PURPOSE: APPROVE FINAL PLAT KNOWN AS FIRST ADDITION TO
CASEY'S MEADOW SOUTH, GENERALLY LOCATED AT THE
WESTERLY TERMINI OF MOCKINGBIRD WAY

BE IT RESOLVED by the Common Council of the City of Oshkosh that the final
plat known as First Addition to Casey's Meadow South, per the attached, is hereby
approved with the following conditions:
1) Lots be renumberd starting with Lot 1 instead of starting with Lot 21.
2) Traffic calming bump -out be included along the extension of Mockingbird Way.
3) Long term stormwater maintenance agreement for drainage swales and
stormwater ponds be reviewed and approved by the Department of Public Works
prior to being recorded.

BACKGROUND
The 2.813 acre plat is zoned R -1 Single Family Residence District and contains 12 lots and right -of-
way identified as the First Addition to Casey's Meadow South. A preliminary plat was approved for
this development in 2005 and the proposed final plat is consistent with that plat. The proposed plat is
generally located north of Sawyer Creek, South of West 9 1h Avenue, east of Clairville Road, and north
of West 20 Avenue. The plat involves an extension of Mockingbird Way, with lots to be located on
the north and south side of the proposed right -of -way.
ANALYSIS
The owner is proposing to subdivide this area consistent with the previous preliminary plat approved
by the City with all lots meeting or exceeding minimum lot requirements for the R -1 district and all
lots front on a public street. The City's Comprehensive Plan identifies this area as appropriate for
residential development and approval of this plat is consistent with said plan. The Department of
Public Works has reviewed the final plat and does not have any concerns with the parcel configuration.
FISCAL IMPACT
Developer will be required to pay for all infrastructure development costs per the associated
development agreement. City services are already provided in the adjacent areas and City service
providers have not expressed any issues with providing services to this subdivision.
RECOMMENDATION
The Plan Commission approved of this request at its September 2, 2008 meeting.

Addition to Casey's Meadow South. The 2.813 acre plat is zoned R -1 Single Family Residence District. A
preliminary plat was approved for this development in 2005 (Resolution 05 -132) and the proposed final
plat is consistent with that plat.
Applicable Ordinance Provisions:
Subdivision regulations are located within Article XVII of the City of Oshkosh Zoning Ordinance.
Property Location and Background Information:
The proposed plat is generally located north of Sawyer Creek, South of West 9 th Avenue, east of
Clairville Road, and north of West 20 Avenue. The plat involves an extension of Mockingbird Way,
with lots to be located on the north and south side of the proposed right -of -way.
The applicant/owner is also simultaneously seeking approval for the Second Addition to Casey's
Meadow South located to the southeast of the proposed First Addition. The areas need to be platted
separately due to the proposed parcel layout not being contiguous.

ANALYSIS
The owner is proposing to subdivide this area consistent with the previous preliminary plat approved
by the City. The original preliminary plat involved 41.05 acres and 105 lots of which approximately 20
lots have been final platted to date. All lots meet or exceed minimum lot requirements for the R- I
district and all lots front on a public street. The lot configuration differs slightly from the preliminary
plat in regard to lot widths for the proposed parcels on the north side of Mockingbird Way; lots on the
preliminary plat indicated 63 -foot wide lots versus 61 -foot wide lots on the final plat. This alteration is
minor and the lots still meet minimum requirements of the R -1 District (60 feet wide, 100 feet deep,
and 7,200 square feet in area).
Staff recommends that the lots be renumbered starting with "Lot 1" instead of the continuation from
the original Casey's Meadow South as indicated on the plat (first lot is indicated as "Lot 21 "). This
avoids confusion when conducting inquiries determining numbers of parcels for a plat or searching for
lower numbered parcels which do not exist.
An issue raised during the preliminary plat process was the need for traffic calming measures along
Mockingbird Way. Citizens have concerns that the long, straight stretch could potentially lead to
higher traffic speeds. As a solution, the preliminary plat included a pavement "bump -out" to force
vehicles to slow down while navigating this choke point. The bump -out is absent from the proposed
final plat and staff is requesting that it be included as a condition for approval.
The City's Comprehensive Plan identifies this area as appropriate for residential development and
approval of this plat is consistent with the Comprehensive Plan.
The Department of Public Works has reviewed the final plat and does not have any concerns with the
parcel configuration.
RECOMMENDATION /CONDITIONS
The Department of Community Development recommends approval of the final plat for the First
Addition to Casey's Meadow South with the following conditions:
1) Lots be renumbered starting with Lot 1 instead of starting with Lot 21.
2) Traffic calming bump -out is included along the extension of Mockingbird Way.
The Plan Commission approved of the final plats as requested with revised conditions. The following is
the Plan Commission's discussion on this item.
The owner is also requesting approval of a final plat containing 10 lots and right -of -way identified as
the Second Addition to Casey's Meadow South. The 3.339 acre plat is zoned R -1 Single Family
Residence District. A preliminary plat was approved for this development in 2005 (Resolution 05 -132)
and the proposed final plat is consistent with that plat.
Mr. Dell'Antonia commented that this plat was getting large and was wondering why no connection
has been made yet to Clairville Road.
Mr. Nau responded that Pheasant Creek Drive extends north to Ninth Avenue.
Ms. Mattox commented on the layout of the plat as she felt that lack of intersections with other streets
created a less neighborly atmosphere.
Mr. Burich replied that Mockingbird Way will contain the maximum length the city likes to see on a

block, but the developers had to adapt to the restrictions of Sawyer Creek to the south. The street will
eventually extend to Clairville Road and some type of trail system would also be included in the area,
but it was the most logical layout.
Chet Wesenberg, 3265 Casey Trail, petitioner for the requests, was present to answer any questions.
Mr. Borsuk asked if he had any issues with the renumbering of the lots as stated in the conditions.
Mr. Wesenberg replied he did not.
Mr. Dell'Antonia inquired about the issue of adding other roads to access the development.
Mr. Wesenberg responded that presently it was a tough time for development and that would be a large
expense. He stated that they have met or exceeded all city requirements for the plat.
Mr. Dell'Antonia then asked if the street would eventually go through to Clairville Road.
Mr. Wesenberg replied that Casey Trail would go through for sure as they also owned the land to the
west of the proposed plat. Sage Lane was meant to continue to the north, however, they do not own
this land.
Mr. Burich commented that it was not practical to require the developer to add a road until such a time
that the area is proceeding with development on the site. The submitted plan is standard platting for
development.
Mr. Borsuk suggested that the city officially map Windsong Terrace to continue through to this area.
Mr. Burich responded that he would look into this matter.
Mr. Fojtik inquired why road connections could not be made going to the south.
Mr. Burich replied that Sawyer Creek restricted road connections going south.
Steve Gohde, Assistant Director of Public Works, stated that he would like to add a condition relating
to the language on the certified survey map for both plat additions referring to lots in this plat affected
by conditions of a long -term stormwater maintenance agreement for drainage swales and stormwater
ponds recorded in a document which has not yet been executed. Mr. Gohde would like the condition
added to state that this document would require review and approval by the Department of Public
Works prior to it being recorded.
Motion by Borsuk to approve the final plats for the first and second additions to Casey's
Meadow South as requested with the following conditions to be applied to the first addition:
1. Lots be renumbered starting with Lot I instead of starting with Lot 21.
2. Traffic calming bump -out is included along the extension of Mockingbird Way.
3. Long -term stormwater maintenance agreement for drainage swales and stormwater
ponds be reviewed and approved by the Department of Public Works prior to being
recorded.
