PURPOSE: APPROVE CONDITIONAL USE PERMIT AND PLANNED
DEVELOPMENT OF A TEMPORARY PARKING LOT IN 600
BLOCK OF JEFFERSON STREET IN CONJUNCTION WITH MAIN
STREET RECONSTRUCTION PROJECT

BE IT RESOLVED by the Common Council of the City of Oshkosh that a
conditional use permit for the planned development of a temporary gravel parking lot in
the 600 Block of Jefferson Street to help alleviate parking concerns for Main Street
businesses and improve public access to said businesses during the Main Street
reconstruction project, per the attached, is hereby approved with the following
conditions:
1) Base standard modifications for the use of gravel as a surface and to setbacks
as depicted on the submitted plan.
2) The use is limited in timeframe to the reconstruction of the 600 block of North
• Main Street at which time access will be blocked, curb -cut closed and site
returned to vegetative groundcover.
3) Trim or clear vegetation at the western lot line between the subject site and the
parking area to the west.
4) Add barriers on the north and south of the parking stalls prohibiting movement
onto the setback green space as approved by the Department of Community
Development.
5) Directional signage, security lighting and trash receptacle(s) are installed as
approved by the Transportation Department.

Reconstruction Project
BACKGROUND
At its February 8, 2010 meeting, the Redevelopment Authority (RDA) reviewed a request from the
owner of Sami's on Main (668 North Main Street) to utilize vacant RDA properties located to the east
along Jefferson Street for interim parking during the Main Street reconstruction project. It was the
consensus of the RDA to have staff further review temporary parking options for the 600 Block
property owners during the street reconstruction project.
City staff met with property owners in this immediate area on March 8th to determine needs and
possible concerns. No significant objections were raised by neighboring property owners, but concern
was expressed over physically protecting adjacent lands from automobile movements using the lot and
that the lot improvements be removed and the site restored to green space following North Main Street
opening in the fall.
The City is requesting that 2 vacant lots on Jefferson Street (formerly 679 & 683 Jefferson) owned by
the RDA be used as a temporary gravel parking lot, which use is permitted only by a conditional use
permit. It should be noted that gravel parking lots are not permitted in the City. However, staff
believes given the temporary nature of the parking lot (due to the N. Main Street reconstruction) and
the conditions being recommended, the use should not have an adverse effect on the neighborhood or
the community.
Under separate action, the City is also requesting Council action on leasing the lots in question from
the RDA as well as approving access easements /agreements with the owner of O'Brian's Tavern for
the use of O'Brian's lot for public access as a private - public partnership aimed at assisting Main Street
businesses.
ANALYSIS
The temporary lot is proposed to be constructed of gravel and consist of a center drive aisle with two
rows of 90 degree parking providing 20 stalls. To address neighborhood concerns, lighting will be
installed and trash receptacles placed on site to reduce litter /debris. It is also proposed to install some
type of wheel stops to prohibit vehicles from entering into the setback areas.
On March 16, 2010, the Plan Commission approved, with conditions, a conditional use permit and
planned development of a temporary gravel parking lot on Jefferson Street adjacent to 686 North Main
Street. At its March 30, 2010 meeting, the RDA also approved of the City's use of the two lots on
Jefferson Street for a temporary gravel parking lot.
FISCAL IMPACT
Staff from Public Works, Parks, Transportation and Community Development Departments will
provide materials, supplies and labor necessary to construct the parking lot. Any applicable costs will
be attributed to the Main Street reconstruction project.
RECOMMENDATION
The Plan Commission approved of this request at its March 16, 2010 meeting with conditions. The
Redevelopment Authority approved of the use of the lots for a temporary parking lot at its March 30,
2010 meeting.

GENERAL INFORMATION

The City, on behalf of area land and business owners, is requesting a conditional use permit (CUP) and
Development Plan Review to construct and operate a temporary gravel parking lot at 679 -683 Jefferson Street to
help alleviate parking concerns associated with the North Main Street reconstruction project.
Applicable Ordinance Provisions:
Parking lots are permitted only through CUP approval in the R -2 Zoning District. Standards imposed on
Conditional Use Permits are located in Section 30 -11 (D) of the Zoning Ordinance. The Zoning Ordinance
establishes criteria and guidelines for the establishment and /or amendment of a PD overlay district in Section
30 -33 (A).
Property Location and Type:
The request involves the temporary use of two properties comprising approximately 8,000 square feet of land
currently owned by the City of Oshkosh Redevelopment Authority. They are located on the west side of
Jefferson Street, approximately 125 feet south of East Irving Avenue. The properties are both currently vacant
but had previously contained residential homes. The existing residential uses in the portion of the block are
being purchased when available and land- banked by the Redevelopment Authority (RDA) for possible area -
wide redevelopment.

ANALYSIS
North Main Street will be closed for reconstruction at various locations for a majority of the 2010 construction
season. It is anticipated that the 600 block of North Main Street will be closed and not permit vehicular access
to businesses from June through October. In an effort to help relieve these access issues and potential parking
pressures, the City is proposing the installation of a temporary gravel parking lot on the lots located at 679 -683
Jefferson Street (owned by the Oshkosh Redevelopment Authority). Staff's review of the proposed temporary
use is atypical because the use of gravel for parking surface is prohibited within the Zoning Ordinance and the
utilization of gravel surface is only allowed for fully enclosed storage areas in industrial settings. However,
staff understands that the reconstruction of North Main Street has created a unique and uncommon situation with
a potentially negative economic impact on local small business owners and therefore dictates this consideration.
The temporary parking area is proposed to be centered on the two lots setback from Jefferson Street 25 feet and
setback from the properties to the north, south and west by 5 feet. As it is temporary in nature, the lot is
proposed to be constructed of gravel and consist of a center drive aisle with two rows of 90 degree parking
providing 20 stalls. Access will be provided in the form of a 24 foot curb -cut on Jefferson Street and a 24 foot
internal drive connection to the O'Brian's Tavern parking lot to the west. The owner of O'Brian's Tavern
understands the need not only for temporary access to his parking lot and building but for the other businesses
located on the east side of the 600 block of Main Street. He has agreed to provide temporary access and parking
easements with the RDA for the public as a private - public partnership aimed at assisting the North Main Street
business community this summer and fall.
Staff reviewed the temporary lot concept and generated suggestions that should be incorporated with the sites
design and operation. Staff believes a barrier should be installed on the north and south sides of the parking
stalls prohibiting movement so as to protect adjoining properties from vehicles utilizing the temporary parking
area. The protective barrier could be in the form of jersey barriers, concrete wheel stops or solid fencing with
the overall purpose of prohibiting vehicles from entering onto the setback greenspace. Additionally, to help the
temporary use run as smoothly and safely as possible, staff recommends that the vegetation at the west /rear lot
line be thinned and /or removed to provide clear vision, that lighting and directional signage be installed for
safety and that trash receptacles be included to minimize potential for migration of litter and debris.
A neighborhood meeting was conducted on March 8 to discuss the issues related to the North Main Street
closure and the action suggested to address it. Several neighboring property owners attended and there was no
significant objection to the temporary lot. Concern was expressed over physically protecting adjacent lands
from automobile movements using the lot and that the lot improvements be removed and the site restored to
greenspace following North Main Street opening in the fall.

Staff recommended approval of the conditional use permit and development plan with the following conditions:

The Plan commission approved of the conditional use permit and planned development as requested with
conditions as noted below. The following discussion occurred at the Plan Commission meeting.
Mr. Buck presented the item, reviewed the site and surrounding area, and gave background information on the
request. He explained that the City of Oshkosh Redevelopment Authority has been acquiring property in this
area for redevelopment purposes and he reviewed the current uses in the area. He further explained that the
request was initiated to assist the Main Street property owners during the reconstruction of the street which will
facilitate the closing of Main Street for a time this summer, creating access and parking issues. Mr. Buck
emphasized that this is an uncommon and unique situation. He reviewed the site plan which would create
approximately 20 parking stalls in the proposed temporary lot and discussed the use of gravel surface,
landscaping, lighting and trash issues and how they would be addressed. The owner of O'Brian's Tavern has
agreed to provide temporary access and parking easements to his parking lot for other businesses to assist in this
venture. A neighborhood meeting was held with adjacent property owners on March 8 with a positive response.
The main concerns were the potential negative impacts from the use of the parking area on surrounding
residential properties.
Mr. Borsuk inquired who would be responsible for the maintenance of the parking lot and if some type of dust
free treatment would be applied to the gravel surface.
Mr. Buck responded that the City would be responsible for the maintenance of the lot and that no dust free
treatment was included with the gravel surface as the city is looking at the least costly and most timely way to
install and remove this lot as it was only proposed as a temporary situation.
Ms. Propp questioned who would be emptying the trash receptacles proposed to be on site.
Mr. Buck replied that City staff or others designated by staff would be responsible for that duty.
Mr. Hinz inquired if there was adequate room to access O'Brian's parking lot from the proposed temporary lot
as the dumpster enclosure and vehicles appeared to be very close to the access point.
Mr. Buck responded that the drive aisle was proposed to be 24 feet which is adequate and easement agreements
would be drafted if this request was approved. He stated that the tavern may have to relocate the dumpster.
Mr. McHugh asked how we would be designing the security lighting proposed for the site.
Mr. Buck replied that the Transit Department would be handling the actual design and installation of lighting
and the Department of Community Development would verify that the lighting is not excessive as there are
residential properties in the area.
Mr. Thorns questioned if this request had been reviewed by the Transit and Police Departments.
Mr. Buck responded that it had been reviewed and that all requests that come before the Plan Commission are
reviewed at a City inter - departmental meeting prior to the creation of the staff reports.
Motion by Nollenberger to approve the conditional use permit /development plan to permit a temporary parking
lot at 679 -683 Jefferson Street with the following conditions:
1. Base standard modifications for the use of gravel as a surface and to setbacks as depicted on the
submitted plan.
2. The use is limited in timeframe to the reconstruction of the 600 block of North Main Street, at which
time access will be blocked, curb -cut closed and site returned to vegetative groundcover.
