PLAN COMMISSION MINUTES FEBRUARY 21, 2006 PRESENT: Lee Bettes, David Borsuk, Thomas Fojtik, Shirley Mattox, Kathleen Propp, Cathy Scherer, Jeff Thorkildsen, John Weinsheim and Chairman

Dell’Antonia called the meeting to order at 4:00 p.m. Roll call was taken and a quorum declared present. The meeting minutes of February 21, 2006 were approved as mailed. (Propp/Thorkildsen)
Unanimous. I: TWO LOT LAND DIVISION/CSM AND SUBDIVISION REGULATION VARIANCE AT 2323 JEFFERSON STREET – Showcase Custom Homes, petitioner/owner Jerry Mathusek, petitioner, 2755 Algoma
Blvd., stated he was available to answer any questions the Plan Commission may have. Chairman Dell’Antonia questioned what the plans were for the garage on the property. Mr. Mathusek
stated he understands that it has to be moved back and north to meet the ordinance requirements. requirements. He stated carpenters were going to look at the garage to determine if the
garage could be moved or if it would need to be demolished. Mrs. Scherer questioned if Showcase Homes was planning to build a new home on the vacant lot. Mr. Mathusek stated they had
planned to build a single family home like the one they are constructing at 1311 Evans Street, however, they have had an offer to purchase the lot, which the buyer would keep as a separate
lot and perhaps sell in the future for a single family dwelling. Mrs. Scherer questioned the Near East Neighborhood Plan and the existing 50’ lot widths in that area and if building
standards should be applied to this site. Mr. Burich stated staff decided against recommending infill standards in this instance due to the variety and age of homes in the neighborhood.
Mrs. Scherer questioned if the 2 homes to the south have the same width as the subject site. Mr. Burich stated it appeared to be the same width. He asked Mr. Mathusek about the garage
if they were to do construction on the vacant lot. Mr. Mathusek stated the garage would be attached. Discussion followed regarding the lot widths and design of homes in the area. Mr.
Burich stated the Near East Neighborhood Plan would have design standards in place for infill construction. Ms. Mattox stated her home is located on a lot that is 50’ wide and in the
early 1900’s there were marvelous house plans. She suggested looking at the existing width of the lots when developing design standards for the Near East Neighborhood Plan.
Plan Commission Minutes -2 February 21, 2006 Motion by Thorkildsen for approval of a land division and subdivision regulation variance for the property located at 2323 Jefferson Street
subject to the following condition: 1) Garage is to be moved to a code compliant location prior to final approval of the CSM. Seconded by Weinsheim. Motion carried 9-0. II: CONDITIONAL
USE PERMIT REQUEST FOR DRIVE-THROUGH COFFEE SHOP AT 1571 WEST SOUTH PARK AVENUE -Penny Braatz & Paula Ramuta, petitioners; Nina’s Investment II, LLC, owner Mr. Buck introduced the item
and noted an additional condition was recommended upon approval for parking near the building to be angled. Chairman Dell’Antonia questioned exactly where the coffee shop would be located.
Mr. Buck pointed out the location of the coffee shop in the southern corner of the lot on the map displayed in the PowerPoint presentation. Mr. Thorkildsen asked for clarification of
the additional condition related to parking. Mr. Buck explained that because of the one way traffic the parking spaces would need to be angled to the north to present an obvious one
way traffic pattern. Mr. Weinsheim questioned where the drive-up window would be located. Mr. Buck stated the window is proposed for the north side of the building. Ms. Mattox questioned
who would be using the parking lot and how many stalls were available. Mr. Buck stated the existing parking lot would be used by the commercial structure. Discussion followed regarding
the size of the parking lot. Paula Ramuta, 337 Settlement Road, Hartford, WI, and Penny Braatz, 2348 Comet Street, Oshkosh, introduced themselves to the Plan Commission. Paula Ramuta
stated they are proposing to bring an original business to Oshkosh. She stated this is not a franchise or chain, and they feel this is an ideal location for a business of this nature.
Mrs. Scherer questioned if they were in agreement with the conditions as listed in the Staff Report and the additional condition Mr. Buck is recommending. Ms. Ramuta stated they are
willing to comply with the conditions listed in the Staff Report and the additional condition to help alleviate any traffic circulation problems that might arise. Mr. Weinsheim questioned
if the petitioners had studied the potential for the coffee shop to be located at the north end of the parking lot. Ms. Ramuta stated they worked with staff to determine the best location
for the coffee shop on the site.
Plan Commission Minutes -3-February 21, 2006 Chairman Dell’Antonia questioned if this business existed anywhere else. Ms. Ramuta stated this is an original design and this is the first
community they have brought their proposal to. Chairman Dell’Antonia complimented them on their business foresight. Mr. Weinsheim stated the traffic pattern looks like it will conflict
with the laundromat traffic. Mr. Buck referred to the map in the PowerPoint presentation and reviewed various traffic patterns, the location of the coffee shop, along with the location
for the drive-up window. Ms. Mattox questioned the exit from the coffee shop. Mr. Buck again referred to the map and pointed out the access points and also mentioned the cross access
agreement with the gas station to the north. Motion by Borsuk for approval of a conditional use permit to allow the development and operation of a drive-through coffee shop on property
located at 1571 South Park Avenue subject to the following conditions: 1) Business/site is developed, maintained and operated per the submitted site plan. 2) Architectural design of
the structure is complimentary and consistent with the primary structure on-site and final design is reviewed and approved by the Department of Community Development. 3) Drive-through
service is limited to the northern side of the coffee shop/kiosk. 4) Pavement is removed within the setback on the southwestern corner of the property and along the southern property
line and replaced with landscaped open space. 5) Internal traffic circulation arrows are painted on the parking lot surface. 6) Easternmost row of parking adjacent to the primary structure
on the lot be angled. Seconded by Thorkildsen. Motion carried 9-0. There being no further business, the meeting adjourned at approximately 4:29 p.m. (Thorkildsen/Weinsheim). Unanimous.
