HomeMy WebLinkAbout10-20JANUARY 26, 2010 10 -20 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE INITIAL RESOLUTION FOR SPECIAL ASSESSMENTS / SANITARY SEWER, WATER MAIN AND LATERALS (KOELLER STREET, LINDEN OAKS, SHOREWOOD DRIVE & MERRITT AVENUE) INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows: 1. The Common Council hereby declares its intention to exercise its power under Section 66.0703 and 66.0705 of the Wisconsin Statutes to levy special assessments upon property within the following described areas for benefits conferred upon such property by improving the following: Sanitary Sewer and Water Main Koeller Street from 800 ft. North of 9th Ave. to 85 ft. North of Menards Drive Sanitary Sewer, Water Main, Sewer Lateral (New and Relay), Water Lateral (New) Linden Oaks from 9th Avenue to 450 ft. south Shorewood Drive from Nicolet Drive to 100 ft. north Merritt Avenue from Bowen Street to Hazel Street 2. The total amount assessed against such district shall not exceed the total cost of the improvements and the amount assessed against any parcel shall not be greater than the benefits accrued thereto from said improvements. 3. The assessments against any parcel may be paid according to the provisions of Section 25 -83 through 25 -89 of the Oshkosh Municipal Code. 4. The Board of Public Works is directed to prepare a report consisting of: (a) Final plans and specifications for said improvements. (b) An estimate of the entire cost of the proposed work or improvements. JANUARY 26, 2010 10 -20 RESOLUTION CONT'D (c) An estimate as to each parcel of property within the assessment district of: (1) The assessment of benefits to be levied for each improvement. (2) The damages to be awarded for property taken or damages by each improvement. (3) The net amount of benefits over damages or the net amount of damages over benefits for each improvement. Upon completion of such report, the Board of Public Works is directed to file a copy thereof in the City Clerk's Office for public inspection. 5. Upon receiving the report of the Board of Public Works, the City Clerk is directed to give notice of a public hearing on such reports as specified in Section 66.0703(7)(a) of the Wisconsin Statutes. The hearing shall be held by the Board of Public Works at the Council Chambers in the City Hall at a time set by the Clerk in accordance with the Wisconsin Statutes. 6. The installation of said street improvements shall be accomplished according to the provisions of Section 25 -3 through 25 -11 of the Oshkosh Municipal Code. Gohde, Assistant Director of Public Works DATE: January 21, 2010 RE: Approval of Initial Resolution for Special Assessments/ Sanitary Sewer and Water Main/ Koeller Street BACKGROUND This resolution is the initial resolution for allowing the City to assess abutting property owners for improvements completed by the City. The proposal is to install sanitary sewer and /or water main under Koeller Street from approximately 800' north of 9 th Ave. to 85' north of Menards Dr. A portion of this work will be funded 90% by the Wisconsin Department of Transportation. The installation of the utilities allows additional lots /areas to be served by City water and sewer services. The City has a policy to assess abutting property owners for the cost to provide the service. ANALYSIS The resolution allows City Staff to proceed with preparing assessments for the abutting properties. A public hearing and final resolution need to be approved by the Council prior the assessments being levied on the properties. FISCAL IMPACT Assessments allow the City to recover a portion of the costs associated with projects from benefiting properties. Funding for the projects is included in the 2010 Capital Improvement Program under Sanitary Sewer and Water Main sections. RECOMMENDATIONS I recommend approval of the initial resolution. The proposal is to install sanitary sewer, water main, sewer lateral (new and relay) and water laterals (new) in several locations. The locations are Linden Oaks from 9th Ave to approximately 450' south and Shorewood Dr from Nicolet Dr. to 100' north, these will serve properties attaching to the City. The other location is Merritt Ave. from Bowen St. to Hazel St. Sanitary sewer laterals will be relaid with sewer main construction. The installation of the utilities allows additional lots /areas to be served by City water and sewer services. The relay of sanitary laterals provides a new water tight lateral in the right of way. The City has a policy to assess abutting property owners for the cost to provide the service.
