The area is located in the South Shore Redevelopment Area and the active manufacturing use of the property was discontinued in sometime in 2009. The subject property, with others, was rezoned from M -2 Central Industrial District to the C -3PD Central Commercial with Planned Development Overlay in November 2009. ANALYSIS The applicant is proposing to utilize the former parking and loading facilities of the Morgan Door Manufacturing site located at the northwest corner of Oregon Street and West 6 Avenue for a temporary concrete and pavement recycling operation. The area has a six foot tall chain link fence running the full length of the lot lines with access to the area through drives on Oregon Street and West 6 Avenue. The concrete and pavement recycling operation includes the staging and operations area for the crushing machine, stacking conveyor, loader, tool truck/trailer, and employee's vehicles. The operation involves bringing concrete and pavement material from the Main Street reconstruction project to the site where it will be crushed into aggregate and stored until needed back on Main Street. The crusher is equipped with a dust control water system and noise readings will not be in excess of city regulations. Access on Oregon Street will be limited to right -in right -out movements only with the area screened from view and stored material not placed on any utility access points. The operation will run from April through September 2010 at which time the impervious surface will be removed with topsoil added and the subject site seeded. FISCAL IMPACT None Anticipated. RECOMMENDATION The Plan Commission approved of this request at its April 6, 2010 meeting. Approved, tyliardy�4� ITEM: CONDITIONAL USE PERMIT AND PLANNED DEVELOPMENT REVIEW FOR A TEMPORARY CONCRETE CRUSHING OPERATION AT 421 OREGON STREET (FORMER MORGAN DOOR PLANT) Plan Commission meeting of April 6, 2010 GENERAL INFORMATION Applicant: Vinton Construction Company Owner: Jeld -Wen Windows and Doors Action(s) Requested: Conditional Use Permit and Development Plan approval for utilization of an existing off - street parking area at the former Morgan Door Manufacturing facility for temporary concrete crushing operation including the import of concrete pavement removed as part of the Main Street reconstruction, processing and storage of pavement material and the export of base course material back to the Main Street construction project area, when needed. Applicable Ordinance Provisions: Conditional Use Permit standards are found in Section 30 -11 of the Zoning Ordinance and criteria and guidelines for the establishment and /or amendment of a Planned Development overlay district in Section 30 -33. The full parcel involved in this CUP /PD request is approximately 21.4 acres and is fully improved with approximately 4.6 acres of building footprint (21.5 %), 15.7 acres of impervious surface area (73.4 %) and 1.1 acres of pervious area (5.1 %). The 3.7 acre area of the parcel proposed to be utilized in this request is 100% impervious surface including gravel, concrete, asphalt and asphalt over concrete. The subject area has a six foot tall chain link fence running the full length of the lot lines on Oregon Street and West 6th Avenue, the river on the north and the manufacturing building on the west. Access to the subject area currently exists through two full access drives on Oregon Street and two full access drives on West 6 Avenue. The concrete and pavement recycling operation includes the staging and operation area for a concrete crushing use including locating a mobile /portable crushing machine, stacking conveyor, loader, tool truck/trailer, and employees vehicles. The concrete crushing operation involves bringing concrete and pavement material, primarily from the Main Street reconstruction project, to the site where it will be crushed into aggregate and stored until needed back on Main Street as backfill material. The applicant performs the material crushing with the use of a tracked portable crushing plant that is mobile so as to work at various locations on the subject site increasing efficiency and effectiveness of the operation. The portable crusher is equipped with a dust control water system to minimize impacts of dust and airborne debris and the applicant has documented noise readings to assure that the operation will not be in excess of city regulations. The petitioner has indicated that similar operations have taken place on College Avenue in Appleton and on Main Street in Menasha, with no environmental impact. The interdepartmental review (Department of Public Works, Transportation Department, Police Department, Fire Department, Community Development Department, Health Department, and City Attorney's Office) generated concern regarding the use of the Oregon Street drives by construction equipment and vehicles associated with the crushing operation as traffic volumes on Oregon Street are extremely heavy, especially with the closure of Main Street. Staff had less concern with the access on West 6 Avenue and suggests that a recommendation of approval be that Oregon Street access is limited to right -in right -out movements only and that West 6 Avenue be the primary entrance. Staff believes that the concrete and pavement recycling operation will be a safe and clean operation but, in an effort to minimize potential negative impacts of the operation on nearby businesses and on the area in general, staff suggests that the east and south property lines include visual screening such as construction tarps, screens or fence slats. It was also noted that the subject area has utilities, both active and unused underground so it is important that stored material not be placed on any utility access points. The petitioner has indicated in their application that the schedule for the proposed use is anticipated to be from mid April, 2010, through September, 2010, and that they will remove the impervious surface, add topsoil and seed the subject area once operations are complete. Staff feels that these ITEM -421 Oregon - CUP /PD temp crushing should be conditions of approval for both the PD and the Conditional Use and staff is therefore recommending that the use be discontinued at the end of the Main Street reconstruction (estimated to be October, 2010) and that the subject area improvements be removed, topsoil added, and the area seeded and mulched. RECOMMENDATION /CONDITIONS The Department of Community Development recommends a finding that the proposed planned development and conditional use permit request is consistent with Sections 30 -11(D) and 30- 33(A)(1) of the Zoning Ordinance and be approved with the following conditions: 1) Access on Oregon Street is limited to right -in right -out movements only. 2) The subject area is screened from view from Oregon Street and West 6ch Avenue. 3) Stored material is not placed on any utility access point. 4) The use is discontinued at the end of the Main Street reconstruction and the subject area improvements are removed, topsoil is added, and the area seeded and mulched. The Plan Commission approved of the planned development/conditional use permit as requested with conditions noted. The following is the Plan Commission's discussion on this item. Mr. Buck presented the item and reviewed the site and surrounding area, the current land use, the site plan and stated that the petitioner was proposing to only use the west side of the site designated on the maps. He further stated that it was only a temporary use from April through September of 2010 for recycling of concrete from the reconstruction of Main Street and explained how the process would operate. He stated that staff had concerns with the Oregon Street access and would be limiting movements on this street to right -in right -out only. He also reviewed the other conditions recommended for this request. Mr. Fojtik questioned if this equipment was the same as the machinery currently being used on Witzel Avenue. Don Rabitz, Vinton Construction Company supervisor, stated that the equipment is currently being used on Murdock Avenue and Jackson Street and is state of the art. They have used it in several urban areas recently without issues and it is equipped with a dust control water system to minimize environmental impacts. Mr. Thorns inquired what the hours of operation would be and how the decibel readings compared to city ordinance regulations for noise. Mr. Rabitz responded that the operating hours would be the same as the construction hours on Main Street and the decibel levels would be within city ordinance requirements. Mr. Burich added that the noise ordinance is enforced by the Health Department however no staff is present from that department to answer questions on the acceptable decibel levels for the city. Mr. Rabitz commented that it was similar to any other construction equipment and that they were working with representatives from Jeld -Wen on the clean up of their site as well. Mr. Nollenberger questioned where this activity would take place if approval was not granted to do the work on the proposed site. ITEM -421 Oregon - CUP /PD temp crushing Mr. Rabitz replied that they would have to find an alternative location if this site was not approved. Mr. Monte inquired about the height of the fence enclosing the area. Mr. Buck responded that the fence was six feet tall. Mr. Monte then inquired if the screening of the work area would be a visual obstruction for motorists at the intersection of 6ch Avenue and Oregon Street. Mr. Buck replied that it should not be an issue as it is a controlled intersection and in addition, it is no different from C -3 Zoning District standards for other uses as this district has no required setbacks from the property line. If there were concerns with visual obstruction issues, the corner could be clipped and move the fence in to accommodate said concerns. Mr. Borsuk asked if the petitioner had any problems with the screening of the site. Mr. Rabitz responded they did not and passed around a sample of the material to be used for screening purposes. Mr. Fojtik commented that the screening should help with both noise and dust issues from the work site. Mr. Rabitz also commented that the operation would be sporadic and not continuous during the temporary period allowed. Mr. Thorns questioned what hours of operation were allowed for construction projects by city ordinance. Mr. Gohde replied that limits for noise under city ordinance are 7:00 am until 10:00 pm and 85 decibels are within the range for construction activity and that decibel readings are taken at the property line. Mr. Thoms then questioned if this operation was temporary, why was there no condition addressing the duration of the project. Mr. Buck responded that there may be issues with construction projects and although it is planned to continue only through September, delays may occur due to weather. He further commented that the project would precipitate the cleanup of this site on the river front as the petitioner would be removing the concrete from the site, adding topsoil and seeding the area when the operation is complete. Mr. Thorns also inquired about the distance from the site to the residential properties on 6th Avenue and the planned hours of operation on the site. Mr. Buck responded that he believed it was about 60 feet. Mr. Rabitz added that the hours of operation would be from 7:00 am until 5:00 pm. Mr. McHugh stated that he had received complaints regarding noise from Oshkosh Corporation vehicles parked on the site. ITEM -421 Oregon - CUP /PD temp crushing Mr. Burich responded that the storage of Oshkosh Corporation vehicles was on the other end of this parcel. Mr. Monte commented that the vehicles produced at Oshkosh Corporation exceed the 85 decibels of the city noise ordinance. Mr. McHugh questioned if there were no alternate sites on Main Street where this operation could be located and voiced his concern with the noise ordinance issues and if it could be controlled. Mr. Bowen commented that the company would be required to comply with ordinance standards. Mr. Fojtik stated that this operation has to be done somewhere and sometime and it is a good reuse of materials and obviously there was not a better location found for the project. Mr. Thorns commented that he had concerns regarding the noise issue and questioned if residents in the area were notified of today's meeting as no one appeared to be present to discuss the matter. He felt that a more appropriate location would be east of Main Street along the river. Mr. McHugh inquired if meeting notices were sent out on this project. Mr. Buck responded that notices were sent to adjacent property owners. Motion by Borsuk to approve the conditional use permit and planned development for a temporary concrete crushing operation at 421 Oregon Street as requested with the following conditions: 1) Access on Oregon Street is limited to right -in right -out movements only. 2) The subject area is screened from view from Oregon Street and West 6th Avenue. 3) Stored material is not placed on any utility access point. 4) The use is discontinued at the end of the Main Street reconstruction and the subject area improvements are removed, topsoil is added, and the area seeded and mulched. Property Dear Mr. Buck: Vinton Construction Company is requesting permission to import concrete pavement from Vinton's reconstruction of North Main Street, crush it on site, and haul it from the site back to Main Street. The purpose of this request is to recycle the existing pavement to utilize it back on the reconstruction of Main Street. Attached is a detailed map that identifies Vinton Construction Company's proposal to process concrete into base course on the Northwest corner of Oregon Street and Sixth Street in the city of Oshkosh The existing site is vacant and is on the market for sale. The site is the former Jeld -Wen Site. Access to the site will be on the east side along Oregon Street through the existing gate. Vinton Construction Company will access the site with quad axle dump trucks through the existing gate. Equipment on site will be limited to the portable crusher, stacking conveyor, loader, tool truck and/or tool trailer, and foreman's pickup truck. Vinton Construction Company has a tracked portable crushing plant that will be mobilized to the site to process the concrete. The crushing plant has its own water system to control dust and Vinton Construction Company has documented decipal readings for noise. The attached letter indicates decipal reading at incremental distances from the machine while in operation. Our proposal does not include a specific crushing location because the crusher is mobile while operating. The unit will track around the site while in operation. The location will be confined to the limits on the attached drawing. The site will be seeded after Vinton is completed with the above mentioned crushing operation. The schedule for this proposal would be from Mid April 2010 to September . �i 2010, non continuous. The actual crushing will be one (1) week each for three (3) times within the above mentioned time frame for this proposal. Vinton Construction Company has operated this machine in similar settings to this site numerous times. This plant has operated in the middle of College Avenue, Appleton and Main Street, Menasha with no environmental impacts to the public.
