HomeMy WebLinkAbout10-55FEBRUARY 23, 2010 10 -55 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE DISPOSITION OF VACANT LOT ON WEST 9TH AVENUE TO HABITAT FOR HUMANITY / 649 WEST 9TH AVENUE INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the disposition of the vacant lot on West 9th Avenue, formerly referred to as 649 West 9th Avenue, to Habitat for Humanity of Oshkosh, Inc., is hereby approved and the proper City officials are hereby authorized and directed to execute any and all documents necessary for purposes of same. Of HK ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: February 18, 2010 RE: Approve Disposition of Vacant Lot on West 9th Avenue to Habitat for Humanity / 649 West 9th Avenue BACKGROUND In 2008, the City purchased the property at 649 West 9th Avenue from the US Department of Housing and Urban Development (HUD) for a dollar with the intent to dispose of the property to Habitat for Humanity for construction of an affordable home. Due to turnovers in staff at Habitat, that sale never occurred. Subsequently, the structure was razed in 2009 by the City due to its dilapidated, uninhabitable condition. ANALYSIS The HUD $1 Program permits local communities to make properties available to low- and moderate - income (LIM) households or to a qualified non - profit entity. Staff met with the new Executive Director at Habitat to inquire if Habitat would be interested in the lot. To make the property affordable for a LMI family, the lot will be sold to Habitat for $1. Habitat proposes to construct a new single family home with construction to begin this spring. FISCAL IMPACT No service extensions are required and city services are already provided to the surrounding neighborhood. The disposition will place the property back on the property tax rolls from its current exempt status. RECOMMENDATION The Plan Commission approved of this request at its September 18, 2007 meeting. ANALYSIS In 2008, the City purchased the property from the US Department of Housing and Urban Development (HUD) for $1 through the HUD Dollar Home Initiative, a program available only to local governments. Local communities may make the properties available directly to low and moderate income households or through a qualified non - profit entity. The program does not permit HUD to sell property directly to a non - profit. Habitat originally had expressed interest in the property in 2008, but due to staff turnovers in the Habitat organization, the property was never transferred and in 2009, the City had the building razed due to its dilapidated condition. Staff recently met with the new Executive Director of Habitat and Habitat again expressed interest in obtaining this property for construction of an affordable single family home. RECOMMENDATION /CONDITIONS The Plan Commission approved of the land acquisition and disposition as requested. The following is the Plan Commission's discussion on this item. Susan Kepplinger, Principal Planner, presented the item and explained that it is the policy of HUD that if a property is on the market for six months that it can be sold to a local government entity for $1 with the stipulation that it be made available to low to moderate income households. Mr. Esslinger asked if the City could purchase the property for $1 and sell it for whatever we can get for it. Ms. Kepplinger responded that the requirement was that it be sold to a low -to- moderate income family and that the house was not in repairable condition. Mr. Esslinger inquired if the City could sell the land for a profit. Ms. Kepplinger responded that it would still have to be sold to a low- income family. Ms. Scherer questioned if there would be a condition that the new home would be designed to be compatible with neighborhood homes. Ms. Kepplinger replied yes. Motion by Scherer to move approval of the land acquisition and disposition of the property at 649 W. Ninth Avenue as requested with the following conditions: 1) The existing structures be razed and anew single family home be constructed in 2008. 2) The home shall be designed to be compatible in appearance with existing homes in the area subject to approval by the Department of Community Development. Seconded by Borsuk Motion carried 5 -0.
