HomeMy WebLinkAbout10-143APRIL 27, 2010 10 -143 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: DISALLOWANCE OF CLAIM FOR EXCESSIVE ASSESSMENTS BY A) DOWLING INVESTMENTS ATLAS, LLC / 2830 ATLAS AVENUE B) DJ OSHKOSH WWI, LLC / 1601 SOUTH WASHBURN STREET C) DANIEL E DOWLING / 3596 STEARNS DRIVE D) DANIEL E DOWLING / 3630 STEARNS DRIVE INITIATED BY: LEGAL DEPARTMENT WHEREAS, pursuant to §74.37 Wis. Stats., Dowling Investments Atlas, LLC; DJ Oshkosh WWI, LLC, Daniel E. Dowling; and, Daniel E. Dowling filed claims for excessive assessment on their real estate holdings at 2830 Atlas Avenue, 1601 South Washburn Street, 3596 Stearns Drive and 3630 Stearns Drive, Oshkosh, respectively; and WHEREAS, upon further review of the documentation filed with the Claim and within the City's files, the Assessor believes that the City's original assessment which was affirmed by the 2009 Board of Review after a public hearing is correct and recommends that this claim be denied. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the following claims against the City of Oshkosh are disallowed: Claimant: Dowling Investments Atlas, LLC Property: 2830 Atlas Avenue Claimant: DJ Oshkosh WWI, LLC. Property: 1601 South Washburn Street Claimant: Daniel E Dowling Property: 3596 Stearns Drive Claimant: Daniel E Dowling Property: 3630 Stearns Drive Date of all Claims: 1/28/2010 BE IT FURTHER RESOLVED that the City Clerk is hereby directed to notify each claimant by certified mail of the disallowance. Notification shall include this statement: The claimant may commence an action in Winnebago County Circuit Court to recover the amount of the claim not allowed. This action shall be commenced within 90 days after the claimant receives notice by registered or certified mail that the claim is disallowed, pursuant to §74.37(3)(d). 74.37(3)(d).
