PURPOSE: APPROVE AND SUBMIT WATER PROGRAM ANNUAL REPORT
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City of Oshkosh that the Storm
Water Program Annual Report, having been reviewed, is approved, and the proper City
officials are authorized and directed to submit the Report to the Department of Natural
Resources.

Annual Report
The City of Oshkosh received coverage under the Wisconsin Department of Natural Resources Municipal
Separate Storm Sewer System (MS4) General Permit on January 2, 2007. This permit requires the City
to comply with the following six minimum control measures (as mandated by the Federal Clean Water
Act, and Environmental Protection Agency):
1. Public Information and Education Plan
2. Public Involvement and Participation Program
3. Illicit Discharge Detection and Elimination Program (including new or revised ordinances)
4. Construction Site Pollutant Control Program (including new or revised ordinances)
5. Post - Construction Storm Water Management Program (including new or revised ordinances)
6. Pollution Prevention Program (Prevent pollution from the daily operations of the City)
The Storm Water Utility Committee reviewed the Annual Report and recommended approval, with
revisions as discussed during the meeting, at their May 6, 2010 meeting.
ANALYSIS
The annual report contains information on the activities performed by the City of Oshkosh in compliance
with the MS4 Permit requirements. This report includes summary outputs from the City's MS4 Permit
Tracking Software (ASIST) and a completed DNR form. City staff has more details available for the DNR,
should they be requested.
FISCAL IMPACT
There is no anticipated fiscal impact from the approval of this resolution.
RECOMMENDATION
Staff recommends approval of the resolution.

Mr. Rabe visited the site with Mr. Nahn, Mr. Jim Erdman (Town of Oshkosh
Chairman), and Mr. Jim Savinski (WDNR). One the day of the visit, there was no
discharge evident. After much review and discussion, Mr. Savinski asked for a list
of properties draining to this outfall, so that he could review for any potential
dischargers.
Mr. Rabe provided that information to Mr. Savinski.
As there was no discharge present on the day of the field visit, there was nothing
further that could be done, and the call was considered closed after forwarding the
parcel information to Mr. Savinski.
This outfall is a major outfall, so it will be screened again as a part of the City of
Oshkosh Initial Field Screening.

activities undertaken in calendar year 2009. In addition, this form serves as the owner or operator's reapplication for permit
coverage as required under s. NR 216.09, Wis. Adm. Code.

The Annual Report has been posted on the City's Storm Water Utility Webpage, and has been reviewed and approved at public
meetings of the Storm Water Utilility Committee and the Common Council. The general public, in addition to members of
interest groups and the elected official have the opportunity to comment at any of these meetings, as well as arrange a meeting
with the Department of Public Works staff to discuss comments.

Elected officials are kept apprised of the MS4 Permit and it's requirements through Common Council workshops. Staff are kept

The Storm Water Utility Rate Analysis performed in 2008 recommended a rate increase for 2009. That rate increase was
implemented in April, 2009. The Rate Study was not revisited in 2009, but will be in 2010.

Fox River: Listed for PAHs. There are no current discharges that would contibute to this pollutant.
Lake Butte des Mortes: Listed for Mercury, PCBs, Sediment, and Phosphorus. Mercury is atmospheric deposition, which the
City cannot implement a means to reduce. PCBs are no longer used in industrial processes along the river, and thus there are
no longer discharges that would contribute to this polluntant. Sediment is being addressed on a City Wide basis, as required by
the MS4 Permit. Phosphorus reductions will be associated with the reduction in sediment on a City Wide basis. Phosphorus is
being addressed under the I &E plan to get residents to reduce the use of phosphorus. Until such time as a TMDL is prepared
for the Upper Fox River Basin, it would be inappropriate to attempt to formulate a plan to reduce phosphorus.
Lake Winnebago: Listed for Mercury, Sediment, and Phosphorus. Mercury is atmospheric deposition, which the city cannot
implement a means to reduce. Sediment is being addressed on a City Wide basis, as required by the MS4 Permit. Phosphorus
reductions will be associated with the reduction in sediment on a City Wide basis. Phosphorus is being addressed under the
I &E Plan to get residents to reduce the use of phosphorus. Until such time as a TMDL is prepared for the Upper Fox River
Basin, it would be inappropriate to attempt to formulate a plan to reduce phosphorus.

Section 2.4.1.1.3 of the MS4 general permit requires a permittee that does not already have authority from the Wisconsin
Department of Commerce (Commerce) to regulate erosion control at public buildings and places of employment to request such
authority from Commerce within 18 months after the start date of permit coverage. However, as of January 1, 2010,
responsibility for erosion control administration and enforcement for commercial building sites was transferred from Commerce
to the Department of Natural Resources. This transfer took place due to 2009 Wisconsin Act 28, the 2009 state budget
legislation, which moved s. 101. 1205, Wis. Stats., commercial building construction site soil erosion and sediment control
statutory language, to s. 281.33, Wis. Stats. As of January 1, 2010, the State's requirements for erosion control at commercial
building construction sites will be administered by the Department of Natural Resources. Accordingly, a permitted municipality

that was delegated to serve as an agent for Commerce will continue to serve as an agent for the Department of Natural
Resources in accordance with the original agreement with Commerce unless this delegation is revoked by the Department of
