HomeMy WebLinkAboutMinutes BOARD OF APPEALS MINUTES FEBRUARY 12, 2003 PRESENT: Thomas Feavel, Joel Kluessendorf, Don Krueger, John Schorse EXCUSED: Carl Ameringer, Cheryl Hentz, Ed Wilusz STAFF: Matt Tucker, Associate Planner; Mary Lou Degner, Recording Secretary The meeting was called to order by Chairman Krueger. Roll call was taken and a quorum declared present. The minutes of January 8, 2003 were approved as mailed. (Feavel/Kluessendorf) I: 175 W. FERNAU AVENUE Donald Johnson, applicant, and B & P Order of Elks, Inc., owner, are requesting a variance to construct an addition on the existing building that will have a 37’ side yard setback, whereas Section 30-30(B)(2) of the City of Oshkosh Zoning Ordinance requires a 50’ side yard setback. Matt Tucker introduced the item. It was noted that there was no representation from the applicant or property owner at this hearing. Mr. Kluessendorf asked how the amount of space necessary was determined and inquired what the hardship would be. Mr. Tucker responded that the applicant relayed to to staff that an open-air pavilion is desired to meet the needs for coverage and protection during inclement weather and the storage space required would be equal in size to the present indoor storage area. Mr. Tucker said the applicant indicated to staff that the size is equal in length to what can be found in other recreational areas and parks. Mr. Tucker stated the hardship is established by the residential use of the adjacent property. Chairman Krueger stated that the setbacks would be met when the adjacent residential building is vacated, noting that the property is presently for sale and zoned industrial. Motion by Feavel to approve a variance request to construct an addition on the existing building. Seconded by Schorse. Motion approved 4-0. Unanimous. Finding of the fact: It was concluded there would be no adverse impact on the neighboring properties. OTHER BUSINESS: Mr. Tucker noted that the Plan Commission has reviewed an amendment in regard to the size of utility storage sheds, which has received received a positive recommendation to the Common Council. He stated the current code permits utility storage sheds to be up to 100 sq. ft. in size and the amendment will permit utility sheds up to 150 sq. ft. in size. Mr. Tucker indicated that this change would adequately address the needs of property owners, which would reduce the number of future variance requests.
