HomeMy WebLinkAboutMinutes PLAN COMMISSION MINUTES AUGUST 19, 2003 PRESENT: Jack Heinemann, Shirley Mattox, John Ruppenthal, Patrick Weston, and Lee Bettes, Chairman EXCUSED: David Borsuk, Jon Dell’Antonia, Steven Gehling, Donald Pressley, Kathleen Propp, and Cathy Scherer STAFF: Darryn Burich, Principal Planner, and Vickie Rand, Recording Secretary The meeting was called to order by Chairman Bettes. Roll call was taken and a quorum declared present. Chairman Bettes called for any additions or corrections to the meeting minutes of August 5, 2003 as mailed. Ms. Mattox stated she would like the minutes to reflect that she would like the parkland fees collected to be used for land acquisition purposes only, added on page 7 where she had asked for clarification if the fees would be used for park equipment or land. Motion by Ruppenthal to approve the minutes as amended, seconded by Mattox. Unanimous. I: CONSENT AGENDA A: TWO LOT LAND DIVISION/CSM ALONG HOMESTEAD AVENUE Frueh Consulting Services, petitioner for Steve and Lynne Behr, owners, request the Plan Commission to review and approve a two lot land division/certified survey map (CSM) for property located along Homestead Avenue. The approximate 1 acre parcel is zoned R-1 Single Family Residence District and was recently annexed to the City from the Town of Algoma. Mr. Burich explained that a condition is being recommended to require that property be dedicated in order to provide for a cul-de-sac with terrace and sidewalk. The condition is being requested due to the fact that the current turn around is too small and the street will never be extended to the west due to the subdivision development in that area. B: ACCEPT RIGHT-OF-WAY DEDICATION AT THE NORTH END OF LILAC ST. Ron Tenpas, Beechnut Development Inc., petitioner/owner, request the Plan Commission to review and approve the acceptance of right-of-way at the north end of Lilac Street. The segment of right-of-way to be dedicated is approximately 4 feet wide, 60 feet long, and about 251 square feet in area. The reason for the dedication is due to a legal description discrepancy involving the area to the north of the proposed dedication in the cul-de-sac and to the south for the portion of Lilac Street that was developed as part of two separate subdivision plats. Plan Commission Minutes 2 August 19, 2003 C: ACCESS CONTROL VARIANCE TO ALLOW THREE DRIVEWAYS WHEREAS ONLY TWO ARE ALLOWED: CHERRY PARK COURT Thomas Wood, petitioner for Ron Leichtfuss, owner, request the Plan Commission to review and approve a variance to the Access Control Ordinance to allow a development with three driveway accesses whereas Section 25-104.1(e) of the Access Control Ordinance allows a maximum of two driveway approaches on local and collector streets. The subject property is located along Cherry Park Court just off of Fond du Lac Road in the 3600 block. D: ACCESS CONTROL VARIANCE TO ALLOW FOUR DRIVEWAYS WHEREAS ONLY TWO ARE ALLOWED: W. WAUKAU AVENUE Midwest Real Estate, petitioner/owner, requests the Plan Commission to review and approve of a variance to Section 25-104.1(e) of the Access Control Ordinance to allow four driveway approaches whereas a maximum of two are allowed. The petitioner is proposing to construct an eight unit condominium building on the site. Jack Heinemann questioned if a precedence would be set on approval of additional driveways on Cherry Park Court and W. Waukau Avenue. Mr. Burich stated these types of requests need to be reviewed on a case by case basis. He also stated that he reviews these cases with the Transportation Director who has given his approval for items “C” & “D”. Chairman Bettes stated that typically the Plan Commission hasn’t allowed additional driveways to be installed on busier roads. Motion by Heinemann for approval of the Consent Agenda with the condition for Item “A” as follows: 1. Right-of-Way be dedicated at the west end of Homestead Drive to construct an adequate cul-de-sac for turn around purposes. Seconded by Mattox. Motion carried 5-0. II: VACATE RIGHT-OF-WAY PART OF LAKEVIEW PARK SUBDIVISION MENOMINEE DRIVE AREA City Administration requests the Plan Commission to review and approve the vacation of right-of-way dedicated as part of the Lakeview Park Subdivision, which was platted in 1924. The areas to be vacated are part of a 30 foot wide by 730 foot long public lane dedicated with the plat that lies between eight properties on Hickory and Chestnut Streets. Mr. Burich stated he had received a call from the property owner at 1630 Chestnut Street who was concerned that the City would increase the density of development in the area, and also a call from a property owner at 1633 Hickory Street who was concerned about the increase in property taxes. Mr. Ruppenthal questioned how the large park was used in the subdivision. Mr. Burich replied that the park was platted as a private park for the subdivision along with acreage across the street to the east along Menominee Drive on Lake Winnebago. Plan Commission Minutes 3 August 19, 2003 Motion by Ruppenthal for the approval of the vacation of right-of-way dedicated as part of the Lakeview Park Subdivision subject to the following condition: 1. Vacated area to be maintained as a public and private utility easement. Seconded by Weston. Motion carried 5-0. III: VACATE RIGHT-OF-WAY AND LAND DIVISION/CERTIFIED SURVEY MAP AT THE INTERSECTION OF FARMSTEAD LANE AND GREENBRIAR COURT Jerry Mathusek, petitioner/owner, requests the Plan Commission to review and approve the vacation of right-of-way at the intersection of Farmstead Lane and Greenbriar Court and a land division/certified survey map for a parcel of land located along Greenbriar Court. The subject property is zoned R-1 Single Family Residence District. There was no discussion on this item. Motion by Ruppenthal for approval of the vacation of right-of-way at the intersection of Farmstead Lane and Greenbriar Court and a land division/certified survey map for a parcel of land located along Greenbriar Court subject to the following conditions: 1. Vacated area to be maintained as a public and private utility easement with changes indicated on the face of the Certified Survey Map. 2. The outside right-of-way line at the intersection of Greenbriar Court and Farmstead Lane shall be established as a radius with the Certified Survey Map reflecting said radius. Seconded by Heinemann.
