in the City of Oshkosh has been painted and repaired pursuant to the Judgment for Abatement of
Public Nuisance and to Raze Property. I ask that after the City of Oshkosh has confirmed that the
premises has been painted and repaired, that you would supply me with a full satisfaction of the
Judgment.
After this Judgment has been satisfied, I will be contacting you to discuss possible settlement
of Mr. Raymond's outstanding Judgment on a previous violation (Winnebago County Case No. 06
FO 661).

YOU ARE HEREBY NOTIFIED that the two -story building situated on the following described
property, to wit:
The East 1/2 of Lots Thirty -one (31), Thirty -two (32) and Thirty -three (33) in ANDREW HEIS'S
REPLAT, in the Fourteenth Ward, City of Oshkosh, Winnebago County, Wisconsin.
Which premises are owned by you and known as 144 W. 22 Avenue has become damaged,
deteriorated, dilapidated and/or blighted to such an extent that the building offends the aesthetic
character of the neighborhood and produces blight or deterioration by reason of such condition.
Based upon the following conditions:
1. Deteriorated and broken windows and screens.
2. Cracked and peeling paint.
THEREFORE, you are hereby ordered to abate the nuisance(s) noted on this building within
thirty (30) days from the date of service of this order upon you.
YOU ARE FURTHER NOTIFIED that this order is served upon you pursuant to the terms and
provisions of Section 66.0413 Subsection (2) of the Wisconsin Statutes and in such case made
and provided. The City of Oshkosh will petition the county circuit court to declare this property
a nuisance and obtain a court order directing the owner to remedy the defect and make such
repairs and alterations as may be required. Furthermore, the City will seek court authorization
to raze and remove the affected structure(s) and restore the site to a dust free condition if the
court order is not complied with within the time fixed by the court. Additionally, the costs of
such razing and removal shall be charged against the property, shall be a lien thereon, and shall
be assessed and collected as a special tax.
YOU ARE FURTHER ORDERED AND NOTIFIED that should you fail to comply with this
order to remove any personal property or fixtures in the above described structure(s) in
accordance with Sec 66.0413(1)(i), Wis. Stats., within 30 days from the date of service of this
order upon you the City of Oshkosh may store the same, or may sell it, or if it has no appreciable
value may destroy the same. In case the property is stored and the amount paid for storage shall
be a lien against such property and against the real estate and shall be assessed and collected as a
special tax against the real estate if the real estate is owned by the owner of the personal property
and fixtures. If the property is stored and not claimed by the owner it may be sold at the
expiration of 6 months after it has been stored.

Problem/Violation of: Municipal Code 17 -36A; Failure to maintain the exterior of
buildings /structures on the premises.
Brief history review:
6/6/03 — After receiving a complaint, an inspection was made of the property located at 144 W
22 Ave. A review of the yard and house reveals the following areas /items to be repaired as the
enclosed photos illustrate:
1. The lawn was not being maintained.
2. The roof on the house was deteriorated and warranted replacement.
3. Paint was starting to chip and peel off several areas on the house.
A Correction Notice with compliance dates of 6/13/03 and 7/6/03 was issued to Mr. and Mrs
Raymond to address the violations that were found. At re- inspection the lawn had been mowed.
5/26/04 — After receiving another complaint the property was inspected again. Once again, the
lawn had not been maintained and no efforts had been made to address the roof and paint
conditions on the house. A buildup of junk and debris on the property was also noted. Another
Correction Notice and three multi -day citations were issued to Mr. Raymond for repeated
violations and failure to comply with the Correction Notice from 2003. A re- inspection on
9/1/04 found that the exterior conditions on the house had not improved.
1/5/06 — Following additional complaints a re- inspection is made. Again, junk and debris had
accumulated on the property and no work had been completed on the buildings exterior. A
Correction Notice was sent out with compliance dates of 1/13/06 and 2/5/06. No contact is made
with this office in response to the notice. On 2/15/06 a final notice is sent out stating that if Mr.
or Mrs. Raymond did not contact Inspection Services by 3/1/06 that a 30 day citation would be
issued for noncompliance.
3/7/06 — Having had no contact with Mr. or Mrs. Raymond, a 30 day citation is issued with a
court date of April 12, 2006. At court, Mr. Raymond's son appeared on his behalf and stated that
the repairs would be made. The matter was adjourned until 6/14/06 to allow for the repairs to be
completed.
6/14/06 — In the morning, before court, I re- inspected the property and found that the roof was in
the process of being replaced. At court, there was no appearance on behalf of Mr. Raymond.
Since I found that the repairs were underway, I asked the court to adjourn the matter another 30
days so the work could be completed. On June 20, 2006 I sent a letter to Mr. Raymond which
stated that if all the remaining repairs were completed and re- inspected by the July 12, 2006 court
date that the citation could be reduced. It was also stated in the letter that if the work was not
completed no reduction would be given.
7/11/06 — The day before the adjourned court date I re- inspected the property and found that
while the roof had been completed, nothing had been done to address the paint conditions on the
house. At court on July 12, 2006 a default judgment was made against Mr. Raymond due to the
fact that he had not complied with the requirements of the Correction Notice and failed to appear
in court.
8/23/06 — Once again, complaints are received by this office concerning the exterior maintenance
of the house. An inspection found that there were three broken windows, excessive weed growth
and the painting still had not been done. A Correction Notice was sent out on 8/24/06. No
contact is made with this office but the windows did get repaired and the weeds were cut down.
8/7/07 — Another complaint is received concerning the unkept conditions of the lawn and house.
At inspection it was found that the yard was not being maintained free of tall grass and weeds,
more broken windows were seen and the painting had not been done. A grass notice was issued
and the Correction Notice from 8/24/06 was re- issued. As of February 29, 2008 the required
exterior maintenance still has not been completed.
Enclosed are copies of numerous Correction Notices that have been issued for failure to maintain
this property, as well as photos of the property. The property at 144 W 22n Ave. is a blighting
influence on this neighborhood and has been the source of numerous property maintenance
complaints. City Ordinance and State Statutes state that if a building is old, dilapidated or out of
repair and consequently dangerous, unsafe, unsanitary or otherwise unfit for human habitation
and unreasonable to repair, order the owner of the building to raze the building or, if the building
can be made safe by reasonable repairs, order the owner to either make the building safe and
sanitary or to raze the building, at the owner's option.
We are requesting an abatement order that would require: (1) the house razed and removed or (2)
if the owner should choose to repair the house, require the owner to make the necessary repairs.

Re: Citation for failure to maintain exterior of your property. June 20, 2006
Dear Mr. Raymond,
I am following up with you in regards to the citation that was issued to you for violating
City Ordinance 17 -36A — failure to maintain the exterior surfaces of your property. In
court you were represented by your son and ordered to work with the Inspection Services
Division to bring your property into compliance with City Codes. A motion was made to
adjourn the matter till June 14, 2006 at which time if all repairs were completed then the
citation would be reduced. You failed to appear or have representation appear on your
behalf.
I conducted an inspection of your property the morning of June 14, 2006, which revealed
that the roof was in the process of getting replaced. Although all repairs necessary to
bring your property into compliance with the Correction Notice you were issued were to
be completed by your adjourned court date, I asked the attorney for the City of Oshkosh
to adjourn the matter until July 12, 2006. If all repairs are completed and a re- inspection
of the property scheduled and passed, then you will still be able to receive a reduction on
the citation that you were issued. However, if the repairs are still not completed and/or
you fail to appear at your next court date, no reduction on the citation will be given.
Your next court date is scheduled for July 12, 2006 at 10:00 am, Rm. 194, 420 Jackson St

• The above - entitled matter, having come before the Honorable Bruce K. Schmidt, Circuit
Court Judge, on a motion for judgment and the court having reviewed the documents on file
herein and being fully advised in the premises, therefore makes and files the following findings
of fact and conclusions of law constituting its decision in this action.
FINDINGS OF FACT
1. That the allegations of the Petition are proven and true.
2. That the Summons and Complaint in the above - entitled action was duly and
personally served on David D. Raymond and Karen L. Raymond. M & I Marshall & Ilsley Bank
and Winnebago County Clerk of Circuit, though its Corporation Counsel, admitted service of the
Summons and Complaint. M & I Marshall & Ilsley Bank, Karen L. Raymond and Winnebago
County Clerk of Circuit Court failed to file an answer within the statutory time allowed for
answer and are in default. David D. Raymond has stipulated to entry of judgment. The plaintiff
is entitled to judgment.
3. Due notice of the pendency of this action was duly filed October 7, 2008 as Document
Number 1485055 and more than 20 days prior to the trial of this action, in the office of the
Register of Deeds for Winnebago County, Wisconsin, in the manner and form required by law.
4. That the premises at 144 W. 22 Avenue in the City of Oshkosh are the subject matter
of this action and are more particularly described as follows:
The East Y2 of Lots Thirty-one (31), Thirty-two (32) and Thirty -three (33) in
ANDREW HEIS'S REPLAT, in the Fourteenth Ward, City of Oshkosh,
Winnebago County, Wisconsin.
5. That the premises at 144 W. 22 Avenue in the City of Oshkosh constitute a public
nuisance pursuant to Section 66.0413(2), Stats., and Chapter 823, Stats.
NOW, ON MOTION OF JOHN M. BLAZEL, ATTORNEY FOR THE PETITIONER it is
ordered, that an order be entered requiring the nuisance to be abated pursuant to the demand in
the Petition and in accordance with the above findings and conclusions.
JUDGMENT FOR ABATEMENT OF PUBLIC NUISANCE
AND JUDGMENT TO RAZE PROPERTY
The court having issued its' findings of fact, hereby orders and adjudges:
1. That the owner of the premises at 144 W. 22 Ave. in the City of Oshkosh, abate the
public nuisance on that premises pursuant to Section 66.0413(2), Stats., and Chapter 823, Stats.
2. That the public nuisance be abated by repairing the deteriorated and broken windows
and screens and by ,scraping the peeling paint and by painting the unpainted and scraped surfaces
by June 30, 2009.
3. That if the nuisance is not abated and the building repaired and painted by June 30,
2009, the City of Oshkosh Building Inspector will be authorized to take such actions as are
necessary to raze the building in compliance with all federal, state and local laws and/or to take
such other actions as are necessary to abate the nuisance.
4. That pursuant to Section 66.0413, Stats., the cost of securing the building may be
charged in full or in part against the real estate upon which the public nuisance is located, and if
that cost is so charged, it is a lien upon the real estate and may be assessed and collected as a
special tax. Any portion of the cost charged against the real estate that is not reimbursed under
Section 632.103(2) from funds withheld from insurance settlement may be assessed and
collected as a special tax.
5. That pursuant to Chapter 823, Stats., the City shall have execution in the common
form for the City's damages and costs incurred in abating the nuisance and the City shall be
entitled to a warrant to the Oshkosh Building Inspector requiring the Building Inspector to abate
the nuisance at the expense of the respondent, David D. Raymond.
6. That pursuant to Chapter 823, Stats., the expense of abating the nuisance pursuant to
the warrant shall be collected by the building inspector in the same manner as damages and costs
are collected upon execution or may be collected by finding the respondent, David D. Raymond,
personally liable for the expenses, as provided in Section 74.53, Stats. The building inspector -
may sell any items abated or removed as a nuisance in the manner that personal property is sold
upon execution and may apply the proceeds to pay the expenses of the abatement, paying the
residue, if any, to the respondent.
7. That the City be awarded court costs /recording costs in the amount of $256.00,
recording of certified Lis Pendens of $14.00, title work in the amount of $50.00, service fees in
the amount of $124.00 together with statutory attorney's fees of $100.00, for a total of $544.00
against David Raymond. Said amount is payable to Attorney John M. Blazel's trust account and
is due within 60 days of this order. If said amount is not paid as set forth above, it shall be a lien
upon the real estate and may be assessed and collected as a special tax.
8. That David D. Raymond and any others occupying the premises shall vacate the
premises by June 30, 2009, if the nuisance has not been abated and the defects remedied and
repairs and alterations completed. That the City may apply for a Writ to have the sheriff remove
David D. Raymond, if he does not comply as set forth herein.
9. That if David D. Raymond should fail to comply with this judgment and fail to
remove any personal property or fixtures in the above described structure(s) in accordance with
Sec 66.0413(1)(i), Wis. Stats., then the City of Oshkosh may store the same, or may sell it, or if
it has no appreciable value may destroy the same. In case the property is stored, the amount paid
for storage shall be a lien against such property and against the real estate and shall be assessed
and collected as a special tax against the real estate if the real estate is owned by the owner of the
personal property and fixtures. If the property is stored and not claimed by the owner it may be
sold at the expiration of 6 months after it has been stored.

Allyn and I are negotiating with Raymond's attorney to have the repairs made. I believe that we have that worked
out. Raymond's attorney is Emily Zimmerman. She is wondering whether it is possible to negotiate a reduction in
the judgments against her client that appear to be as a result of him failing to pay citations that were issued against
him for building code violations. The judgments are in favor of the clerk of courts so I don't think that there is much
we can do. However, I wanted to check with you to inquire whether that is something that you have dealt with
before.

This has been a long and protracted case and frankly I do not believe we've receive the best cooperation on this case.
However, we recognize the building cannot be painted this time of the year. I do not believe August 31, 2009 is an acceptable
compliance date. This needs to be made a priority. Given that, I initially was going to set a date of May 31, but I also
recognize spring can pose some complications with wet weather (and given the location the Lake Fly hatch could be a
problem.) For these reasons, I believe this should be completed by June 30, 2009. If not done, there must be some very
compelling reasons why its not done.

Here are the photos from today. I am guessing the "window" issue had to do with a couple that were broken on the Ease side.
Those have been repaired. I have been involved with this property since I started in 2006. Looking at the file it would seem
that the property has been under orders for exterior maintenance since 2003. I would not feel good about the August 31, 2009
date for completion due to the fact that the property has been an eyesore for the area for years and I would be afraid that if
compliance was still an issue that the noncompliance would drag on for yet another year. I would be fine if we said that we
would be checking on the property at the beginning of June and that if significant progress was made by then that we would
afford additional time to complete (30 days). I am assuming that we would also have enough time to continue with court
proceedings if in June it was found that no progress had been made?

I've been in contact with David Raymond's attorney. She has indicated that it is his position that he has taken care of the
windows and the only issue that is left to be addressed is painting the structure. Obviously he is unable to do that. He would
like to have until August 31st to have the structure painted. I told her that I would speak to you to find out if you agreed that
painting was the only item that needed to be left and then we could set a time line for accomplishing that. If we can reach an
agreement we can perhaps stipulate to a resolution of this matter.
Please let me know at your convenience what your thoughts are about the matter.

Dear Allyn:
Enclosed is a copy of the answer that was filed by David Raymond in our abatement action. I've
also enclosed a copy of our complaint for your reference. I spoke with Raymond's attorney. She
advised me that she believed that he had taken care of the window issue but recognized that he
still needed to paint. Raymond's position is that he wants to be able to do the work in order to
repair the building. He is currently living in Minnesota and says that he did not get notice of this
matter because we were not able to serve him and had to publish instead.
I advised his attorney that she should talk to him and present us with a timeline for completing
the work necessary to bring the property into compliance. I wanted to make you aware of this so
that you could double check on the status of the work on the property. If we are able to reach an
agreement I would like to structure it so that if the work is not done by a certain date the city
would be entitled to an order to raze the property. If the work is done then the city would
dismiss the action.
I will contact you again as soon as I have a timeline from Raymond.

1. That the City of Oshkosh is a Wisconsin Municipal Corporation with its primary
offices at 215 Church Avenue, P.O. Box 1130, Oshkosh, WI 54902.
2. That upon information and belief, the defendant, David D. Raymond, is an adult
resident of the State of Wisconsin residing at 144 W. 22 Avenue, in the City of Oshkosh,
Wisconsin 54902.
3. That the defendant, M & I Marshall & Ilsley Bank is banking corporation with their
principal office located at 770 N. Water Street, Milwaukee, WI 53201 -2035 and is named as a
defendant due to a mortgage in the original amount of $78,000 which was dated September 27,
2006 and recorded in the Office of the Register of Deeds on October 4, 2006 as Document
Number 1413201.
4. That the defendant, Karen L. Raymond, is an adult resident of Winnebago County
residing at 1653 Doty Street, Oshkosh, Wisconsin and is named as a defendant by virtue of a
judgment as contained in a Marital Settlement Agreement incorporated in the Findings of Fact,
Conclusions of Law and Judgment of Divorce which was filed in the Office of the Clerk of
Courts for Winnebago County on March 3, 2004 as Case No. 03FA71.
5. That the defendant, Winnebago County Clerk of Circuit Court, has an address of 415
Jackson Street, P.O. Box 2808, Oshkosh, WI 54903 -2808 and has an interest in the property by
virtue of a non traffic ordinance judgment against the defendant, David D. Raymond, which was
docketed in the Office of the Clerk of Courts for Winnebago County, Wisconsin on October 4,
2006 at Case No. 06 FO 661.
6. That David D. Raymond is the owner of 144 W. 22 Avenue in the City of Oshkosh.
7. The City served the defendant, David D. Raymond with a Notice and Order. The
Notice and Order is attached hereto as Exhibit A.
8. The Notice and Order was served by means of publication because the City was
unable to obtain personal service after exercising due diligence.
9. That the Notice and Order required Raymond to repair the deteriorated and broken
windows and screens and further required Raymond to address the cracked and peeling paint.
10. That the violations of City ordinances are taking place at 144 W. 22n Avenue, in the
City of Oshkosh, which is more particularly described as follows:
The East 1 /2 of Lots Thirty -one (31), Thirty-two (32) and Thirty-three (33) in
ANDREW HEIS'S REPLAT, in the Fourteenth Ward, City of Oshkosh,
Winnebago County, Wisconsin.
11. That the violations have been repeated and continuous since that date.
12. That the violations include the following: Section 17 -36A of the Oshkosh Municipal
Code is being violated because the defendant, David D. Raymond, has failed to maintain the
exterior of every structure or accessory structure in good repair and has failed to keep all exterior
surfaces painted or covered with exterior siding for the purposes of preservation and appearance.
Defendant has further failed to repair or replace broken windows.
13. That the conditions of the property constitute repeated violations of City ordinances.
14. That the repeated violations constitute a public nuisance.
15. That the defects in the building which were noted in the Notice and Order are that the
building has deteriorated to the extent that it offends the aesthetic character of the neighborhood
or produces blight or deterioration by reason of its condition.

surfaces painted or covered with exterior siding for the purposes of preservation and appearance.
Defendant has further failed to repair or replace broken windows.
13. That the conditions of the property constitute repeated violations of City ordinances.
14. That the repeated violations constitute a public nuisance.
15. That the defects in the building which were noted in the Notice and Order are that the
building has deteriorated to the extent that it offends the aesthetic character of the neighborhood
or produces blight or deterioration by reason of its condition.

16: That the defendant, David D. Raymond, has failed to raze or repair the premises
within the time allowed by the Notice and Order.
WHEREFORE, the City of Oshkosh requests the following relief:
A. For an Order requiring the owner to raze or repair the premises.
B. For an Order requiring any persons occupying the building to vacate the premises.
C. For such costs, fees and expenses as shall be allowed pursuant to Section 66.0413,
Stats., and otherwise allowed by law.
D. For an Order authorizing the Building Inspector to proceed to raze the building if the
building is not razed or repaired by the property owner.
E. For a determination that the building and premises constitute a public nuisance
pursuant to Chapter 823, Stats.
F. For an Order enjoining the public nuisance.
G. No monetary or injunctive relief is being sought personally as to M & I Bank, Karen
L. Raymond or Winnebago County Clerk.
H. For such other and further relief as may be just and equitable.
