BOARD OF APPEALS MINUTES JULY 26, 2006 PRESENT: Larry Lang, Dennis Penney, Moss Ruedinger, Edward Wilusz, Chairperson Cheryl Hentz EXCUSED: Dan Carpenter, Robert Cornell STAFF: David
Buck, Associate Planner; Mary Lou Degner, Recording Secretary The meeting was called to order by Chairperson Hentz. Roll call was taken and a quorum declared present. The minutes of
July 12, 2006 were approved as mailed. Lang/Ruedinger I: 1724 ALGOMA BOULEVARD Thomas Karrels-applicant, City of Oshkosh-owner, request a variance to permit an off-street parking area
and drive lane that will have a 9’4” rear transitional yard setback. Section 30-25 (B)(1)(c) of the Oshkosh Municipal Code: Additional Standards and Exceptions requires lots adjacent
to a residential use/district to provide a 19’3” rear transitional yard setback. David Buck introduced the item and shared photos of the subject property. Tom Karrels, 2725 Shorewood
Drive, stated he took the opportunity to speak with three of the adjacent property owners, which included the owner of the car lot across Murdock Avenue, the operator/owner of Pizza
King and the gentleman who owns the property to the south. Two main concerns noted were the trees obstructing the signage for Pizza King and the desire that a fence be installed in place
of the proposed shrubbery on the south lot line. Mr. Karrels said he would remove the crabapple tree and also stated that he did not have a problem with the installation of a 5’ fence.
It was noted that the proposed building would require 8 parking stalls, which is a number based upon the square footage of the building. Mr. Buck stated that Staff’s recommendation was
for approval of the variance with the condition that screening is a minimum of 5’ high and 90% solid installed along the south lot line. The goal of the 90% solid screening was to block
the headlights, emissions, garbage and noise from intruding upon the adjacent residential property. Jeff Wilderman, 1710 Algoma Boulevard, stated his desire for the installation of a
fence. During Board Discussion Mr. Lang stated that, in his opinion, it is difficult to provide 90% solid screening through the use of vegetation in the state of Wisconsin. Mr. Lang
voiced his support for a fence versus a solid green barrier. Mr. Penney questioned where the dumpster would be located. Mr. Buck responded that the garbage would be located inside the
building. Chairperson Hentz commended Mr. Karrel’s diligence in working with the neighbors. There was discussion on the possibility of adding conditions regarding the removal of the
tree and the installation of the fence.

condition: 1. Screening that is a minimum of 5’ high and 90% solid is installed along the parking lot perimeter to the south. Seconded by Mr. Penney. Motion approved 5-0. Finding of
Facts: It was a unique and difficult property to build on. It was the least variance necessary to correct the problem. The applicant did a good job of trying to mitigate any adverse
impact with the neighbors. Granting of the variance will not result in harm to the public interest. The applicant made a creative use of the property. OTHER BUSINESS Mr. Buck stated
