PLAN COMMISSION MINUTES DECEMBER 2, 2003 PRESENT: David Borsuk, Steven Gehling, Shirley Mattox, Donald Pressley, John Ruppenthal, and Kathleen Propp, Vice Chairman EXCUSED: Jon Dell’Antonia,
Lee Bettes, Jack Heinemann, Cathy Scherer, and Patrick Weston STAFF: Darryn Burich, Principal Planner, Jackson Kinney, Director of Community Development, and Vickie Rand, Recording Secretary
The meeting was called to order at 4:00 p.m. by Vice Chairman Propp. Roll call was taken and a quorum declared present. The minutes of the November 18, 2003 meeting were approved as
mailed. (Ruppenthal/Mattox) Unanimous. I: EXTRATERRITORIAL 3 LOT LAND DIVISION/CERTIFIED SURVEY MAP AT 375 E. SNELL ROAD R.A. Smith and Associates, petitioner for Justin Krueger, owner,
request the Plan Commission to review and approve an extraterritorial 3 lot land division/certified survey map (CSM) for a parcel of land generally located at 375 E. Snell Road in the
Town of Oshkosh. The 3.25 acre parcel is zoned for industrial purposes (under Winnebago County Zoning) and contains two dwellings, a large storage building, and assorted accessory structures.
Mr. Burich presented the item with a PowerPoint presentation noting that the purpose for which the land division is being requested doesn’t comply with either the Town of Oshkosh or
the City of Oshkosh Comprehensive plans. Doug Buettner, 1531 W. New York Avenue, complimented Mr. Burich on his presentation, however, he made reference to Mr. Burich’s statement regarding
the houses located on these lots being a problem, as he felt the problem lies where the City and the Township have drawn the line between zoning districts. He stated a nice residential
neighborhood is located to the north of this property and showed pictures of what the subject property looks like today, and also showed pictures of what the neighborhood might look
like in the future. Mr. Buettner disagreed with the Comprehensive Plans for both the City of Oshkosh and the Town of Oshkosh, and the zoning for manufacturing use on the subject property.
Mr. Buettner noted the value of residential property in the area will most likely decrease, and if the homes on the subject property were destroyed they wouldn’t be able to be rebuilt
under current conditions. He stated a bad situation has been created with the designation of light industrial use for this area. Mr. Ruppenthal questioned what effect the denial of this
request would have on the property owner. Mr. Burich stated denying this request would prevent the land division from taking place due the City’s extraterritorial review authority. Ms.
Mattox questioned if lot one as shown on the Certified Survey Map could be sold separately for industrial development. Mr. Burich replied that would be an option, however, a land division
would need to be made. He noted that he believes there is a request in to the County regarding lot one remaining for industrial use.
Plan Commission Minutes 2 December 2, 2003 Ms. Mattox also questioned if Snell Road was a major arterial. Mr. Burich stated Snell Road was a secondary arterial. He stated the petitioner
is proposing a 33 foot dedication of right-of-way, however, he noted the City standards for a secondary arterial calls for 40 feet to be dedicated for an 80 foot wide right-of-way. Mr.
Burich recommended that if the Plan Commission were to approve the land division then an additional 7 feet of right-of-way should be dedicated. Discussion continued regarding possible
land split options for the subject property and the corresponding zoning district options. Mr. Borsuk stated he would support the staff’s recommendation to deny this land division, especially
with the Town of Oshkosh and the City of Oshkosh having the same plan for this area. Ms. Mattox noted that a "For Sale" sign is in place on the property. She questioned if there could
be two different owners for this property. Mr. Burich stated there could not be two different owners for the property without a land division taking place. Motion by Pressley to deny
the Extraterritorial Three Lot Land Division/Certified Survey Map as it is not found to be consistent with the intended land uses for the subject area as identified in the Comprehensive
Plan of the City of Oshkosh per Section 30-71 (B), (I) (4), and (M) (5) (b)(i-iv) of the Zoning Ordinance. Seconded by Ruppenthal. Motion carried 6-0. There being no further business,
