Problem/Violation: Unsafe / unsanitary conditions and exterior maintenance.
Brief history review:
On 7/19/06 complaint was filed by Mr. Charles Radcliff who is currently a tenant at 105 E
Melvin Ave. The complaint stated that the kitchen sink had not been in working condition and
that previous attempts to repair the sink had been unsuccessful. It was also noted that the owner
of the property, OK Hui Fink, had been notified of the condition and she had purchased
replacement parts and had Mr. Radcliff attempt to fix the problem. Any repairs to plumbing
systems in a rental unit can only be completed by a licensed plumber, which Mr. Radcliff is not.
An inspection of the kitchen area was completed on July 25, 2006. The following conditions
were noted and photographed:
• The kitchen sink was not in working condition.
• The kitchen floor sustained water damage due to the leaking sink.
• The subfloor and floor joists may be damaged also due to the presence of water on the
floor. An inspection of the basement area was not permitted.
• Cockroaches and other insects were present both on the kitchen floor and specifically
inside the sink base cabinet. The degree of infestation is unknown.
• The ceiling in the living room is cracked and in such a condition that it poses a safety
hazard due to the fact that large pieces of plaster may fall causing injury.
• An exterior inspection found other violations of the Minimum Housing Code and
Property Maintenance Code. A Correction Notice has been issued for all existing
violations.
It is for the above mentioned reasons, specifically the insect infestation and unsanitary
conditions, that the house was posted "Unfit for Human Habitation Occupancy or Use" on July
26, 2006. This is the third time that the residence has been posted unfit. Several Correction
Notices have been issued to Ms. Fink for repeated violations of the City of Oshkosh's Minimum
Housing Code and Property Maintenance Code at this residence. (See attachments)
City Ordinance and State Statutes state that if a building is old, dilapidated or out of repair and
consequently dangerous, unsafe, unsanitary or otherwise unfit for human habitation and
unreasonable to repair, order the owner of the building to raze the building or, if the building can
be made safe by reasonable repairs, order the owner to either make the building safe and sanitary
or to raze the building, at the owner's option. Therefore, I am requesting approval to have this
structure located at 105 East Melvin Ave. razed unless all necessary repairs and are made.
The following repairs /corrections are required:
• A licensed plumber with a permit shall repair the kitchen sink.
• An exterminator shall be hired to eliminate the insect infestation.
• The kitchen floor shall be replaced. The subfloor shall also be replaced if water
damage has occurred.
• The ceiling in the living room shall be replaced or sufficiently repaired.
• All broken windows shall be replaced or repaired.
• All doors that are damaged, including storm doors, shall be replaced or repaired.
• All windows shall be effectively screened.
• The balcony shall be repaired. (Previous order)
• The roof shall be replaced. (Previous order)
• All junk/debris /tires shall be removed from the premises or properly stored.
• The lawn shall be maintained. Weeds shall be removed. All grass 8" or taller shall
be cut.
• The attic shall be abandoned, as it does not meet the requirements of a habitable
room. (Previous order)
• The number of residents at this address shall be reduced to no more than four (4)
including the owner unless: 1) The owner, Ms. Fink, no longer resides at this address.
2) The number of persons residing at this address does not violate City Ordinance
requirements as they pertain to minimum square footage of habitable space and 3) It is
documented that the person's living at the residence are related.
• The dwelling cannot be occupied until approved by Inspection Services Division
following an inspection of the entire premises to verify that no other violations exist.

Received a call to come to 420 to speak with Pete Donner in reference to a possible child protective placement
for Dellilah Murrell, Kayla Murrell, and Kasarah Ratcliff. He indicated that the building inspector (that being
Andrew Prickett) was going to post the house for no habitation due to some building code violations and insects
in the house.
I contacted Sgt. Gomoll. Myself, Sgt. Gomoll, and Officer Kirby, Pete Donner, and Andrew Prickett went over to
this address. We made contact with some of the tenants. Both Charles Ratcliff Sr. and Dorothy Ratcliff were not
present. We did speak with Karen Ratcliff, along with Kasarah. Charles Ratcliff Jr. was present. He was living
over at 1258 Titan Court #8. It should be noted that there were several other individuals who were present who
refused to identify themselves.
There was a vehicle present which was 811HLF, which returns to a '99 Cadillac DeVille, maroon in color.
Returns to a Zachary D. Malnory. He was there playing basketball with another white male.
Through the next two hours, most of the people we contacted were uncooperative. It was explained to them that
they would be able to go in the residence and get some property out, but they couldn't stay in it because it was
posted. Eventually at approximately 3:00 PM, Charles and Dorothy Ratcliff came walking down the sidewalk.
We had contact with them. There were numerous problems with them.
The building inspector had left at this time. He was asked to return and he did explain to the Ratcliffs that O.K.
Fink who is the property owner was responsible for the property and its repair, that until the repairs had taken
place it is posted as uninhabitable. They could go in and get some of their property out, but they couldn't remain
in the residence.
They continued to argue with myself, Pete Donner, and everybody else who was trying to help them. We had
attempted to find different places for them to stay. Pete Donner was looking at places for the chidden to stay if
the Ratcliffs could not provide information as to where these children would stay. Mr. Donner spoke to
somebody in Chicago who was on a cell phone who identified himself as Jerry Brown and stated that he was
one of the Ratcliff children and that he would be coming up and getting the children to bring them back to
Chicago. He did give a date of birth and an address in Chicago. Upon running this individual he came back not
on file.

Officer Kirby talked to one of the children and they identified their brother as a Fred Hunter so that information
given to myself and Mr. Donner obviously was false.
It was worked out that the children would be staying at Charles Ratcliff Jr's. apartment located at 1258 Titan Court
#8, and, based upon this final information and resolution, Mr. Donner was satisfied that the children would have
some place to stay. As a result of this he then left. Andrew Prickett, once again, came back to the area. He
attempted to explain to the Ratcliffs the rules, but they did not feel the rules should apply to them. They had paid
rent and they should have a right to live in a residence that has these problems.
We did not have occasion to meet the property owner, O.K. Fink.
At approximately 3:35 PM officers did clear after explaining to the Ratcliff family that they would be allowed to go
in and gather their property, but they would need to leave until the repairs to the residence are taken care of and
that the residence is posted as not inhabitable.
A copy of this complaint should be forwarded to Andrew Prickett from the City of Oshkosh Property Maintenance
Inspector, and a copy of this complaint should be forwarded to Peter Donner in the Department of Social
Services.
It should be noted the individual who had the '99 Cadillac DeVille, the plates were expired on it. He was told not
to move the vehicle. If he moved the vehicle he would be receiving a citation for expired plates. He indicated
he understood this, but as these problems escalated with the Ratcliff family, this individual did apparently get in
his vehicle and leave the area due to the fact that when we cleared the vehicle was no longer parked on the
roadway.
