HomeMy WebLinkAboutMinutes BOARD OF APPEALS MINUTES FEBRUARY 23, 2005 PRESENT: Dan Carpenter, Robert Cornell, Larry Lang, Cheryl Hentz EXCUSED: Meredith Scheuermann, Ed Wilusz STAFF: Matt Tucker, Associate Planner; Patty LaCombe, Clerical Assistant; Darlene Brandt, Recording Secretary The meeting was called to order by Chairperson Hentz. Roll call was taken and a quorum declared present. A motion was made and seconded to approve the minutes of January 12, 2005. From her notes, Ms. Hentz seemed to recall that it was stated the sign at 910 N. Sawyer St. would be lit until 10:00/10:30 pm. She asked that staff review the tape in this regard. Motion approved by voice vote. I: 2822 OREGON STREET – LuVern Kienast, owner Mr. Tucker noted the applicant is requesting approval to permit an off-street parking area with a 0 ft. front yard setback and a 0 ft. rear yard setback to serve as a display area for the automobile sales use currently occupying the main building. Mt. Tucker distributed photos showing the site and a map illustrating the Oregon St./County Rd. I right-of-way (on file at the Planning Services Division office). Mr. Tucker further noted that based on inconsistencies between the petitioners submittal and the submitted site plan, staff is recommending denial of the request in its present form. Mr. LuVern Kienast, 765 N. Washburn St., indicated he has contacted an architect who is working on the parking lot layout, but to date, it hasn’t been completed yet. Ms. Hentz inquired of Mr. Kienast if he wanted this item laid over for 2 weeks? Mr. Kienast replied yes. Motion by Lang to lay over this item until the March 9th meeting. Seconded by Cornell. Motion carried by voice vote. (Mr. Kienast left at this time.) Mr. Cornell questioned the right-of-way width and curb cuts in this area? Referring to the Oregon St./County Rd. I right-of-way map, Mr. Tucker noted the right-of-way width provides an additional 9+ ft. from the existing curb line. It appears that measurements on Mr. Kienast’s site plan were taken from the curb versus the right-of-way line. Mr. Lang requested that a revised, completed site plan be submitted prior to the next meeting and included in the agenda packet. Mr. Tucker noted he would contact the applicant in this regard.
