I have contacted Miron Construction on this detail and Miron Construction has contacted Schindler elevator on the detail. While this detail may not fit the attached detail exactly, it is the nearest Hilti detail that could be found for the application by the contractor. What was installed, per Mike Schmid at Miron, was the wireway was packed with steel wool as per the drawing, and then a sheet metal enclosure was installed to contain the steel wool. The fire caulk was applied over and around the sheet metal enclosure. I did touch bases with the state elevator inspector, Tim Marty, and he indicated that as part of his inspection, before issuing an elevator use permit, he does review not only all the elevator components and operation, but also the fire wall penetrations. Mr. Marty indicated that if he had noted any concerns with this particular penetration, he would have noted the concern on his report. He did indicate he was satisfied with the installation of this penetration at the time of his inspection. He also indicated that the State Elevator Inspector would have jurisdiction over this installation, but suggested that if you had further concerns, that you could give him a call. We would just ask that you contact Mr. Marty to discuss to see if there can be some agreement on this penetration. While we are not looking to circumvent anyone's concerns regarding any portion of this project, we are mostly interested in getting the job complete and obtaining the official occupancy permit for this project. If you are not satisfied with either detail on the remaining fire penetrations in question or are not interested or will not discuss the elevator hoistway penetration with Mr. Marty or have discussed and would still have some action item, we would just ask that you provide some direction on what you would like to see done. Based on our last conversation, there was a question on what the applicable wall fire ratings were based on what was in the plans. I have contacted Miron Construction on this detail and Miron Construction has contacted Schindler elevator on the detail. While this detail may not fit the attached detail exactly, it is the nearest Hilti detail that could be found for the application by the contractor. What was installed, per Mike Schmid at Miron, was the wireway was packed with steel wool as per the drawing, and then a sheet metal enclosure was installed to contain the steel wool. The fire caulk was applied over and around the sheet metal enclosure. I did touch bases with the state elevator inspector, Tim Marty, and he indicated that as part of his inspection, before issuing an elevator use permit, he does review not only all the elevator components and operation, but also the fire wall penetrations. Mr. Marty indicated that if he had noted any concems with this particular penetration, he would have noted the concem on his report. He did indicate he was satisfied with the installation of this penetration at the time of his inspection. He also indicated that the State Elevator Inspector would have jurisdiction over this installation, but suggested that if you had further concerns, that you could give him a call. We would just ask that you contact Mr. Marty to discuss to see if there can be some agreement on this penetration. While we are not looking to circumvent anyone's concerns regarding any portion of this project, we are mostly interested in getting the job complete and obtaining the official occupancy permit for this project. If you are not satisfied with either detail on the remaining fire penetrations in question or are not interested or will not discuss the elevator hoistway penetration with Mr. Marty or have discussed and would still have some action item, we would just ask that you provide some direction on what you would like to see done. Our code analysis was based on IBC 2003 as indicated on plan sheet G0.02T. Sheet G0.02T also indicates the fire rating requirements as follow: Vertical Exit Enclosure: 2 hour rating minimum for four stories or more. (Per IBC Section 1019.1) Shaft Enclosure: 2 hour rating minimum for four stories or more. (Per IBC Section 707.4) Per IBC Table 601 (Type IB Construction type): Structural Frame = 2 hour rating Bearing Walls = 2 hour rating Floor Construction = 2 hour rating Roof Construction =1 hour rating Per IBC Section 412.1.3 as it relates to Towers; if the exit stairway and elevator hoistway are located in the same shaft enclosure, a 4 hour rating separation needs to be provided. Our explanation for indicating 4 hour walls UL designs on sheet A9.01 T is as follows: The Structural Engineer calculations dictated the thickness of the precast concrete walls to be used and based on those thicknesses the UL Design were established. We have used two different thicknesses of precast walls in this project; an 8 inch and 14 inch and both walls based on their thickness provides a fire rating of more than 4 hours. Refer to IBC Table 721.3.2. The reason 4 hour rating UL Design were indicated on sheet A9.01T was because there were no UL Design that will provide a 2 hour rating using a 8 or 14 inch thick wall. You inspired me to review my inspection reports to see how this played out with the elevator inspection because I make a practice not to inspect anything associated with the elevator until the elevator inspection(s) has been approved. My Field Inspection Reports revealed that I was on site conducting an electrical inspection on 6/30/2008, and I documented on my report that the elevator inspection was being conducted at the time of my requested inspection; consequently I did not do any inspections associated with the elevator. I was back on site on 7/3/2008 for an electrical re- inspection and at that time I conducted an inspection for the electrical associated with the elevator, which I faxed to Jeff Delcore @ Schindler Elevator. In that inspection report I noted that the fire stopping was not installed in the hoistway between the machine room and the hoistway. 11/24/2009 Page 2 of 3 As for who has jurisdiction, it is any building official who has a code section associated with the installation. The elevator inspector, electrical inspector, building inspector, fire inspector, etc., may all have jurisdiction over the installation. This is a job specific permit not an annual permit. The only annual electrical permits we have are for manufacturing. Our municipal code also states that work conducted without permit shall pay a double permit fee or an additional $100.00 which ever is greater. Also they did not renew their electrical contractor's license for 2010, so they will also have to procure that license in order to issue a permit now. They did have a license at the time the work was conducted. It is our interpretation that the law makes a major distinction between building codes and zoning codes and requires Federal agencies to: a. Design its facilities in accordance with nationally recognized building codes. b. Design its facilities to be compatible with all reasonable local zoning codes. c. Consider any local or sponsor building code requirements and adopt those we feel appropriate and beneficial. The law precludes the local officials or sponsor from penalising the agency for not adopting local code requirements. In our opinion this is the way we have been doing business for the past 20 years. On February 8, we requested the chief Counsel, AGC -1, to provide legal guidance on the applicability of PL 100 -678 (Attachment 1). Some sponsors believe that the law requires the Federal Government to adopt all local building codes and have threatened to withhold building permits for Federal construction unless we comply. We believe that the FAA has the right to, and as it sometimes has, proceed with construction without a local building permit. However, sponsors can and have held up construction by refusing to issue a building permit to our construction contractor. One particular case has recently been brought to our attention by the Central Region concerning their planned expansion of the St. Louis, Missouri, ATCT base building by approximately 2000 square feet. The St. Louis local officials are attempting to require the FAA to upgrade the entire 10,000 square foot building to current codes when the new addition is built. This could cost an additional, $100,000. In our opinion, this project is not even subject to PL 100 -678 since it was funded in fiscal year (FY) 1988. Please provide us with your interpretation of: 1. Our responsibility to consider local building codes. 2. Whether or not a local authority can penalize the Federal Government by withholding a contractors • ' permit. • 3. In carrying out this subsection, the Administrator or the head of the Federal agency authorized to construct or alter the building shall use the latest edition of the nationally recognized codes referred to in this subsection. (b) Zoning laws Each building constructed or altered by the General Services Administration or any other Federal agency shall be constructed or altered only after consideration of all requirements (other than procedural requirements) of - (1) zoning laws, and (2) laws relating to landscaping, open space, minimum distance of a building from the property line, maximum height of a building, historic preservation, and esthetic qualities of a building, arid other similar laws, of a State or a political subdivision of a State which would apply to the building if it were not a building constructed or altered by a Federal agency. Page 2 of 3 (c) Special rules (1) State and local government consultation, review, and inspections For purposes of meeting the requirements of subsections (a) and (b) of this section with respect to a building, the Administrator or the head of the Federal agency authorized to construct or alter the building shall - (A) in preparing plans for the building, consult with appropriate officials of the State or political subdivision, or both, in which the building will be located; (B) upon request, submit such plans in a timely manner to such officials for review by such officials for a reasonable period of time not exceeding 30 days; and (C) permit inspection by such officials during construction or alteration of the building, in accordance with the customary schedule of inspections for construction or alteration of buildings in the locality, if such officials provide to the Administrator or the head of the Federal agency, as the case may be - (i) a copy of such schedule before construction of the building is begun; and (ii) reasonable notice of their intention to conduct any inspection before conducting such inspection. (2) Limitation on State responsibilities Nothing in this section shall impose an obligation on any State or political subdivision to take any action under paragraph (1). (d) State and local government recommendations Appropriate officials of a State or a political subdivision of a State may make recommendations to the Administrator or the head of the Federal agency authorized to construct or alter a building concerning measures necessary to meet the requirements of subsections (a) and (b) of this section. Page 3 of 3 officials may also make recommendations to the Administrator or the head of the Federal agency concerning measures which should be taken in the construction or alteration of the building to take into account local conditions. The Administrator or the head of the Federal agency shall give due consideration to any such recommendations. (e) Effect of noncompliance No action may be brought against the United States and no fine or penalty may be imposed against the United States for failure to meet the requirements of subsection (a), (b), or (c) of this section or for failure to carry out any recommendation under subsection (d) of this section. (f) Limitation on liability The United States and its contractors shall not be required to pay any amount for any action taken by a State or a political subdivision of a State to carry out this section (including reviewing plans, carrying out on-site inspections, issuing building permits, and making recommendations). (g) Applicability to certain buildings This section applies to any project for construction or alteration of a building for which funds are first appropriated for a fiscal year beginning after September 30, 1989. (h) National security waiver This section shall not apply with respect to any building if the Administrator or the head of the Federal agency authorized to construct or alter the building determines that the application of this section to the building would adversely affect national security. Very few projects come to a "perfect" close. We understand there are generally items to be cleaned up at the end of the project and as long as we.have developed an opinion the project is reasonably save, we typically proceed with allowing Occupancy as long as we have a reasonable schedule for completion. Additionally, if something were to present itself that would cause us to reconsider, we would first bring it to your attention in hopes of getting such issues addressed before taking action on Occupancy since we had entered into an agreement for Occupancy. Please advise the affected contractors to follow up with the necessary reinspections to verify compliance. We will look forward to approving everything (save the FAA work) by the end of August. As I had indicated on the phone, the work by FAA will likely not be completed until November or December of this year in order for them to move all remaining equipment from the existing tower to the new tower. As far as the work Miron has remaining on the building portion of their contract, I would estimate that everything would be totally complete by the end of August. Miron's work on the building will generally be punch list work, airfield lighting control fiber installation (which is mainly airfield work)and finishing up any items on the City inspection reports. Fire extinguishers have been installed as required. 2. A scanned copy of the Building and HVAC Compliance Statement is attached to this e-mail. 3. A scanned copy of the Precast Plan Approval Letter from the State is attached. 4. The fire shutter door did not release at the time of testing the smoke alarms in the lobby as the fire shutter door was deactivated at the time of the smoke alarm test so the door would not close on anyone. The door was tested by A & A Security and this test result will be included in their test documentation. Also, the fire shutter has been reactivated. Please see the attached e-mail string between Bill Seronko from Northern Electric and myself regarding the fire shutter door. 5. Kevin Benner has been in contact with Northern Electric regarding the work done by FAA. The work has been reviewed by Northem Electric and Kevin Benner did discuss with Northern Electric in addition to doing a follow up inspection on the work today, July 23. No additional items were noted by Kevin. The low voltage permit fee was to be mailed by Northern either late yesterday or today. 6. Schindler has sent in the required paperwork for doing electrical work in the City and will be sending in the permit and fees. FAA has contracted with Northern Electric to review FAA work and submit fees. 7. The work platform for the chiller was performed by August Winters, however, the platform was less than 36" deep. An e-mail has been sent to Miron Construction indicating that the platform depth will need to be corrected. 8. Plumbing approvals have been obtained. Electrical approvals have several items remaining to be completed after meeting with Kevin Benner this morning, July 23. An e-mail was sent to Miron Construction today itemizing the items that remain to be completed. We will continue to diligently work to complete the items on the list. These items will also be included on a punch list for the building until they are completed or resolved. Kevin Benner indicated that he thought that none of the items on the list that remain would hold up getting an occupancy permit, however, we do need to get the items finished up a quickly as possible. If there is any additional information you need or clarification on anything, please let me know. Miron Construction and OMNNI will continue to take care of any items remaining both on the electrical list and the punch list that was developed for the building by OMNNI. As previously noted, any items remaining on the electrical list will be put on the building punch list to be completed. The code has an exception that allows annealed glass to be used at an angle greater than 15 degrees if "walking surface below the glazing material is permanently protected from the risk of falling glass." I explained to Allyn that the original intent of the design and construction was to have the cab glass installed at 15 degrees but through the design and shop drawing review process we ended up with the glass at a 20 degree angle from the vertical. As a result of the higher angle from the vertical, we were required by code to go to a laminated glass, and because of the existing design, we were looking at laminated insulated glass verses just laminated glass. I also explained that in using this type of glass, there was a concern from FAA about the potential for double imaging and as a result we were looking into the potential for a waiver from using a laminated insulated glass vs. using the planned annealed insulated glass. Based on this intention, we were looking for an interpretation of the IBC 2400 code, specifically the exceptions listed in IBC 2405.3. After discussing with Allyn, there are basically two items that Allyn would not be comfortable granting a waiver for. The first is that both the ground and the catwalk could be considered walking surfaces that would need to be protected and how would we do that; the second is that even if only the ground was considered the walking surface and the existing catwalk was enclosed on the bottom and sides, AIIyn would not be comfortable that this enclosure would provide enough protection to keep glass from falling outside the catwalk. Kevin Benner has been in contact with Northern Electric regarding the work done by FAA. No additional items were noted by Kevin. The low voltage permit fee was to be mailed by Northern either late yesterday or today. 6. Schindler has sent in the required paperwork for doing electrical work in the City and will be sending in the permit and fees. FAA has contracted with Northern Electric to review FAA work and submit fees. 7. The work platform for the chiller was performed by August Winters, however, the platform was less than 36" deep. An e-mail has been sent to Miron Construction indicating that the platform depth will need to be corrected. 8. Plumbing approvals have been obtained. Electrical approvals have several items remaining to be completed after meeting with Kevin Benner this morning, July 23. An e-mail was sent to Miron Construction today itemizing the items that remain to be completed. We will continue to diligently work to complete the items on the list. These items will also be included on a punch list for the building until they are completed or resolved. Kevin Benner indicated that he thought that none of the items on the list that remain would hold up getting an occupancy permit, however, we do need to get the items finished up a quickly as possible. The door has been left energized and in working order. The circuit determined for the door did not change from the base bid drawings as the circuit is shown, and only the smoke detectors were actually extra work. Also, has the door been reactivated since all of the testing? If we have documentation, I should get that to the building inspector. He thought the control relay for the door was deactivated at test time so as the door would not close on anyone during the fire alarm testing. I have a call in to Allyn to see if we can get conditional occupancy if not every item is complete before EAA. As far as who needs to get the individual items complete, that is as follows: 1. Fire Extinguishers - Miron - Should be done as the extinguishers were on site. 2. Compliance Statements - OMNNI -Tim B. 3. Precast Plan Approval Letter - OMNNI - Tim B. 4. Fire Shutter Release Explanation - Northern Electric - This is in reference to why the shutter door did not close when the fire alarms were set off. (Bill S.- I believe this was because the fire shutter door is activated by a fusible link but could you please verify) 5. Review of FAA electrical installation and permits - Northern Electric 6. Electrical permit for elevator work - Schindler Elevator 7. Chiller Platform - will get revised sketch to Mike Schmid today. This would either need to be done by Miron or August Winters. 8. Plumbing Approvals - Need to move one condensate line in janitors closet (August Winters) and submit backflow preventer test results to City (S & S Mechanical) 9. Electrical Approvals - Please see electrical inspection report dated 6/30/08 as received from Kevin Benner from the City of Oshkosh. This list is a combination of corrections for Northern Electric (3 items), FAA (4 items), August Winters and August Winters sub, Johnson Controls (4 items), and Miron (1 item). l know the one item that was on the list for Miron has been completed (access to the electrical equipment in the elevator control room). There were other items on the fire department and OMNNI punchlist, but many of these items have also been taken care of plus they would not affect occupancy.
