they’ve been told it wasn’t necessary according to the City Zoning Ordinance. Mr. Dell’Antonia stated he was concerned about eliminating the easement for the trail from this CUP. He stated negotiations for an easement at a later date will most likely cost the City more. Mr. Burich stated the Sisters are concerned about having the trail close to the site at this time, and since the City didn’t have a design in place for the trail, staff thought it would be appropriate to work out the easement for the trail with the property owners at a future date when a design for the trail was more certain. Mr. Krusner stated the Sisters are concerned about the security and safety of their tenants, taking into consideration their age and health, with the proposed location of the trail. He stated Affinity would like to see the Sawyer Creek Trail connected to the Affinity property and the Sisters property. Mr. Dell’Antonia questioned where the trail would go. Mr. Mr. Burich stated there weren’t any alternatives for the trail location at this time. Mr. Borsuk stated he was also concerned with eliminating the condition for the trail, noting the easement can always be modified in the future. Mr. Dell’Antonia stated he was concerned about preserving the trail for future use, and not have it end and pick up again in another area. Mrs. Propp stated she understood the Sisters safety concerns, however, research has shown that trails do not create safety or crime problems. She stated she would like the condition regarding the trail easement to remain as part of the CUP. Mrs. Propp stated she was also concerned about moving the floodplain. Vice Chairman Bettes stated the Plan Commission would be reviewing the floodplain issue again at a later date. Motion by Blassingame for approval to abandon the easement as well as to find the CUP to allow construction of an addition to a nursing/retirement facility consistent with the standards set forth in Section 30-11 (D) of the Zoning Ordinance and be approved with the following conditions: Plan Commission Minutes 3 March 4, 2003 1) Floodplain maps be amended to remove the proposed structure from the 100 year floodplain. 2) A 150 foot wide stormwater easement (75 feet on each side of the creek starting at the centerline of the creek) be provided along Sawyer Creek. 3) Provide a 15 foot wide recreational trail easement along Sawyer Creek. Seconded by Borsuk. Motion carried 8-0. III: CONSENT AGENDA A: LAND DIVISION/CERTIFIED SURVEY MAP –KNAPP STREET Roehlig Land Surveying & Consulting, petitioner for Del Tritt, owner, requests the Plan Commission to review and approve a three lot land division/certified survey map along Knapp Street. The subject properties are part of the Foster Heights Plat that was preliminarily approved by the Plan Commission on February 18, 2003 and by the Common Council on February 25, 2003. Motion by Reschenberg for approval of a three lot land division/certified survey map along Knapp Street subject to the following conditions: 1) All easements needed for stormwater and utilities be granted as determined by the Department of Public Works. 2) The lots created from the land division be included in the final grading and drainage plan at time of final plat approval. 3) The ditch along the south side of Lot 3 be maintained for drainage purposes until such time as a drainage plan has been approved for Foster Heights subdivision. 4) Buildings to be constructed on the lots shall be required to use new sewer and water laterals. 5) Lots to be included in all calculations and engineering requirements for the Foster Heights Plat.
