HomeMy WebLinkAboutMinutes BOARD OF APPEALS MINUTES JUNE 25, 2003 PRESENT: Carl Ameringer, Thomas Feavel, Cheryl Hentz, Don Krueger, Larry Lang EXCUSED: John Schorse, Ed Wilusz STAFF: Matt Tucker, Associate Planner; Mary Lou Degner, Recording Secretary The meeting was called to order by Chairman Krueger. Roll call was taken and a quorum declared present. The minutes of June 11, 2003 were approved as mailed. (Feavel /Ameringer) Unanimous. I: 1212 ALGOMA BOULEVARD Wesley W. Schwartz, applicant and owner, is requesting a variance to construct an addition onto an existing detached garage that will result in the garage having 916 sq. ft. of structure area, whereas Section 30-18(B)(4)(a) of the City of Oshkosh Zoning Ordinance requires detached garage structure area to a be a maximum of 800 sq. ft. Matt Tucker introduced the item. Wesley Schwartz, 1212 Algoma Boulevard, stated that he did not have sufficient storage space available. He said the addition would compliment the architecture of the house. Chairman Krueger inquired if the addition would be brick. Mr. Schwartz answered that the siding would be matched to the house. Ms. Hentz asked if the applicant was agreeable to the conditions recommended by staff. Mr. Schwartz said he was agreeable to the conditions. Motion by Hentz to approve a variance to construct an addition onto an existing detached garage that will result in the garage having 916 sq. ft. of structure area with the following conditions: 1) No additional detached storage structures may be permitted on site. 2) The addition be constructed as proposed in the applicant’s submittal. Seconded by Feavel. Motion approved 5-0. Unanimous. Finding of the fact: It was concluded that it was the least variance necessary, there would be no adverse impact on neighboring properties, it was a good compromise, and there were no objections from adjacent property owners. Board of Appeals Minutes -2 -June 25, 2003 II: 3116 ALGOMA BOULEVARD Kelly King, applicant and owner, requests a variance to construct an 8’ tall solid fence with a 0’ rear yard setback, whereas Section 30-35(E)(4) of the City of Oshkosh Zoning Ordinance requires an 8’ tall fence to have a 25’ rear yard setback. Matt Tucker introduced the item and presented pictures. He added that he spoke to an adjacent property owner, Mike Sammons, who had no objection to the variance request. Kelly King, 3116 Algoma Boulevard, stated that the business is a medical exercise facility and when the weather permitted they utilize the outdoors. Mr. Lang presented questions about the location of the subject property and the location of the fence. Mr. Tucker showed the original submittal from the applicant, depicting the area where the fence would be installed. Motion by Hentz to approve a variance to construct an 8’ tall solid fence with a 0’ rear yard setback. Seconded by Lang. Motion approved 5-0. Unanimous. Finding of the fact: It was concluded that the characteristics of the property were unique creating a hardship, which was not self-created, there would be little impact on surrounding properties, and it was the least variance necessary. OTHER BUSINESS: Mr. Tucker presented Chairman Krueger, who resigned effective June 30, 2003, with a letter and a certificate of appreciation for his time devoted to the Board of Appeals and the Plan Commission. It was noted that Chairman Krueger had served on the Board of Appeals since 1985 and had also served on the Plan Commission since 1998. Mr. Tucker read a list of Board members and members of staff who had served with Chairman Krueger.
