Moore, Principal Planner; Patricia Wendorf, Recording Secretary Chairman Slover called the meeting to order at 3:30 P.M. Roll call was taken and a quorum declared present. Motion by Roehlig for approval of the April 7, 1993 minutes as distributed; Seconded by Slover. Motion carried 4 -0. Chairman Slover informed the applicants that 4 affirmative votes are required to approve a variance; if 3 affirmative votes, the item will be laid over; less than 3 affirmative votes, the item is denied. He also explained the process for obtaining building permits, if the variance is approved, or the appeal process, if the variance is denied. I: 2275 WELDON COURT - Rev. Carl and LaVonne Knitt, owners; Attorney Paul G. Swanson, applicant The applicant, Attorney Paul G. Swanson; on behalf of Rev. Carl and LaVonne Knitt, owners, is requesting a variance to construct a deck attached to the dwelling with a 16 ft. rear yard setback; whereas Section 30 -15(B) R -1 Single Family Residence District of the City of Oshkosh Zoning Ordinance requires a 25 ft. minimum rear yard setback for decks attached to a dwelling. THIS ITEM WAS WITHDRAWN FROM THE AGENDA PER THE OWNERS' REQUEST. III: 2413 SOUTH MAIN STREET - Ardythe A. Timm - Davis, owner; Steven J. Davis, applicant The applicant is requesting a variance to construct a sign which projects 24 inches above the peak of an existing roof line of a structure; whereas Section 3- 33(E)(2)(d) of the City of Oshkosh Zoning Ordinance permits a maimum projection of 12 inches for a sign above an existing structure's roof. Steven J. Davis gave a brief history of the property in question and reiterated the variance request. Because of the age of the signs, weather deterioration, and wind damage, the signs are showing evidence of rotting and they would like to be able to keep up the appearance of the property. The signs have been on the structure for nearly the length of time the business has been in operation, which is approximately 45 years. The signs are important to the business as they are the actual menu that the customers read. Mr. Krueger inquired if the signage would meet the Zoning Code. Ms. Moore stated that she assumed Mr. Krueger was referring to the sign area and stated that it was her understanding that the 30% rule would be met by the proposed signs. (MR.
