HomeMy WebLinkAbout10-05JANUARY 12, 2010 10 -05 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: ACCEPT SIDEWALK EASEMENTS AT 1137 BOWEN STREET AND 720 EAST NEW YORK AVENUE INITIATED BY: DEPARTMENT OF PUBLIC WORKS PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the City hereby accepts sidewalk easements at 1137 Bowen Street and 720 East New York Avenue, per the attached, and the proper City officials are authorized and directed to execute any and all documents necessary for purposes of same. 1'HK 1H ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Service DATE: January 7, 2010 RE: Approve Accepting Sidewalk Easements / 1137 Bowen Street and 720 East New York Avenue (Plan Commission Recommends Approval) BACKGROUND The subject properties are located along the west side of Bowen Street at the E. New York Avenue intersection. The immediate area is predominately single family residential in a well - established neighborhood with R -1 and R -2 zonings. In the summer of 2009, E. New York Avenue was reconstructed, which included the replacement of public sidewalks. ANALYSIS The purpose of the easement request is to allow placement of ADA- compliant wheelchair ramps at the northwest and southwest corners of the intersection which were constructed this past summer. A small area of additional land outside public right -of -way is required for construction of the ramps. Each triangular easement runs five feet along each street and approximately seven feet along the hypotenuse totaling 12.50 square feet. The easements will not have a negative impact on either property and are necessary for the placement of the wheelchair ramps. The Department of Public Works will work with the property owners to have appropriate easement documents signed and, if approved, will be recorded at the Winnebago County Register of Deeds. FISCAL IMPACT N/A RECOMMENDATION The Plan Commission approved of this request at its December 15, 2009 meeting. NEW YORK AVENUE Plan Commission meeting of December 15, 2009 GENERAL INFORMATION Petitioner: City of Oshkosh, Department of Public Works Owners: James Ellerbusch, Karen Boutin Action Requested: The Department of Public Works is requesting acceptance of two sidewalk easements located at the west side of the intersection of E. New York Avenue and Bowen Street. Applicable Ordinance Provisions: N/A Property Location and Type /Analysis: The subject properties are located along the west side of Bowen Street at the E. Staff does not have any concerns with the easements as they are necessary for the placement of the wheelchair ramps. The Department of Public Works will work with the property owners to have appropriate easement documents signed. After review by the Plan Commission and approval by the Common Council, the easement will be recorded at the Winnebago County Register of Deeds. RECOMMENDATION /CONDITIONS The Department of Community Development recommends approval of the acceptance of the proposed sidewalk easements as requested. The Plan Commission approved of the sidewalk easements as requested. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item, reviewed the site, and explained that the purpose of the easements were to allow placement of ADA- compliant wheelchair ramps at the northwest and southwest corners of the intersection which were constructed this past summer. Motion by Nollenberger to approve sidewalk easements for properties located at 1137 Bowen Street and 720 E. New York Avenue as requested. Seconded by Borsuk. Motion carried 9 -0.
