HomeMy WebLinkAbout10-169MAY 25, 2010 10 -169 RESOLUTION (CARRIED 6 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: AMEND INITIAL RESOLUTION 10 -138 FOR SPECIAL ASSESSMENTS / PAVING, SIDEWALK, DRIVEWAY & UTILITIES / THIRD LOCAL STREET CONCRETE PAVING PROGRAM (CENTRAL STREET, MERRILL STREET, SARATOGA AVENUE, PROSPECT AVENUE, SCOTT AVENUE, SHORELANE STREET, FRANKFORT STREET & HARNEY AVENUE) INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, on April 27, 2010, the Common Council of the City of Oshkosh approved an initial resolution pursuant to Section 66.0703 and 66.0705 of the Wisconsin Statutes; and WHEREAS, it is necessary to revise the initial resolution to include grading and graveling and to add Scott Avenue to the streets to receive assessments. NOW, THEREFORE, BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows: 1. The Common Council hereby declares its intention to exercise its power under Section 66.0703 and 66.0705 of the Wisconsin Statutes to levy special assessments upon property within the following described areas for benefits conferred upon such property by improving the following: Grading and Graveling, Concrete Paving, Asphalt Paving, Concrete Curb and Gutter, Sanitary Sewer Laterals (New & Relay), Sanitary Sewer Main, Water Main, Water Laterals (New), Storm Sewer Laterals, Sidewalk Repair, New Sidewalk, and Concrete Driveway Approach: FRANKFORT STREET — 250 feet south of Bay Shore Drive to Ceape Avenue BAYSHORE DRIVE — 40 feet east of Frankfort Street to 40 feet west of Frankfort Street CEAPE AVENUE — 25 feet east of Frankfort Street to 25 feet west of Frankfort Street HARNEY AVENUE — Bowen Street to Eveline Street BOWEN STREET — 25 feet south of Harney Avenue to 25 feet north of Harney Avenue MAY 25, 2010 10 -169 RESOLUTION CONT'D EVELINE STREET — 25 feet south of Harney Avenue to 25 feet north of Harney Avenue SHORELANE STREET — Waugoo Avenue to Babbitz Avenue WAUGOO AVENUE — 25 feet east of Shorelane Street to 25 feet west of Shorelane Street PROSPECT AVENUE — Jackson Street to N. Main Street FREDERICK STREET — 25 feet south of Prospect Avenue to Prospect Avenue CENTRAL STREET — 25 feet south of Prospect Avenue to Prospect Avenue N. MAIN STREET — 25 feet south of Prospect Avenue to 25 feet north of Prospect Avenue SARATOGA AVENUE — Jackson Street to Merrill Street MERRILL STREET — Prospect Avenue to W. New York Avenue W. NEW YORK AVENUE — 25 feet east of Merrill Street to 25 feet west of Merrill Street CENTRAL STREET — Prospect Avenue to W. New York Avenue W. NEW YORK AVENUE — 25 feet east of Central Street to 25 feet west of Central Street SCOTT AVENUE — Main Street to Randall Place 2. The total amount assessed against such district shall not exceed the total cost of the improvements and the amount assessed against any parcel shall not be greater than the benefits accrued thereto from said improvements. 3. The assessments against any parcel may be paid according to the provisions of Section 25 -83 through 25 -89 of the Oshkosh Municipal Code. 4. The Board of Public Works is directed to prepare a report consisting of: (a) Final plans and specifications for said improvements. (b) An estimate of the entire cost of the proposed work or improvements. (c) An estimate as to each parcel of property within the assessment district of: (1) The assessment of benefits to be levied for each improvement. (2) The damages to be awarded for property taken or damages by each improvement. (3) The net amount of benefits over damages or the net amount of damages over benefits for each improvement. MAY 25, 2010 10 -169 RESOLUTION CONT'D Upon completion of such report, the Board of Public Works is directed to file a copy thereof in the City Clerk's Office for public inspection. 5. Upon receiving the report of the Board of Public Works, the City Clerk is directed to give notice of a public hearing on such reports as specified in Section 66.0703(7)(a) of the Wisconsin Statutes. The hearing shall be held by the Board of Public Works at the Council Chambers in the City Hall at a time set by the Clerk in accordance with the Wisconsin Statutes. 6. The installation of said street improvements shall be accomplished according to the provisions of Section 25 -3 through 25 -11 of the Oshkosh Municipal Code. Gohde, Assistant Director of Public Works DATE: May 19, 2010 RE: Amend Initial Resolution 10 -138 for Special Assessments for Paving, Sidewalk, Driveway and Utilities/ Third Local Street Concrete Paving Program. BACKGROUND This resolution is to amend the streets and the edit types of improvements assessments can be levied for on the third local street concrete paving project. Scott Avenue from Main Street to Division Street is added to the list of streets. The second change is editing the improvements that can be assessed. The assessable work will include concrete pavement, asphalt pavement, concrete curb and gutter, grading and graveling, sidewalk repair, new sidewalk, concrete driveway approaches, sanitary main, sanitary laterals (new and relay), storm sewer laterals, water main and water laterals (new). ANALYSIS The resolution allows City Staff to proceed with preparing assessments for the abutting properties. A public hearing and final resolution need to be approved by the Council prior the assessments being levied on the properties. FISCAL IMPACT Assessments allow the City to recover a portion of the costs associated with projects from benefiting properties. Funding for the projects is included in the 2010 Capital Improvement Program in the Street, Storm Sewer, Sanitary Sewer and Water Main sections.
