HomeMy WebLinkAbout10-142APRIL 27, 2010 10 -142 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: DISALLOWANCE OF CLAIM FOR EXCESSIVE ASSESSMENT BY MILLS PROPERTIES INC., / 177 NORTH WASHBURN STREET INITIATED BY: LEGAL DEPARTMENT WHEREAS, pursuant to §74.37 Wis. Stats., Mills Properties Inc., filed a claim for excessive assessment on real estate that it owns at 177 North Washburn Street, Oshkosh; and WHEREAS, upon further review of the documentation filed with the Claim and within the City's files, the Assessor believes that the City's original assessment which was affirmed by the 2009 Board of Review after a public hearing is correct and recommends that this claim be denied. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the following claim against the City of Oshkosh is disallowed: Claimaint: Mills Properties Inc. Property: 177 N. Washburn Street Date of Claim: 1/22/2010 BE IT FURTHER RESOLVED that the City Clerk is hereby directed to notify the claimant by certified mail of the disallowance. Notification shall include this statement: The claimant may commence an action in Winnebago County Circuit Court to recover the amount of the claim not allowed. This action shall be commenced within 90 days after the claimant receives notice by registered or certified mail that the claim is disallowed, pursuant to §74.37(3)(d).
