BOARD OF APPEALS MINUTES JUNE 11, 2003 PRESENT: Thomas Feavel, Cheryl Hentz, Don Krueger, Ed Wilusz EXCUSED: Carl Ameringer, John Schorse STAFF: Matt Tucker, Associate Planner; Mary
Lou Degner, Recording Secretary The meeting was called to order by Chairman Krueger. Roll call was taken and a quorum declared present. The minutes of May 14, 2003 were approved as mailed.
(Hentz /Feavel) Chairman Krueger moved Item II to be the first item on the agenda. II: 3250 W. 9TH AVENUE David L. Sennholz, applicant for New Life Community Church, is requesting a
variance to construct a ground sign for an institutional use that will incorporate two bulletin boards of 25 sq. ft. each, whereas Section 30-37(F)(1)(c) of the City of Oshkosh Zoning
Ordinance requires institutions have a single bulletin board, not to exceed 24 sq. ft. in size. Matt Tucker introduced the item with photos. David Sennholz, of the Board of Deacons for
New Life Community Church, presented pictures. Mr. Wilusz asked if perpendicular signs are code compliant and questioned the reason that such a sign would not serve the required needs.
Mr. Tucker said perpendicular signs are code compliant. Mr. Sennholz stated that a safety hazard would be presented due to the posted speed limit of 30 miles per hour in the area, which
would make it difficult to read the sign. Allyn Dannhoff, Director of Inspection Services, stated that the property to the east has a fair amount of over growth on it and the property
to the west has a tree line, which would interfere with perpendicular signage. Motion by Feavel to approve a variance to construct a ground sign for an institutional use that will incorporate
two bulletin boards of 25 sq. ft. each. Seconded by Hentz. Motion approved 4-0. Unanimous. Finding of the fact: It was concluded that it was the least variance necessary, it addresses
the safety issue involved, and there would be no adverse impact on surrounding properties.
Board of Appeals Minutes -2 -June 11, 2003 I: 1283 BAYSHORE DRIVE Terry Laib, contractor, is requesting a variance to the City’s Building Code. Per Oshkosh Building Code Section 7-33,
persons may file an appeal to the Board of Zoning Appeals as provided in the City Zoning Ordinance, Section 30-6(B)(2)(a) if an equally good or better form of construction is proposed.
All appeals shall be accompanied by supporting data. The application is being made to have a set of spiral stairs without a code compliant landing. John Zarate, Building Inspector, introduced
the item. He explained that the irregular landing on the proposed set of stairs is one of five code compliant exits to the first floor, outside balcony, or ground level exit. Inspector
Zarate said the owners have constructed an addition on the house and further explained that the spiral staircase serves as a landing for both the old portion of the house and the new
portion of the house, he also noted that the second floor of the old area is at a different level than the second floor of the new area. Chairman Krueger stated that the required number
of exits are currently existing, not including the proposed spiral staircase. Ms. Hentz questioned the condition that was stated in the staff report. Inspector Zarate clarified that
the condition should state that the existing four code compliant exits should not be eliminated. Motion by Hentz to approve a building code variance request to allow for the creation
of a spiral staircase without a code compliant landing with the following condition: 1) The existing four code compliant exits are not eliminated. Seconded by Feavel. Approved 4-0. Unanimous.
Finding of the fact: It was concluded that there are four code compliant exits presently existing, it does not present a safety issue, and the condition ensures that the code compliant
exits will remain intact. III: 1010 W. 20TH AVENUE Thomas J. Sitter, applicant, and Thomas Rusch, owner, are requesting a variance to construct a ground sign that will have a 16’ front
yard setback, whereas Section 30-35(B)(1)(d) of the City of Oshkosh Zoning Ordinance requires a 25’ front yard setback. Matt Tucker introduced the item and presented two letters from
the applicant requesting that the item be laid over to the meeting of July 9, 2003. Chairman Krueger recommended that the item be laid over as requested by the applicant. Motion by Hentz
to lay the item over to the meeting of July 9, 2003. Seconded by Wilusz. Motion approved 4-0. Unanimous.
Board of Appeals Minutes -3 -June 11, 2003 IV: LOTS 122, 123, 124 OF THE CITY OF OSHKOSH REPLAT NUMBER 2/SCOTT AVENUE Jeremy M. Phillips of Short, Elliot, Hendrickson, Inc., applicant
for Thomas Sonnleitner, Vice Chancellor of UWO, are requesting a variance to construct an off-street parking area that will have varying substandard setbacks, whereas Section 30-35(B)(1)(c)
of the City of Oshkosh Zoning Ordinance requires a 20’7” setback to the west, a 19’3” setback to the east, a 25’ setback to the north, and a 25’ front yard setback. Matt Tucker introduced
the item and presented a map. He noted that there are conditions on the approval of the conditional use permit relating to aesthetics, off-street lighting, and landscaping. There was
discussion on the number of parking spots that would be created (47 or 48), and the number of parking spots (about 15) which would be lost if the setbacks were met. It was noted that
the site would be very challenging with these losses. Joe Blohm, Director of Parking Services at the University, identified himself. Mr. Feavel said he found the proposal to be acceptable.
Chairman Krueger said, in his opinion, it would add much needed parking availability and noted that the area would be well screened and lighting would not be a problem. He added that
the only negative aspect, which was mentioned at the Plan Commission by a member, was the fact that the parking lot would be in a residential area. Mr. Tucker noted that this is the
last surface parking area that is depicted on the University’s master plan for this area. Motion by Hentz to approve a variance request to construct an off-street parking area that will
have substandard setbacks. Seconded by Feavel. Motion approved 4-0. Unanimous. Finding of the fact: It was concluded that it was the least possible variance necessary, there would be
no adverse impact on surrounding properties, and it would aid in the problem parking situations in the area. OTHER BUSINESS: There being no further business, the meeting adjourned at
