HomeMy WebLinkAboutBoard of Zoning Appeals (minutes) - 12/02/1992 BOARD OF ZONING APPEAL MINUTES PAGE -3- DECEMBER 2, 1992 Motion by Krueger to approve the variance as requested contingent upon a Certified Survey Map (CSM) being developed to create the two lots in question. Seconded by Stover. Motion carried 4 -0. As to the Findings of Fact, Mr. Krueger stated the two lots in question were developed long before the Zoning Ordinance was put in place and by granting this variance, we are making two equal size lots which will give a straighter property line to a number of properties in that area. IV: 2275 WELDON COURT - Rev. Carl and LaVonne Knitt, owners; Attorney Paul G. Swanson, applicant The applicant, Attorney Paul G. Swanson; on behalf of Rev. Carl and LaVonne Knitt, owners, is requesting a variance to construct a deck attached to the dwelling with a 10 ft. rear yard setback; whereas Section 30 -15(B) R -1 Single Family Residence District of the City of Oshkosh Zoning Ordinance requires a 25 ft. minimum rear yard setback for decks attached to a dwelling. AT THE REQUEST OF THE APPLICANT, THIS ITEM HAS BEEN LAID OVER. V: 724 JACKSON STREET - Norman R. Bock, owner /applicant Norman R. Bock, owner /applicant requests a variance to construct an entrance /exit platform with a 3 -1/2± ft.side yard setback; whereas Section 30 -19(B) R -5 Multiple Family Dwelling District of the City of Oshkosh Zoning Ordinance requires a 7 -1/2 ft. minimum side yard setback. Mr. Bock gave a brief history of the property in question and reiterated his variance request. Mr. Bock distributed three photographs of the platform in question for the Board's review (said pictures not being made a part of these minutes). He noted the uniqueness of the structure is that it juts out about 1 ft. on the north side and that there is a furnace vent on the affected side of the house that would have to be contained. Mr. Bock also distributed a letter he received from his insurance carrier stating that he was required to provide a safe exit /entrance way in the case of emergency (said letter not being made a part of these minutes). Chairman Stover inquired if the area in question was the main entrance /exit prior to the construction of the platform and Mr. Bock indicated that it was. Mr. Dellantonia inquired as to what the entrance /exit looked like before the construction. Mr. Bock stated the occupants opened the door and immediately went down some steps. Discussion ensued as to viable alternatives and it was determined that there were viable alternatives, (i.e., having the steps from the platform lead to the east) that could be taken to comply with the Zoning Ordinance.
