PETER JUNGBACKER / QUAIL RUN FARM (LOTS 20, 23 -26) D) OSHKOSH WESTOWNE LLC / 2231 WESTOWNE AVENUE E) 20 STREET LLC / 1621 WEST 20 AVENUE F) JUNGBACKER CHILDREN'S PRESENT INTEREST TRUST / 1627 ELMWOOD AVENUE INITIATED BY: LEGAL DEPARTMENT WHEREAS, pursuant to §74.37 Wis. Stats., Lakeview Terrace, LLC; Alexander & Biship, Ltd., J. Peter Jungbacker; Oshkosh Westowne, LLC; 20 Street LLC; and, Jungbacker Children's Present Interest Trust filed claims for excessive assessment on their real estate holdings at 1191 High Avenue, Quail Run Farm (Lots 1 -4, 8 9 12 17 18 and 29), Quail Run Farm (Lots 20, 23 -26) 2231 Westowne Avenue, 1621 West 20 Avenue, and 1627 Elmwood Avenue, Oshkosh, respectively; and WHEREAS, upon further review of the documentation filed with the Claim and within the City's files, the Assessor believes that the City's original assessment which was affirmed by the 2009 Board of Review after a public hearing is correct and recommends that this claim be denied. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the following claims against the City of Oshkosh are disallowed: Claimant: Lakeview Terrace, LLC Property: 1191 High Avenue Claimant: Alexander & Bishop, Ltd. Property: Quail Run Farm (Lots 1 -4, 8, 9, 12, 17, 18, and 29) Claimant: J. Peter Jungbacker Property: Quail Run Farm (Lots 20, 23 -26) Claimant: Oshkosh Westowne LLC Property: 2231 Westowne Avenue Claimant Property: APRIL 27, 2010 Claimant Property: 20 Street LLC 1621 West 20 Avenue 10 -144 RESOLUTION CONT'D Jungbacker Children's Present Interest Trust 1627 Elmwood Avenue Date of all Claims: 1/29/2010 BE IT FURTHER RESOLVED that the City Clerk is hereby directed to notify each claimant by certified mail of the disallowance. Notification shall include this statement: The claimant may commence an action in Winnebago County Circuit Court to recover the amount of the claim not allowed. This action shall be commenced within 90 days after the claimant receives notice by registered or certified mail that the claim is disallowed, pursuant to §74.37(3)(d). 74.37(3)(d).
