May 11, 2010 10 -164 RESOLUTION (CARRIED 7 -0 LOST LAIDOVER WITHDRAWN ) PURPOSE: (1) APPROVE CHANGE ORDERS NO.1 — NO. 7 FOR GRAND OPERA HOUSE REPAIRS /FIRE PROTECTION SYSTEM PROJECT /BOLDT COMPANY ($ +56,589); (2) APPROVE AUTHORIZATION OF UP TO $35 TO REPLACE CARPET /REPAIR SUBFLOORING ON THE BALCONY; AND (3) APPROVE REDUCTION OF PROJECT BUDGET FROM $2,064,793.22 TO $1 INITIATED BY: CITY ADMINISTRATION WHEREAS, on August 25, 2009, the Common Council approved a contract with Boldt Construction Company in the amount of $1,379,000 to reconstruct the roof and supporting structures of the Grand Opera House; and WHEREAS, the Common Council authorized a budget of $2,064,793.22 for said project, including a 15% budget contingency in the amount of $232,800; and WHEREAS, over the course of the project, issues related to code compliance were identified that required additional work not anticipated in the original contract with Boldt; and WHEREAS, after other repairs were made in accordance with the project budget, the project remained approximately $181,000 under budget; and WHEREAS, the condition of the carpeting in the balcony area has deteriorated and needs replacement at this time to avoid duplicating the cost to remove theater seats in the future; and WHEREAS, adequate funds remain in the contingency account to cover the estimated $35,000 needed to replace the carpet and associated subfloor. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that: (1) Change orders 1 through 7 for the Boldt Company in the amount of $56,589 are hereby approved; (2) Staff is authorized to seek bids to replace carpeting and associated subfloor in the balcony area of the Grand Opera House; and (3) The revised project budget is hereby reduced from $2,064,793.22 to $1,918,253.59 to reflect projected costs for the project. BACKGROUND On August 25, 2009 the Common Council approved repairs to the Grand Opera House with a total projected budget of $2,064,793.22. This budget included a projected contingency of $232,800 to cover unanticipated change orders and associated project management costs that would not be immediately identified until work commenced. ANALYSIS Over the course of the repairs we identified items that needed to be addressed within this project that were not apparent when in the original bid documents were established. Seven separate change orders were necessary as a result of additional work needed or not needed to complete the project. The change orders have altered the Boldt Company contract by $56,589 per attached details. Also attached is a budget summary that encompasses the projected cost areas of the entire project including the truss repairs /fire protection system bid, wood soffit repairs, architectural /engineering services, decorative elements, equipment removal /reinstallation and contingency. We do not anticipate any additional significant change orders at this time. A summary of each of the project areas and their cost variances are as follows: Truss Repair /Fire Protection System Bid ( +$40,373) Boldt's contract amount required change orders #147 (attached). The majority of the items within the change orders were related to code compliance issues discovered over the course of construction including installing fire separation in the elevator equipment room, installing additional attic and balcony outlets /conduits, lathe plaster repairs in the basement ceiling and additional electrical wiring/fixtures for egress exiting. Change orders were also required for additional structural improvements required during the repairs /renovations including additional joist framing between trusses 2 and 4, basement lintel /wall reinforcements, balcony plaster repairs /refastening, roof valley drainage alterations and repairing the concrete steps on the south /east exterior. Wood Soffit Repairs (- $32,792) This area realized reduced costs from the investment of architectural /engineering services leading to a solution in which it was determined the most cost effective method to address the wood soffit repairs was to have Laib Restoration coordinate the decorative soffit trim removal /reinstallation /painting ($10,992) and have Boldt refasten, refinish and paint the soffit beams ($16,216). Architectural /Engineering Services ( +$35,896.12) While the project presented several unforeseen challenges as it evolved, the investment in professional expertise from a variety of fields including architectural, engineering, fire sprinkler /life systems, electrical and HVAC reduced or minimized change orders. These services also enabled the project to save expenses in the wood soffit repairs and contingency areas. Historic Decorative Elements ( +$3,953) The Decorative Elements Working Group (with representatives from the City, the Grand, the Grand Opera House Advisory Board and the Landmarks Commission) selected the nationally respected Conrad Schmitt Studios from Milwaukee to create historic reproductions of the four art elements within the hall. The reproductions were produced from descriptions of the original art within the Grand from newspaper accounts and historic photos. Equipment Removal /Reinstallation (415,000) Temporary storage costs and labor costs to remove /reinstall theatre chairs, stage equipment, lighting and other materials displaced as part of this project are projected to come under budget. Contingency (- $178,969.75) Given the uncertainties of repairs /renovations to this 100+ year -old structure the project was provided a 15% contingency budget. Strong project management allowed for minimal use of the contingency budget. If approved by the Council, the contingency used will include the proposed amount of $35,000 to replace the balcony carpet. The replacement is recommended at this time because of its deteriorated condition and to avoid costs to remove /reinstall theatre chairs in the future. FISCAL IMPACT With the above referenced changes, the anticipated savings will be realized entirely by the City, and the project will remain under budget by approximately $146,539.63. The City can reduce its 2010 borrowing by the same amount. RECOMMENDATIONS I recommend a resolution to accomplish the following: 1) Approve change orders #147 for Grand Opera House Repairs /Fire Protection System Project/Boldt Company ($ +56,589); 2) Approve authorization of up to $35,000 to replace carpet/repair subflooring on the balcony; and 3) Approve reduction of project budget from $2,064,793.22 to $1,918,253.50.
