HomeMy WebLinkAboutMinutes PLAN COMMISSION MINUTES NOVEMBER 18, 2003 PRESENT: David Borsuk, Steven Gehling, Shirley Mattox, John Ruppenthal, Cathy Scherer, and Lee Bettes, Chairman EXCUSED: Jon Dell’Antonia, Jack Heinemann, Donald Pressley, Kathleen Propp, and Patrick Weston STAFF: Darryn Burich, Principal Planner, and Vickie Rand, Recording Secretary The meeting was called to order at 4:00 p.m. by Chairman Bettes. Roll call was taken and a quorum declared present. Chairman Bettes called for approval of the November 4, 2003 Plan Commission Meeting Minutes. Mr. Gehling noted that in regard to the Conditional Use Permit amendment at 910 W. Murdock Avenue he felt the action taken by the Plan Commission to allow an overall area for boat placement versus restricting the petitioner to a specific number of boats was a wise choice and should be considered for other similar developments in the future. The minutes of the November 4, 2003 meeting were approved as mailed. (Ruppenthal/Scherer) Unanimous. I: CONSENT AGENDA A: ACCEPT TEMPORARY CONSTRUCTION EASEMENTS AND PERMANENT HIGHWAY/UTILITY EASEMENTS ALONG FOND DU LAC ROAD The Department of Public Works, petitioner for Margaret L. Hanson, David E. Butzlaff, and Sally Counts, owners, request the Plan Commission to accept Permanent Highway/Utility easements along the west side of Fond du Lac Road. The easements are being requested to accommodate storm sewer construction at this location. B: VACATE STORM SEWEREASEMENT FOSTER HEIGHTS SUBDIVISION R.A. Smith & Associates, Inc., petitioner for Dell Tritt, owner, requests the Plan Commission to review and approve the vacation of a portion of a storm sewer easement created as part of the Foster Heights Plat. The petitioner is requesting to vacate the 25 foot wide storm sewer easement, located in Lots 14, 15, 16, and 17 of the plat. Motion by Borsuk for approval of the consent agenda. Seconded by Scherer. Motion carried 6-0. II: AMEND SECTION 30-13 OF THE OSHKOSH ZONING ORDINANCE (FEES, REZONING) Section 30-13 of the Oshkosh Zoning Ordinance establishes the fee schedule the City charges in order to process various actions requiring review by the Plan Commission or Board of Appeals. As part of the 2004 budget process, City Departments were directed to examine fee schedules and make recommendations for adjustments to compensate for costs associated with the review process of items subject to fees. Plan Commission Minutes Page 2 November 18, 2003 Mr. Burich explained that increases have been seen with the cost of publishing, especially for the rezoning requests. He also reviewed the amount of staff time spent on processing rezoning requests, and presented comparable fees charged for rezoning requests throughout the Fox Valley. Mr. Ruppenthal questioned the average number of rezoning requests processed each year. Mr. Burich estimated that less than 15 rezoning requests are processed each year. Ms. Mattox questioned if there would be any advantage to implementing a tiered system such as Fond du Lac uses. Mr. Burich stated a tiered system would be more complicated, however, they may want to look at that option in the future with overall changes to the fee structure. Motion by Ruppenthal for approval of the fee for rezoning requests be increased to $300.00 as established in section 30-11 of the Oshkosh Zoning Ordinance. Mr. Borsuk questioned why $300.00 was recommended instead of recovering 100% of the cost. Mr. Burich responded that the entire fee schedule should be reviewed if the City was to consider recovering 100% of the processing costs associated with items requiring review by the Plan Commission and Board of Appeals. Seconded by Gehling. Motion carried 6-0. OTHER BUSINESS Chairman Bettes reminded the Plan Commission of the Comprehensive Plan Update Committee meeting on Wednesday, November 19th at 4 p.m. in room 404, Oshkosh City Hall.
