HomeMy WebLinkAboutMinutes Plan Commission Minutes 1 April 17, 2007 PLAN COMMISSION MINUTES APRIL 17, 2007 PRESENT: Ed Bowen, Thomas Fojtik, Paul Lowry, Kathleen Propp, Cathy Scherer, Jeff Thorkildsen, Jon Dell’Antonia EXCUSED: David Borsuk, Eduardo Corpus, John Weinsheim STAFF: Darryn Burich, Director of Planning Services; David Buck, Principal Planner; Deborah Foland, Recording Secretary Chairman Dell’Antonia called the meeting to order at 4:02 pm. Roll call was taken and a quorum declared present. The minutes of February 20, 2007 and March 20, 2007 were approved as presented. I. TWO-LOT EXTRATERRITORIAL LAND DIVISION/CERTIFIED SURVEY MAP AT 4730 CTH “S” IN THE TOWN OF OSHKOSH; DETERMINATION OF CONSISTENCY WITH CITY OF OSHKOSH COMPREHENSIVE PLAN Extraterritorial land division/certified survey map of an approximate 9.7 acre parcel of land containing a single family residence and outbuildings at 4730 CTH “S” in the Town of Oshkosh as follows: 􀁸 Lot 1 is proposed at 7.122 acres 􀁸 Lot 2 is proposed at 2.528 acres Determination of consistency with the Comprehensive Plan. Lands to be divided in the City’s extraterritorial land division jurisdiction are required to be consistent with the City’s adopted land use plan and a finding by the Plan Commission that the proposed land division is consistent with that Plan. Mr. Bowen asked if there will be access off of County Trunk Highway S to these lots and would it remain if this area would become a subdivision in the future. Mr. Burich responded that there would be access off of County Trunk Highway S and this access could remain even if a subdivision was later developed in the area. Mr. Fojtik inquired if the lots would have two access drives. Mr. Burich replied that they would not. Mr. Lowry arrived at 4:12 pm. Ms. Scherer questioned if this area would be developed into a subdivision in the future, would the City be able to provide public services to the homes. Mr. Burich responded that this land division, if approved, would probably not adversely affect the ability to provide services to this this area. Mr. Dell’Antonia stated that the Commission has denied requests of this type in the past as it could hinder future development in the area. Plan Commission Minutes 2 April 17, 2007 Mr. Burich replied that the residential land use recommendation and developed land use pattern in the area of this land division is not inconsistent with the City’s Comprehensive Plans for this area and the land divisions that the City has rejected were typically in areas designated as rural preservation. Kelly King, Post Office Box 264, Butte des Morts, Wisconsin, stated that he would like to divide the lots to develop for himself and another family member. Ms. Scherer inquired if the homes to be developed on these lots would be located as marked on the certified survey map. Mr. Burich responded that the homes would not necessarily be located where they are marked on the map. The owner would have to meet Winnebago County zoning ordinance requirements when a building permit was obtained, but that the County cannot enforce building envelope requirements. Mr. Dell’Antonia voiced his concern regarding approving this type of land division as he felt that it would be setting a precedence. Mr. Burich replied that he felt the land division met the land division criteria of the Subdivision Regulations as well as being consistent with the City’s recommended land use map (residential) for the area and given that staff was recommending approval of the land division. Motion by Thorkildsen to move approval of the land division as requested. Seconded by Propp. Motion carried 6-1. There being no further business, the meeting adjourned at approximately 4:25 pm.
